HomeMy WebLinkAboutCouncil Minutes 07-23-2019328 The City Council of the City of Plainview met on July 23, 2019 at 7:00 p.m., in the Council Chambers of the Plainview City Hall at 901 Broadway. Mayor Wendell Dunlap presided. Councilmembers present were: Nelda VanHoose- District 1, Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, and Evan Weiss -District 6. Councilmembers Susan Blackerby-District 5 and Oliver Aldape- District 7 were absent. Staff members present were: Jeffrey Snyder -City Manager, Bryan Guymon -City Attorney, Jeff Johnston -Assistant City Manager, Sarianne Beversdorf-Di rector of Finance, Ken Coughlin -Chief of Police, Tim Gibson -Fire Chief, Isauro Gutierrez -Director of Information Technology, Rachael Foster -Director of Human Resources, Paul Kite -Assistant Director of Utilities, Melinda Brown -Main Street Manager, Brock Lively -Landfill Foreman and Belinda Hinojosa-City Secretary. Invocation and Pledge of Allegiance Mayor Wendell Dunlap 2. Recognitions. The Council recognized Isauro Gutierrez, Melinda Brown, Rachael Foster, Brock Lively and Belinda Hinojosa, Certified Public Manager Graduates. 3. Consent Calendar a) Excused Absences — Councilmembers Susan Blackerbv and Oliver Aldape b) Minutes of June 20, 2019 and June 25, 2019; c) Financial Reports d) Quarterly Investment Report for the period from April 1, 2019 through June 30, 2019 e) Appoint Carol Terrell to the Main Street Board to complete the unexpired term of Dora Sanchez with said term to expire on January 1, 2021 Motion: Approve Consent Calendar Motion by Councilmember King, seconded by Councilmember Weiss Vote: 6 — 0. Motion carried. 4. An Ordinance Granting to Southwestern Public Service Company D/B/A Xcel Energy, its Successors and Assigns the Non -Exclusive Right to use and Occupy Rights - Of -Way Within the City of Plainview for the Construction and Operation of an Electric Transmission and Distribution System, Prescribing Conditions Governing the Use of the City Council Minutes June 25, 2019 Page 1 of 4 Public Rights -Of -Way; Providing for Compensation Designating an Effective Date and a 329 Term of said Franchise Providing For Written Acceptance Of This Franchise; Finding that the Meeting at which this Ordinance is Passed is Open to the Public; and Providing For Severability. (Ordinance No. 19-3694 — Second Reading) Since this was the second of two readings, the Council chose to forego staff briefing. Motion: Move to approve Ordinance No. 19-3694, the Southwestern Public Service Company Franchise Agreement, on second reading, with the following amendment: Amend Section 4, Indemnity, as approved at the first reading, to be consistent with the 2009 franchise agreement Indemnity provision but add the phrase "not associated with the Company" at the end of the first sentence of Section 4(B). Motion by Councilmember Williams, seconded by Councilmember Juarez Vote: 6-0. Motion carried. 5. An Ordinance of the City Council for the City of Plainview, Texas Authorizing the Transfer of Certain Real Property in the City of Plainview Texas to Hale County, Texas, In Accordance with Section 272.001 of the Texas Local Government Code; Authorizing the Mayor to Execute All Documents Necessary to Transfer Ownership; (Ordinance No. 19-3696 — First Reading) Presenter: Jeffrey Snyder, City Manager This Ordinance authorizes transfer to the County of one-half interest of real property in this 1.812-acre tract of land purchased for the business park. Motion: Move to adopt Ordinance No. 19-3696 on first reading Motion by Councilmember Weiss, seconded by Councilmember VanHoose Vote: 6-0. Motion carried. 6. A Resolution Supporting City of Plainview's Application to the Texas Department of Transportation's 2019 Transportation Alternatives Set -Aside (TASA)/Safe Routes to School -Infrastructure (SRTS) Call for Projects. (Resolution R19-446) Presenter: Tim Crosswhite, Director of Public Works This Resolution authorizes submittal of the grant application to the TxDOT Set Aside Grant Program. Motion: Move to adopt Resolution R19-446 Motion by Councilmember King, seconded by Councilmember Juarez Vote: 6-0. Motion carried. City Council Minutes July 23, 2019 Page 2 of 4 330 7 Consider and take necessary action, regarding services agreement between the City of Plainview and RingCentral phone system upgrade through TIPS contract and implementation with BlueLayer and authorize City Manager to sign necessary documents Presenter: Isauro Gutierrez, Director of Information Technology This is Agreement with RingCentral and BlueLayer for upgrade of phone system. Motion: Move to approve agreement between the City of Plainview and RingCentral phone system upgrade through TIPS contract and implementation with BlueLayer and authorize City Manager to sign necessary documents Motion by Councilmember Weiss, seconded by Councilmember Juarez Vote: 6-0. Motion carried. 8. Consider Interlocal Agreement between the City of Plainview and Plainview Independent School District — Police Department Presenter: Ken Coughlin, Chief of Police The school district established their own police department. This outlines reasonable communication and coordination efforts between the school district and the city. Motion: Move to approve Interlocal Agreement between the City of Plainview and Plainview Independent School District — Police Department Motion by Councilmember King, seconded by Councilmember Juarez Vote: 6-0. Motion carried. 9. Convene into executive session pursuant to Texas Gov't Code § 551.074 to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, or to hear a complaint or charge against an officer or employee. Appointments to the following boards and commissions: Canadian River Municipal Water Authority and 10. Convene into executive session pursuant to Texas Gov't Code $ 551.072 to deliberate the purchase, exchange, lease or value of real property, the public discussion of which would not be in the best interest of the City's bargaining position with third parties. Consider and take necessary action regarding Interlocal Governmental Cooperation Contract for Administrative Services and Authorize Mayor to Sign Mayor Dunlap recessed the meeting at 7:34 p.m. Mayor Dunlap called the meeting back in open session at 7:52 p.m. City Council Minutes July 23, 2019 Page 3 of 4 11. A Resolution by the City of Plainview Texas City Council Electing a Person 331 Qualified to Fill the Vacancy on the Canadian River Municipal Water Authority and Certified by the Mayor. (Resolution R19-447) Presenter: Jeffrey Snyder, City Manager This Resolution reappoints Tyke Dipprey and appoints Donnie Brumley to the Canadian River Municipal Water Authority Board Motion: Move to approve Resolution R19-447 Motion by Councilmember King, seconded by Councilmember Juarez Vote: 6-0.
