A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS ESTABLISHING AN ANIMAL SERVICES TASK FORCE TO EVALUATE THE POLICIES AND PROCEDURES OF ANIMAL. CONTROL AND THE ANIMAL SHELTER WHEREAS,. the City of Plainview, a home rule municipality, in order to protect the public health, safety and welfare and enforce applicable state and local laws relating to animals within the municipal limits, regulates animal control by ordinance and operates an animal control department along with an animal shelter;, and WHEREAS, the City Council of the City of Plainview has: committed significant financial and capital resources towards animal control including committing to upgrade and renovate the City's Animal Shelter; and WHEREAS, the services provided by the City's Animal Control Department,..not only include enforcement of applicable, animal control regulations but also includes,rabies prevention, animal bite investigation, education on responsible animal ownership, animal adoption, and capture and care for stray and unwanted animals; and WHEREAS,..the enforcement of animal control regulations and the services provided by the City's Animal Control. Department significantly impacts the citizens of the City of Plainview; and WHEREAS, the City of Plainview .and the City Council greatly values the input, suggestions, experience; assistance and advice of citizens and believes that it would be in. the best interest of the City to seek the input, suggestions, experience, assistance of interested citizens regarding the City's policies and operation of the City's Animal Control Department and the City's Animal Shelter; NOW THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLAINVIEW THAT: Task Force Established The.Plainview Animal Control Task Force. (the "Task Force").is hereby established. 2. Task Force Responsibilities (a) 'The Task Force shall be advisory only and shall advise the City Manager on policies and procedures presented to the Task: Force regarding: i. The City's Animal Control Department; ii. The City's Animal. Shelter; Plainview Animal Control Advisory Task Force — Council Appointed Page 1 of 4 2571 iii. The use of volunteers and non-profit animal,rescue/welfare organizations in support of the City's- animal control responsibilities; and iv. Any other function or .duty as requested :or directed by the City Council or deemed advisable. by the City Manager relating to City? s Animal Control Department. (b) Within twelve (12) months of being appointed or. after completing all tasks assigned to the Task Force by the City Council or the City Manager, the Task Force and the City Manager shall jointly -present a final reportto the City Council regarding its recommendations on policies and procedures :concerning the: matters listed in 2(a) above. Nothing :in this section shall be construed as preventing the Task Force from :making interim :reports: to the City Council or City Manager prior to the.issuance of its .final. report. 3. Appointment and --Qualifications of the. Task Force (a) The Task Force shall. consist of ten members appointed by the City Council, The Task Force members serve at the will and pleasure of the City Council and may be removed with or without cause :by majority vote of the City Council.. The Mayor shall serve -as. an ex-oyhcio non- voting member of the Task Force. (b) 'The: initial terms. of the Task Force :members shall expire when the Task Force presents its final report to the Council or within one year of being appointed, whichever -occurs first. (c) Members -of the Task Force shall; meet the following criteria: i. No less than one nor more than two members shall be licensed veterinarians; ii. No less than two nor more than four :members shall be affiliated: with a non-profit animal rescue or animal humane :organization; ill. No less than tw& members shall be: residents and eligible voters of the City of Plainview and are not affiliated with any animal rescue or animal humane organization; iv. No more than three members may also be -members of the City Council; v, Except for a member filling the position outlined in 3(c)(vi) below;. all other members of 'the Task Force must continue to reside and be eligible to vote within the City of Plainview during their membership on the Task.Forco; and vi.. One member -may serve on the task force that lives outside the municipal -boundaries of the City of Plainview so long as they live within the extra -territorial jurisdiction of the -City of Plainview. The City Secretary shall be responsible fot ensuring that the members of the Task Force .meet the qualifications and criteria established herein. (d)- The Task Force members: shall serve without compensation. (e) The Task Force members shall fully disclose any potential or actual conflict of 'interest to the City Council: Substantial interest shall mean substantial interest as defined by the laws of the - State of Texas: regulating conflicts of interest of officers of municipalities. Composition of the Task Force The Task Force sha11 be comprised of the following members: Mindy Morris Laura Steen Phyllis Wall Mark Hardin Kim Swan Kristy Kruse Blaine Long Norma Juarez Nelda VanHoose Evan Weiss 5. Meetings,: Quorum The Task..Force may meet as often as necessary when requested by :the City Council; Mayor or City Manager. Six members of the Task Force shall constitute a. quorum for meeting and voting purposes. 6. Officers, Rules: and By-laws The Task Force may, at its discretion, elect, a chairman, vice chairman; secretary and treasurer at its first meeting. If necessary and deemed advisable by the Task Force, the Task Force may adopt rules and/or by-laws -in order to more efficiently conduct its meetings and carry out its duties and responsibilities so long as such rules:ot by-laws are notinconsistent with or conflict with applicable state law,. the City's ordinances or this resolution. 7. Open Meetings The'Task Force is an advisory only committee and is not required to comply with the Texas Open Meetings Act. The Task Force may, but. is not required, to provide notice to the public regarding its:.meeting times and locations or open. its meeting to the public. In the event the Task Force chooses to follow the provisions of the Texas Open Meetings Act as a guide for providing notice to. the public .of its meetings, failure to strictly comply with the provisions. of the Texas Open eetings Act -shall not prevent the Task Force from Bolding its meeting.
