HomeMy WebLinkAbout97 1009 min MINUTES Special City Council Meeting October 9, 1997 The Plainview City Council met in a Special City Council Meeting on October 9, 1997, at 12:00 Noon at the Plainview Convention Center. Notice of this meeting was posted at City Hall on October 6, 1997 at 10:00 a.m. Mayor Lloyd C. Woods presided. Councilmembers present were: Larry Dickerson-Precinct 1, Mary Virginia Kirchhoff-Precinct 2, Mike Hutcherson-Precinct 4, Ross Owen-Precinct 5, and Bobby McGehee-Precinct 6. Councilmembers Irene Favila-Precinct 7 and Rey Rosas-Precinct 3 were absent. Staff members present were: Jim Jeffers-City Manager, Ches CartheI-Director of Public Works, Cindy Gasaway-Main Street Coordinator, Wally Hatch-City Attorney, Norman Huggins-Director of Finance, Gary Glass-Fire Chief, Pat Hernandez-Municipal Judge, William Mull-Police Chief, and 'Larry Gould-Chief Building Inspector. News media present: Richard Orr-Plainview Daily Herald. Guests present were: John Warrick, Gilbert Pena, Larry Burnside with Texas Municipal League and Gary Lloyd of the Mouser Insurance Agency. OPEN MEETING Ordinance No. 97-3137. (Zone Case 643 C-2 to CDB). An Ordinance amending the zoning map of the City of Plainview, Hale County, Texas, to rezone Lot 1, N12"-2, Block 55, Original Town of Plainview, Texas from C-2 Retail District to CB Central Business District; Cumulativeness clause; Conflicts clause; Severability clause; And effective date. (715 Columbia). Second reading. Councilmember Mike Hutcherson moved to approve Ordinance No. 97-3137 and his motion was seconded by Councilmember Mary Kirchhoff. Community Services Director John Castro told the Council the Planning and Zoning Commission recommended approval of the zone change and the City has not received any objections from the public. The change will allow the buildings, which were used as doctor's offices and is currently vacant, to be remodeled and converted to multi-family living quarters. Mayor Woods asked for public comment. Gilbert Pena, 408 W. 8th St., addressed the Council stating he was opposed to the change because he was unsure of who might live there. Mayor Woods asked if he appeared before the Planning and Zoning Commission when the proposed change was presented to them? He said no, he did not. Councilmember McGehee asked if there were other multi-family housing in the area? Mr. Castro said not adjacent, but yes, there are others in the area. Councilmember Kirchhoff said when property is allowed to remain vacant it deteriorates quickly. If the building is remodeled according to city codes, it will improve the building as well as the neighborhood, and she C:\MyFiles\MINUTES\97 1009 spec.wpd appreciates Mr. Pena's concern for the neighborhood. Mayor Woods asked if he was concerned about increased traffic, and Mr. Pena said no, only that out of town people might move into it. Larry Gould, Code Administration officer, told the Mayor and Council there was adequate parking even for multi-family use. Mayor Woods and Councilmembers Kirchhoff, McGehee, Owen, and Hutcherson voted in favor of the motion to approve the ordinance. Councilmember Dickerson abstained from voting. There were no votes against. Ordinance No. 97-3138. (Zone Case 644 Specific Use Permit). An Ordinance authorizing the issuance of a Specific Use Permit to construct a single family residence in a light industrial district, generally known as 1104 E. 5~h Street; Cumulativeness clause; Conflicts clause; Severability clause; And effective date. Second Reading. Councilmember McGehee made the motion to approve Ordinance No. 97-3138 and his motion was seconded by Councilmember Hutcherson. Community Services Director John Castro told the Council the Planning and Zoning Commission approved the zone case with no negative comments. Mr. Castro said they received several positive comments. There was no public comment. Mayor Woods and Councilmembers Dickerson, Kirchhoff, McGehee, Owen and Hutcherson voted in favor of the motion to approve. There were no votes against. Ordinance No. 97-3143. An Ordinance of the City of Plainview, Hale County, Texas waiving the permit fees established in Chapter 6, Article 1 of the Code of Ordinances, No. 94-2995; Regarding building permit fees for the 1997 Farmers Home Housing Preservation Program administered by Motivation, Education and Training, Inc.; Cumulativeness clause; Conflicts clause; And effective date. First Reading. The motion to approve Ordinance No. 97-3143 was made by Councilmember Dickerson and seconded by Councilmember McGehee. Councilmember Favila has declared a Conflict of Interest regarding this agenda item and even though she is absent, if she were here she would not participate in the discussion or the voting. City Manager said there is a precedent for waiving the building permit fees, the Council waived them twice before a few years ago for M.E.T., Inc. The purpose of waiving the fees is to allow all of the rehabilitation funds to be used on the houses and not on administrative fees. Mayor Woods asked how many houses are planned for rehabilitating. The City Manager said 14 houses in all, but 4 are in Plainview and will be affected by this ordinance. Councilmember McGehee asked if the houses will be required to meet city code and will they have to get the permits, even though they will not be paying for them? Chief Building Inspector Larry Gould told him yes, they get the permits, the houses are inspected and they must meel city code like all other buildings. The Mayor and Councilmembers Dickerson, Kirchhoff, Hutcherson, Owen and McGehee voted in favor of the motion to approve, with no votes against the motion.
