HomeMy WebLinkAboutCouncil Minutes 06-25-2019322 The City Council of the City of Plainview met on June 25, 2019 at 7:00 p.m., in the Council Chambers of the Plainview City Hall at 901 Broadway. Mayor Wendell Dunlap presided. Councilmembers present were: Nelda VanHoose- District 1, Larry Williams -District 2, Norma Juarez -District 3, and Susan Blackerby-District 5. Councilmember Teressa King -District 4, Evan Weiss -District 6 and Oliver Aldape- District 7 were absent. Staff members present were: Jeffrey Snyder -City Manager, Matthew Wade -City Attorney, Sarianne Beversdorf-Di rector of Finance, Ken Coughlin -Chief of Police, Tim Gibson -Fire Chief, Isauro Gutierrez -Director of Information Technology, Rachael Foster -Director of Human Resources, Jeff Johnston -Community Development Manager, Paul Kite - Assistant Director of Utilities, Melinda Brown -Main Street Manager and Belinda Hinojosa- City Secretary. Motion: Move to accept Annual Report. Motion by Mayor Pro Tern Blackerby, seconded by Councilmember VanHoose Vote: 5-0. Motion carried. 5. An Ordinance Amending the City of Plainview Texas Code of Ordinances by Amending Chapter 4 "Business Regulations" by Adding Article 4.12 Entitled "Film Production — Guidelines and Permit" Establishing a Permitting Process and Regulating Film Production and Filming Within the City and on Public Property; Providing for a Penalty not to Exceed $500 00 per day and Injunctive Relief for Failing to Obtain a Permit; Providing an Effective Date• Providing a Savings Clause; Providing a Repealer and Providing for Publication. (Ordinance No. 19-3693 — Second Reading) Motion: Move to adopt Ordinance No. 19-3693 on second reading Motion by Councilmember Juarez, seconded by Councilmember VanHoose Vote: 5-0. Motion carried. 6. An Ordinance Granting to Southwestern Public Service Company D/B/A Xcel Energy. its Successors and Assigns the Non -Exclusive Right to use and Occupy Rights - Of -Way Within the City of Plainview for the Construction and Operation of an Electric Transmission and Distribution System• Prescribing Conditions Governing the Use of the Public Rights -Of -Way' Providing for Compensation Designating an Effective Date and a Term of said Franchise Providing For Written Acceptance Of This Franchise; Finding that the Meeting at which this Ordinance is Passed is Open to the Public; and Providing For Severability. (Ordinance No. 19-3694 — First Reading) Presenter: Jeffrey Snyder, City Manager This Ordinance renews the franchise agreement with Southwestern Public Service Company to maintain and operate their electric transmission and distribution systems within the City of Plainview for a period of ten years. An Ordinance Amending Ordinance 19-3690 of the City of Plainview, Texas and Amending the Zoning Map of the City Of Plainview as set out in 04.02.003 of the Code of Ordinances by Changing from "General Commercial (GC)" to "Suburban Residential (SR)" that Certain Tract of Land out of Lots 5 and 6 Block 2, Brandes Subdivision of City Council Minutes June 25, 2019 Page 2 of 4 324 Blocks 35_and 36, West Boswell Heights Addition and Block 83, College Hill Addition to the Town of Plainview, Hale County, Texas 0 003 Amarillo Street); Providing a PenaltL Providing an Effective Date; Providing a Savings Clause; and Providing for Publication. (Ordinance No. 19-3695 — Second Readingl Public Hearing was opened at 7:17 p.m. with no public comment. Public Hearing was closed at 7:18 p.m. Motion: Move to approve Ordinance No. 19-3695 on second reading. Motion by Councilmember Williams, seconded by Councilmember Juarez Vote: 5-0. Motion carried. 8. A Resolution of the City Council of the City of Plainview, Texas Supporting and Authorizing the Filing of a Grant Application for Funds with the Better Utilizing Investments to Leverage Development (BUILD) Discretionary Grants Program for the 24th Street Reconstruction Project; Designating an Authorized Official and Authorizing such Official to Execute all Documents Necessary and Pledging Compliance to the Awarded Grants Program (Resolution R19-443) Presenter: Jeffrey Snyder, City Manager This authorizes the City to submit a grant application to the U.S. Department of Transportation's Better Utilizing Investments to Leverage Development (BUILD) Discretionary Grant Program. The proposed project will be focused on safety enhancements to include a turning lane at Joliet Street and 24th Street Intersection. Motion: Move to approve Resolution R19-443 Motion by Mayor Pro Tern Blackerby, seconded by Councilmember VanHoose Vote: 5-0. Motion carried. 9. Consider and take necessary action regarding Interlocal Governmental Cooperation Contract for Administrative Services and Authorize Mayor to Sign Presenter: Jeffrey Snyder, City Manager This Agreement allows SPAG to provide administrative services for the Main Street grant. Motion: Move to authorize Mayor to sign Interlocal Governmental Contract for Administrative Services with South Plains Association of Governments Motion by Mayor Pro Tern Blackerby, seconded by Councilmember Juarez Vote: 5-0. Motion carried. 10. A Resolution by the Council of the City of Plainview Texas Designating Authorized Signatories for Contractual Documents and Documents for Requesting Funds City Council Minutes June 25, 2019 Page 3 of 4 and Pertaining to the Texas Capital Fund Main Street Program (TCF-MS) Contract 325 Number 7218162. (Resolution R19-444) Presenter: Jeffrey Snyder, City Manager This authorizes the signatories for the contractual documents for the Texas Main Street Capital Grant. Motion: Move to approve Resolution R19-444 Motion by Councilmember Juarez, seconded by Councilmember Williams Vote: 5-0. Motion carried. 11. A Resolution of the City Council of the City of Plainview, Texas Adopting and/or Reaffirming the Requirements of the Texas Capital Fund — Main Street Program Through the Texas Department of Agriculture and Designating a Civil Rights Officer and Fair Labor Standards Officer as a Part of the Grant Program. (Resolution R19-445) Presenter: Jeffrey Snyder, City Manager This Resolution states that the City adopts and/or reaffirms that it will comply with the requirements of the grant program and appoints the Civil Rights Officer and Labor Standards Officer to serve throughout the grant period.
