HomeMy WebLinkAbout07.07.2020 ZBA MINUTESZONING BOARD OF ADJUSTMENT MINUTES July 27, 2020 The Zoning Board of Adjustment held a public hearing on Monday, July 27 2020 at 6:00 p.m. The meeting took place in the Council Chambers of City Hall, 901 Broadway, Plainview, Texas, with the following members present: BOARD MEMBERS PRESENT: Mark Hardin, Mark Bacher, Lawrence Sloma, Chris Lefevre. STAFF MEMBERS PRESENT: Jeff Johnston, Asst City Manager, Jaque Enriques, Code Enforcement, Judy Rasher, Community Service Secretary. Mark Hardin opened the meeting at 6:07 pm, established a quorum and conducted the consideration of the following items in the order presented. Jeff Johnson read the staff reports, and gave the recommendations for each item. 1. Oath of Office: Mark Hardin, Mark Bacher and Lawrence Sloma 2. Approval of July 22, 2019 meeting minutes: Chris LeFevre made a motion to approve minutes of July 22, 2019 as presented. Mark Bacher seconded the motion. Motion carried unanimously. 3. ZBA-20-01: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 7, Lot 7 of the Hillcrest Addition, Plainview, Texas, Hale County, also known as 207 E Roselawn Street The applicant is requesting to construct a 15 x 2 flat roof carport in the front -yard setback. The propose carport would encroach approximately 9ft. into the required minimum front - yard setback of 15ft. Staff observed at least 4 carports on the same street. This particular neighborhood is one where garages are not present in the area. 21 letters were sent to the neighbors. Staff have not received any letters in favor or in opposition of the request. Mark Bacher made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Chris LeFevre seconded and the motion was carried unanimously. 4. ZBA-20-03: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 3, N40'-15 S20'-16 of the Howell Addition, Plainview, Texas, Hale County, also known as 1306 Xenia Street The applicant is requesting to construct a 20 x 20 pitched roof carport in the front -yard setback. The propose carport would encroach approximately 12ft. into the required minimum front -yard setback of 25ft. Zoning Board of Adjustment July 27, 2020 Staff observed 5 carports within a 1 block radius. 22 notices have been sent to property owners within 200 feet regarding this request. Staff received 4 letters in favor. Chris LeFevre made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Mark Bacher seconded and the motion was carried unanimously. 5. ZBA-20-04• Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 1 S10' OF E70' - 13 W/2 - 13&14 of the Truitts Addition, Plainview, Texas, Hale County, also known as 2409 W 11th Street The applicant is requesting to construct a 20 x 20 pitched roof carport in the front -yard setback. The propose carport would encroach approximately 20ft. into the required minimum front -yard setback of 25ft. Staff observed at least 4 carports on the same street. 26 letters were sent to the neighbors. Staff received 2 letters. Mark Bacher made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Chris LeFevre seconded and the motion was carried unanimously. 6. ZBA-20-05: A request for a Special Exception in order to be allowed to construct an extension of an existing porch six feet into the minimum required front -yard setback of twenty -feet. The location described as the Block 2 Lot 3 Unit 1 of the Thunderbird Addition, Plainview, Texas, Hale County, also known as 2505 Lexington Street. 7. The applicant is requesting a special exception to construct an extension of an existing porch six feet into the minimum required front yard setback of 20 feet. Applicant would like to extend the porch the length of the house which is 6 ft x 38 ft, to shield the home from the elements. Mark Hardin made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. The applicant requested a special exception to construct a 20 x 20 carport in the front - yard setback. The propose carport would encroach approximately 20ft. into the required minimum front -yard setback of 25ft. Chris LeFevre made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. ZBA-20-07: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 76 Lot 12 of the College Hill Addition, Plainview, Texas, Hale County, also known as 608 Yonkers Street. The applicant requested a special exception to construct a 12 x 20 carport in the front - yard setback. The propose carport would encroach approximately 20ft. into the required minimum front -yard setback of 25ft. Staff observed at least one carport on the same street. 14 letters were sent to the neighbors. Received 2 letters in favor. Mark Hardin made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Mark Bacher seconded and the motion was carried unanimously. 9. ZBA-20-08: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 15 Lot 7 Unite 3 of the Thunderbird Addition, Plainview, Texas, Hale County, also known as 1112 W 31 81 Street. The applicant requested a special exception to construct a 20 x 20 carport in the front - yard setback. The propose carport would encroach approximately 20% into the required minimum front -yard setback of 25ft. Staff observed at least 4 carports on the same street. 14 letters were sent to the neighbors. Received 2 letters in favor. Chris LeFevre made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Mark Bacher seconded and the motion was carried unanimously. 10. ZBA-20-09: Consider the request of a special exception of the minimum front set 1 Lot 8 of the R B Jones Addition, Plainview, Texas, Hale County, also known as 1504 W 16th Street. Zoning Board of Adjustment July 27, 2020 The applicant requested a special exception to construct a 12 x 20 carport in the front - yard setback. The propose carport would encroach approximately 1 Oft. into the required minimum front -yard setback of 25ft. Staff observed at least one carport on the same street. 18 letters were sent to the neighbors. Staff has not received any letters in favor or in opposition of the request. Mark Bacher made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Chris LeFevre seconded and the motion was carried unanimously. 11. ZBA-20-1 0: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 18 Lot 12 of the West Lynn Addition, Plainview, Texas, Hale County, also known as 1803 Kokomo Street. The applicant has an existing carport on the side of his home. Applicant is requesting to extend the carport and addition 20 feet into the front yard setback. The propose carport would encroach approximately 20ft. into the required minimum front -yard setback of 30ft. Staff observed at least two carports on the same street. 17 letters were sent to the neighbors. Staff has not received any letters in favor or in opposition of the request. Chris LeFevre made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Mark Bacher seconded and the motion was carried unanimously. 12. ZBA-20-11: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 1 Lot 7 of the Aylesworth Addition, Plainview, Texas, Hale County, also known as 1309 Travis Street. The applicant requested a special exception to construct a 12 x 25 carport in the front - yard setback. The propose carport would encroach approximately 20ft. into the required minimum front -yard setback of 30ft. Staff observed at least four carports on the same street. 24 letters were sent to the neighbors. Staff received 3 letters in favor of the carport. Mark Hardin made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Mark Bacher seconded and the motion was carried unanimously. 13. ZBA-20-1-2: -Consider the request of a special exception of the minimum front set 1 Lot 8 N12'-9 of the Aylesworth Addition, Plainview, Texas, Hale County, also known as 1307 Travis Street. Zoning Board of Adjustment July 27, 2020 The applicant is requesting to construct a 12 x 20 carport in the front -yard setback. The propose carport would encroach approximately 20ft. into the required minimum front -yard setback of 30ft. Staff observed at least four carports on the same street. 24 letters were sent to the neighbors. Staff received 3 favor of the carport. Mark Bacher made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Chris LeFevre seconded and the motion was carried unanimously. 14. ZBA-20-13: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 6 S61' OF C144' of the High School Addition, Plainview, Texas, Hale County, also known as 2102 Smythe Street. The applicant is requesting to construct a 20 x 20 carport in the front -yard setback. The propose carport would encroach approximately 20ft. into the required minimum front -yard setback of 25ft. Staff observed at least two carports on the same street. 12 letters were sent to the neighbors. Staff received 2 letters in favor of the carport. Chris LeFevre made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Mark Bacher seconded and the motion was carried unanimously. 15. ZBA-20-14: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 9 Lot 7 Unit 1 of the Thunderbird Addition, Plainview, Texas, Hale County, also known as 1112 W 29th Street. The applicant is requesting to construct a 24 x 13 carport in the front -yard setback. The propose carport would encroach approximately 20ft. into the required minimum front -yard setback of 25ft. Staff observed at least two carports on the same street. 16 letters were sent to the neighbors. Staff received 2 letters in favor of the carport. Mark Hardin made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback.
