HomeMy WebLinkAbout97 0610 min MINUTES CITY COUNCIL MEETING City of Plainview June 10, 1997 The Plainview Cky Council held a meeting at 7:30 P.M., Tuesday, June 10, 1997, in the Council Chambers of the Plainview City Hall at 901 Broadway, Plainview, Texas. The Council met in Pre-Session at 7:00 P.M. Action may be taken on each agenda item. Mayor Lloyd Woods presided at the meeting. Present were Council members Larry Dickerson - Precinct 1, Mary Virginia Kirchhoff- Precinct 2, Rey Rosas - Precinct 3, Mike Hutcherson - Precinct 4, Ross Owen - Precinct 5, Bobby K McGehee - Precinct 6, Irene Favila - Precinct 7. The notice and agenda for this meeting was posted at 5:00 P.M. on June 3, 1997. Staffmembers present were: Gary Glass - Chief of Fire Department, John Castro - Director of Community Services, Cindy Gasaway - Main Street Coordinator, Ches Carthel - Director of Public Works, Norman Huggins - Director of Finance, Will Mull - Chief of Police, Wally Hatch - City Attorney, Tina Davis - Deputy City Secretary, Karen McBeth - City Secretary. News media present were: Richard Orr - Plainview Daily Herald and Wayland Baptist University television crew. OPEN MEETING: Invocation - The Honorable Mayor Lloyd Woods Pledge of Allegiance - The Boy Scouts Recognitions. By proclamation, Mayor Woods declared that the citizens of the City of Plainview, in observance of National Flag Day, should pause at 6:00 P.M., on June 14, 1997, to recite the Pledge of Allegiance. 3. Consent Calendar - Councilmember Favila moved to approve the Consent Calendar as presented. Councilmember McGehee seconded the motion. The motion carried unanimously among the Councilmembers from Precincts 1, 2, 3, 4, 5, 6, 7 and the Mayor. a) b) c) d) Minutes were approved. Departmental Reports were approved. Expenditures were approved. Excused Absences. None were requested. e) Budget Amendment Fire/EMS Business and Education. Ordinance 97-3124. An Ordinance amending Ordinance 96-3090 to appropriate funds in the present budget to pay for education to the end of the fiscal year. Was approved on Second Reading. 1 of 3 t) Codification Amendment - Ordinance No. 97-3125 - An ordinance adopting and enacting amendments to the Code of the City of Plainview; compiled and codified by authority of the City Council; containing amendments to the permanent, general ordinances of the City; repealing alt ordinances and parts 0f ordinances of a permanent general nature not included in the amended code in full or by reference; providing a penalty for wrongfully changing or tampering with the amended code; regulating the bringing of the code up to date; providing for certification of copies of the amended code; for the sale of copies thereof} and prescribing the effective date. Was approved for First Reading. g) Designation of Drug Free Zone at Plainview High School. Was approved. REGULAR AGENDA ITEMS 4. Consider accepting ownership of the Austin Heights Community Center property fi.om the Plainview Independent School District; declaring such surplus property; and transferring ownership to the Austin Heights Community Center Board of Directors. Councilmember McGehee motioned that this item be tabled. Councilmember Rosas seconded. The motion carried unanimously among Precincts 1, 2, 3, 4, 5, 6, 7 and the Mayor. 5. Zone Case 640. East Fifth Street. Ordinance 97-3123. An ordinance amending the zoning map of the City of Plainview, Texas, rezoning a 0.817 acre tract of land out of the Southeast part of the L.S. Kinder Homestead Survey, Hale County, Texas, described by metes and bounds, from A - Agricultural to M1 - Light M_anufacmring; cumulativeness clause; conflict clause; severability clause; and effective dates. Second Reading. Councilmember Owen motioned that the Council approve Ordinance 97-3123. Councilmember Rosas seconded. John Castro, Director of Community Development, presented Zone Case 640 to the Council. The motion carried unanimously among Precincts 1, 2, 3, 4, 5, 6, 7 and the Mayor. 6. Consider designation of the Panhandle Cotton Compress facilities on South Columbia as and Industrial District and authorize the Mayor to execute an annexation agreement. Wally Hatch, City Attorney, addressed the Council and informed them that the Panhandle Cotton Compress had withdrawn, in writing, thek request for water service, thus item 6 and item 7 of this agenda were no longer presented for consideration. 7. Consider the request of Panhandle Cotton Compress for water service on South Columbia. Hear citizens' requests and comments per Open Forum Policy. Bob Butler, 105 Ebeling, Plainview, Texas, addressed the Council by reading a prepared 2 of 3 statement regarding alleged crimes committed against citizens and property in the 500, 600 and 700 blocks of West 20th Street and the surrounding area. Donna Moreno, 611 W 20th Street, Plainview, Texas, James Young, 707 West 21 st Street, Plainview, Texas, and Ray Garcia, 614 West 20th Street, Plainview, Texas, further stated that as a citizens of Plainview and residents of the West 20th Street neighborhood, they are also concerned with alleged illegal activity in their neighborhood. 9. Closed Meeting. Deliberate the appointment, employment, evaluation, reassignment or duties, removal, discipline or dismissal of a public officer or employee, board, commission, or committee member, or to hear complaints or charges. (Board of Adjustment, Building/Fire Code Board of Appeals, Senior Citizens Commission). This meeting is authorized by TEX GOVT. CODE ANN. §551.074, 551.075 (Vernon 1996). No closed meeting was held. 10. Consider appointments to: Board of Adjustment, Building/Fire Code Board of Appeals, Senior Citizens Commission. No qualified applications were submitted. 11.
