FIRST II EM ON THE AGENDA: Approval:of August 2005 minutes. James Crossland made
motion to ipprove minutes as presented; Fred Willis seconded. Motion carried 5-0.
SECOND ITEM O1'4 THE AGENDA: BA Case # 1504 The request of Bertoldo Garda for a
variance c f four (4) feet of' the required five (5) foot side setback as stated in Section 34 of the
City of P ainview Zoning Ordinance to construct an oversized 12'X50' Carport in a Single
Family (R-2) Zoning District, and being Block 2, W61' - Lot 2, Warren Addition, Plainview,
Hale Cou~tty, Texas the same being 210 SE 7t~ Street. Bertoldo Garcia is present to answer
questions >fthe Board in regards to this case. His son, Javier Garcia is present to interpret for
Mr. Garc! a who speaks very little English. John Castro showed the Board pictures of the
property ,,nd a site plan of the proposed carport along with a map showing property owners

~sponses received from the neighborhood, all in favor of the request: John Castro said
amends the carport have a gutter installed to keep rain water from draining onto the
tg property. He told the Board that a similac variance had been approved in this
~od in the recent past. He explained to the Board that most of the carport in the back
is wanted mostly for shade and that the area alongside the house would be used for
verage. James Crossland asked how the ends of the carport would be supported and

made a motion to approve the request based on this being the only logical place for a

John Bickel called the meeting to order at 7:01
FIRST ITEM O1~t ~ AGENDA: Approval of August 2005 minutes. James Crossland made
motion to approve minutes as presented. Fred Willis seconded. Motion carded 5-0.

variance of four (4) feet of the required five (5) foot side setback as stated in Section 34 of the

property and a site plan of the proposed carport along with a map showing property owners

three (3) responses received from the neighborhood, all in favor of the request. John Castro said
staff recommends the carport have a gutter installed to keep rain water from draining onto the
neighboring prop~. He told the Board that a similar variance had been approved in this
neighborhood in the recent past. He explained to the Board that most of the carport in the back
yard area is wanted mostly for shade and that the area alongside the house would be used for
vehicle coverage. James Crossland asked how the ends of the carport would be supported and
Mr. Garcig said that the 8" perlings being used would support the weight at the comers. Max
Browning made a motion to approve the request based on this being the only lo,cai place for a
carport and the positive response from the neighborhood and added that a gutter must be placed
along the neighbor's side of the ca~port to allow drainage onto Mr. Garcia's property instead of
the neighboring propc~y. Fred Willis seconded. Motion carried 5-0.

questions from the Board. John Castro showed 'the Board pictures of the property and a site plan
of the proposed carport along with a map showing property owners within two htmdred (200)
feet of this property who were notified of the 'variance request. There were two (2) responses
received fxom the neighborhood, both in favor of the request. John Castro said staff recommends
the carport have a gutter installed to keep rain water from draining onto the neighboring
property. He said this case is unique because the carport existed as a legal non-conforming use
before it was tom down for replacement. John Bickel asked what materials would be used for
construchon and Barry Vitato said it would be constructed of pressure treated lumber, concrete
and iron~ James Crossland asked if the existing garage behind the proposed carport would be
used as a garage and Barry Vitato said it is used as a storage facility. Fred Willis made a motion
to approve the variance request based on this being the only logical place for a carport and added
tha~ a gutter be placed along the neighbor's side to allow drainage onto the owner's property
instead of the neighbor's property. James Crossland seconded. Motion carried 5-0.
FOURTH ITEM ON TBE AGENI)A: BA Case # 1506 The request of Pedro Vargas for a
variance of twenty-five (25) feet of the required twenty-five (25) foot front setback as stated in
Section 34 of the City of Plainview Zoning Ordinance to construct a 16'X25' carport in a Single
Family (R-2) Zoning District, and being Block 1, S60'-6, Titus-Pillow Addition, Plainview, Hale
County, Texas the same being 2405 Galveston Street. Pedro Vargas is present to answer
questions from the Board. John Castro showed the Board pictures of the property and a site plan
of the proposed carport along with a map showing property owners within two hundred (200)
feet of this property who w~ere notified of this request. There were tl~ee (3) responses received
from the neighborhood, all in favor of the request. John Bickel asked if the carport would extend
to the sidewalk and Pedro Vargas said it would be a few feet off the sidewalk. Kenny Brown
asked if the carport would be placed under the eave of the house and Pedro Vargas said it would.
John Bickel asked what materials would be used in the construction of the carport; Pedro Vargas
replied it would be made of8" c-perlings and 4" poles. Kenny Brown made .motion to approve
the variance based on this is the only logical place for the carport and positive response from the
neighborhood. Max Browning seconded. Motion carried 5-0.
