HomeMy WebLinkAboutCouncil Minutes 10-22-2019The City Council of the City of Plainview met on October 22, 2019 at 7:00 p.m., in the 359 Council Chambers of the Plainview City Hall at 901 Broadway. Mayor Wendell Dunlap presided. Councilmembers present were: Nelda VanHoose- District 1, Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, and Susan Blackerby-District 5. Councilmember Evan Weiss -District 6 was absent. Staff members present were: Jeffrey Snyder -City Manager, Matthew Wade -City Attorney, Jeff Johnston -Assistant City Manager, Ken Coughlin -Chief of Police, Tim Gibson -Fire Chief, Isauro Gutierrez -Director of Information Technology, Paul Kite -Assistant Director of Utilities, Tim Crosswh ite-Di rector of Public Works, Melinda Brown -Main Street Manager and Belinda Hinojosa-City Secretary. Review Agenda items for regular meeting The Council and staff reviewed the agenda items 1. Invocation and Pledge of Allegiance Councilmember Teressa King 2. Recognitions. 3. Consent Calendar a) Excused Absences — Councilmember Evan Weiss b) Minutes of September 19, 2019 and September 24, 2019 c) Quarterly Investment Report for the period from July 1, 2019 through September 30, 2019 d) A Resolution of the City Council of the City Of Plainview, Texas, Approving the Request from the Y.M.C.A. to Host the 2019 Turkey Trot; Authorizing the Filing of the Agreement for the Temporary Closure of State Right -Of -Way With the Texas Department of Transportation for this Event; Declaring that the Event Serves a Public Purpose; and Agreeing to Comply with Regulations. (Resolution R19-455) Motion: Approve Consent Calendar Motion by Councilmember Williams, seconded by Councilmember Juarez Vote: 6 — 0. Motion carried. 4. A Resolution of the Citv of Plainview. Texas ADDrovina Cooperation With Cities Served by Atmos West Texas to Review Atmos Energy Corp., West Texas Division's ("Atmos West Texas") Requested Rate Change; Hiring Legal and Consulting Services to Negotiate with the Company and Direct any Necessary Litigation and Appeals; Requiring Reimbursement of Cities' Rate Case Expenses; Authorizing Intervention in any Ratemaking Proceeding at the Railroad .Commission that Relates to . the Company's City Council Minutes October 22, 2019 Page 1 of 3 360 Filing; Requiring Notice of this Resolution to the Company and Cities' Legal Counsel (Resolution R19-454) Presenter: Jeffrey Snyder, City Manager The Executive Committee of the Steering Committee recommends intervention at the Railroad Commission because: 1) the Company has requested creation of a regulatory asset that may adversely affect future rate filings; 2) it appears that the Commission Staff is mandating that Atmos treat a portion of the pipe assets involved with the filing as a separate transmission company; and 3) Atmos intends to seek annual rate increases through the GRIP process for the transmission assets which will increase the cost of gas at city gates. Staff recommends authorizing legal counsel to monitor and intervene in this case. Motion: Move to approve Resolution R19-454 Motion by Councilmember Juarez, seconded by Councilmember VanHoose Vote: 6-0..Motion carried. 5. A Resolution of the City Council of the City of Plainview, Texas establishing an Animal Services Task Force to evaluate the policies and procedures of Animal Control and the Animal Shelter (Resolution R19-456) Presenter: Jeffrey Snyder, City Manager This Resolution would establish an Animal Services Task Force to assist in a review of the policies and procedures in Animal Control as well as the Animal Shelter operations including adoption practices, euthanasia practices, and the use of volunteers and non- profit animal rescue/welfare organizations in support of the City's animal control responsibilities. In addition, this group will assist staff with the renovations and expansions plans for the Animal Shelter. The Task Force will provide recommendations to the City Council for review. Motion carried. 6. Consider and take necessary action regarding Interlocal Agreement between the City of Plainview and Hale County for the Distribution of TXDOT Grant Funds Received for the Hangar Acquisition Project and Authorize Mayor to Sign all necessary documents City Council Minutes October 22, 2019 Page 2 of 3 Presenter: Jeffrey Snyder, City Manager 361 1 The City and County are moving closer to finalizing the purchase with Rocket Aviation. For this project, the City will provide $775K towards the purchase with the agreement that City would be reimbursed the $600K in NPE funds when it is received by the County from TXDOT Aviation. Motion: Move to approve Interlocal Agreement between the City of Plainview and Hale County for the Distribution of TXDOT Grant Funds Received for the Hangar Acquisition Project and Authorize Mayor to Sign all necessary documents Motion by Councilmember King, seconded by Mayor Pro Tern Blackerby Vote: 6-0. Closed Session — Sec. 551.071 — Consult with attorney on a matter in which the attorney's duty to the government body under the Texas Disciplinary Rules of Professional Conduct conflicts with the open meeting statutes and about pending or contemplated litigation or settlement of same relating to Police Department Recess Meeting at 7:31 p.m. Mayor Dunlap called the meeting back in open session at 8:15 p.m. and announced that no action would be taken. 8.
