PLAINVIEW CITY COUNCIL
August 11, 1998
The Plainview City Council held a meeting at 7:30 p.m., Tuesday, August 11, 1998, in the Ash
Learning Center, 908 Ash Street. The Council met in Pre-Session at 7:00 p.m. Mayor Lloyd C.
Woods presided. Councilmembers present were: Sam Parker-Precinct 1, Mary Jane Shanes-Precinct
2, Rey Rosas-Precinct .3, Mike Hutcherson-Precinct 4, Ross Owen-Precinct 5, Bobby McGehee-
Precinct 6, and Irene Favila-Precinct 7. The Notice and Agenda for this meeting were posed at 5:00
p.m. on August 3, 1998 in City Hall.
Staff members present were: Jim Jeffers-City Manager, Dale Simpson-Civil Service Director, John
Castro-Director of Community Services, William Mull-Police Chief~ Wally Hatch-City Attorney, John
Berry- Assistant Director of Public Works, Gary Glass-Fire Chief, Norman Huggins-Director of
Finance, Rusty Reese-Parks Superintendent., Det. Michael Carroll-Police Department, and Karen
McBeth-city secretary.
Guests present: Terry McEachern-District Attorney, and Barbara Parker-609 West 10.th St.
News media present: Richard Orr - Plainview Daily Herald.
OPEN MEETING
1. Invocation - The HonOrable Irene Favila
2. Recognitions - There were none.
3. Consent Calendar - Councilmember Favila moved to approve the Consent Calendar as
presented. Councilmember Owen seconded the motion. The Mayor and Councilmembers Parker,
Shanes, Rosas, Owen, McGehee and Favila voted for the motion. None voted against.
Councilmember Hutcherson had not yet arrived at the meeting and was not present when this vote
was taken.

e)
Quincy School Speed Zone. Ordinance No. 98-3182. An Ordinance of the City of
Plainview, Texas, designating a portion of Quincy Street between West 10th Street
and West 12th Street as a School Zone; Providing for a penalty; Cumulativeness
clause; Conflicts clause; Severability clause; And effective date. Second Reading. The
ordinance was adopted.
f) Plumbing Code. Ordinance No. 98-3181. An Ordinance amending the City of

Plainview Code of Ordinances, Chapter 20, amending Article XIII of the City of
Plainview Plumbing Code; Cumulativeness clause; Conflicts clause; Severability
clause; And effective date. Second Reading. The ordinance was adopted.
g)
Consider award of bids on traffic signal equipment and hardware to be installed at
the intersection of24~ and Joliet. Bids were received from: Naztec Inc. in the amount
of $20,935 (this bid was incomplete); OMJC Signal Inc. submitted a No Bid;' Traffic
Parts Inc. bid $47,000; Consolidated Traffic bid $72,498; Cardinal Hwy. Products
submitted a No Bid. The bid was awarded to Traffic Parts Inc. for $47,000.
h) Consider amendments to agenda action policy. The amendments were adopted.

Consider amendments to the Council Relations policy. The amendments were
adopted.
REGULAR AGENDA
4. Precinct One open forum -- Mayor Woods turned the meeting over to Councilmember
Sam Parker. Councilmember Parker thanked everyone for coming to this Precinct 1 meeting and
asked if anyone had any public comments or wished to ask questions of the Council. No one asked
to speak. Councilmember Parker recognized Barbara Parker of 609 W. 10~ and asked if she had any
comments she would like to make. Mrs. Parker said she was happy to attend the meeting, but had
no special comments. Councilmember Parker turned the meeting back to Mayor Woods.
ORDINANCE NO. 98-3184 -- An Ordinance of the City of Plainview, Texas, amending
Ordinance No. 97-3135, the 1997' 1998 Budget of the City of Plainview as such pertains to
the Sexual Assault Nurse Examiner (SANE) Program. First Reading
District Attomey Terry McEachern explained to the Council the $5,000 appropriated by this Budget
Amendment would be added to $5,500 from Hale County and other private corporations to total
$20,000 which would be used to train 12 registered nurses to become sexual assault nurse examiners.
Eight of these nurses are regular employees of the Methodist Hospital system, and the remaining 4
are outside the Methodist system. Mr. McEachern went on to say that anyone who is a victim of
sexual assault suffers severe trauma, which in some instances the present system adds insult to injury.
When examinations and evidence gathering is not done by medical personnel specifically trained to
handle the emotional trauma, as well as the physical trauma, and understand the importance of
specific evidence gathering and the proper handling of that evidence, it can result in a poor case.
This program will save time, effort, money and give the district attorney quality evidence with which
to prosecute offenders. The nurses trained for this program will be on call 24 hours a day, 365 days
a year. This program proposes to go into effect August 31, 1998. Mr. McEachern explained at the
present time many sexual assault victims have to be taken to Lubbock for tests and evidence
gathering. He said this does not help the victim or the prosecutor who hopes to build a quality case
against the offender.

Councilmember McGehee moved to adopt Ordinance No. 98-3184 and Councilmember Owen
seconded the motion. Councilmembers Parker, Shanes, Rosas, Hutcherson, Owen, McGehee, Favila
and Mayor Woods voted yes on the motion. No one voted no.
A Public Hearing for owners of the property hereinafter described and referred to, and to all
interested persons as provided by law, concerning the annexation of Westridge Addition
Lot 154, Unit 6.
Mayor Woods asked if there was anyone present who wished to speak for or against the proposed
annexation. No one responded, either for or against.
7. Parks - Annual Report. Mayor Woods recognized Rusty Reese, Interim Parks
Superintendent. Mr. Reese reported to the Mayor and Council that Mr. Roy Reay gave the Parks
Department five fiberglass boat hulls for the children of Plainview to use their imaginations in, at no
cost to the City. He reported there were no serious injuries reported on the playgrounds this year nor
have there been any on-the-job injuries to Parks Department employees. Kidsville was re-sealed for
the 7'h year and is in very good condition after 7 years of use to this very popular spot in Regional
Park. There have been 10 Bald Cypress trees planted at the Tmssell Duck Pond this year. The Parks
Department had a successful year in dealing with the softball and baseball organizations, as well as
special events such as Juneteenth, Fiesta Campesino, and Fourth of July. The Parks Department has
received several compliments on the appearance of the parks, stating they are cleaner and the grass
is greener and well kept. Mr. Reese thanked the department employees for doing such a good job.
He thanked the Parks Advisory Commission for their dedication to the parks and for devoting their
time and effort to improving the City's parks. He also thanked the Wheeler and Formby Units of the
Texas Criminal Justice System, both the personnel and inmates for their contributions to the City
parks. In closing he thanked the Mayor and Councilmembers for their support and their continuing
interest in all the parks.
Mayor Woods thanked Mr. Reese for his report and for a job well done.
Open Forum. Hear citizens requests and comments per Open Forum Policy. No one spoke
during this portion of the meeting.
Adjournment. Councilmember Hutcherson made a motion to adjourn the meeting.
Councilmember Shanes seconded the motion. The Mayor and all seven Councilmembers
present voted in favor of the motion. Mayor Woods declared the meeting adjourned at 7:45
p.m.
