HomeMy WebLinkAbout96 1210 min/__ ,. /, MINUTES CITY COUNCIL MEETING City of Plainview ..December 10, 1996 The Plainview City Council held a regularly scheduling meetingat 7:30 p.m., Tuesday, December 10,1996 in the Council Chambers of the Plainview City Hall at 901 Broadway. The notice and agenda for this meeting was posted at 5:00 p.m. on December 4, 1996 at 4:00 p.m. The Council met in Pre-Session at 7:00 p.m. Action may betaken on eachagenda item. Councilmembers present for the meeting were: Mary Virginia Kirchhoff-Precinct 2, Mike Hutcherson-Precinct 4, Ross Owen-Precinct 5 and Bobby R. McGehee-Precinct 6. Councilmembers Rey Rosas-Precinct 3 and Irene Favila-Precinct 7 were absent. Mayor Lloyd C. Woods presided. Staff members present were: Jim Jeffers-City Manager, Wally Hatch-City Attorney, John Berry- AssistantDirector of Public Works, Dale Simpson-Director of Civil Service, Capt. William Mull- Interim Police Chief, and Karen McBeth-City. Secretary. News media present:. Phil Hamilton-Lubbock Avalanche-Journal OPEN MEETIN 1. Invocation -The Honorable Ross Owen Pledge of Allegiance 2. .Recognitions/Oath of Office - No recognitions or Oath of Office. 3. Consent Calendar a) -Minutes -None presented, none approved. b) .Departmental Reports were: accepted. c) Expenditures were approved. d) Excused Absences were: extended to Councilmember Rey Rosas and Irene Favila. e) Council meeting. Consider rescheduling the December 24, 1996, regular City Council meeting. The meeting will be on December 19, 1996, at the time of the regular Work Session. f) Landfill.Farm Services. Consider contract amendment with Rob Wilson. The contract amendment was approved. REGULAR AGENDA ITEMS 4. Zone Case 634 -- 24t" and Columbia. (Second reading) Ordinance No. 96-3103. An Ordinance amending the zoning map of the City of Plainview, Texas to re-zone property located at _~ -- __ _. ,~ , ,. /.~ ~ ~' ..24th and Columbia from an M-1; Light Manufacturing District o a C-3, Commercial General Business Zoning District.; Cumulativeness clause; Conflicts clause; Severability clause; And effective date. Councilmember McGehee moved to adopted Ordinance No. 96-3103 and Councilmember Mike Hutcherson seconded the motion. :Director of Community Services John Castro reviewed the proposed Ordinance, explaining the property in question is directly across 24th street from a United Super Market and the request is to rezone this property so as to build a new United Super Market. The change does not impact the neighboring property in any adverse. way at all. Planning and Zoning Commission recommended the zone change and it passed at its first reading. Councilmembers Kirchhoff, Hutcherson, Owen and McGehee along with Mayor Woods voted in favor of the ordinance. No Councilmembers voted against it. The ordinance was approved. 5. Traffic -Ennis Street. Consider a petition calling for adjustments to traffic patterns on Ennis Street between 11"' street and the I27 service road. Mayor Lloyd Woods told those assembled there were no plans to widen Ennis Street within the forseeable future. He said it is in the long-range plans;..but the emphasis is on the very long range. Mr. George Garman, 1507 Ennis, addressed the Council, stating that traffic on Ennis is a serious problem, and in some instances hazardous due to the speed with which traffic travels the length of Ennis. He said this past Sunday a gravel truck drove in .front of his home at approximately 50 mph. He called the police and they did take care of this problem, but. he said this is the type ofproblem the people who live on Ennis Street experience regularly. He stated that the people who live on Ennis have circulated a petition, which has been given to the Mayor and Council, and they are asking the city to do something to slow down the traffic on their street. At a recent Work Session it was' reported that Stop signs do not adequately address the problem of people speeding down a street, they only speedup between signs. Mr. Garman said he would be disappointed if their request was denied on this premise. At one time there were four way Stop signs on Ennis at 11th Street and at 16th Street: Residents on Ennis said the fast traffic was not so large a problem then. Mr. Garmon said the petitioners conducted their own traffic study and said you could use the frontage road or Ennis St., going' from Olton Road to 24th Street, and it took the same amount of time. He said it appeared that people would use the frontage road if there were Stop signs placed on Ennis St. He suggested that Ennis is the route of choice because it is a nice street and there is nothing to slow them. down and they speed down Ennis. He stated he hoped the residents of Ennis would be included in any student conducted by the City Council and/or the Planning and Zoning Commission. He said he hoped they could establish some credibility with the Council and get them to understand this is a serious problem. Mr. Garmon asked if stop signs or other speed deterrants could be placed down the length of Ennis. Frank Gastro, 1107 Ennis, .addressed the Mayor and Council stating he feels addressing the City Council is futile because 96 people signing a petition is not going to have any: impact on the governing body of 25,000 .people. He said when he backs out of his drive way it is often difficult to do so immediately because of the frequency and speed of the traffic. He said most cars come off other streets west of Ennis; between 11th & 24th Streets. He believes. the condition of many streets in town warrants attention, they are all contaminated with bumps, dips, etc. He said he believed 24th Street to be in terrible shape, and needs to be repaired. He said if the City were to widen Ennis signal lights ~'- ~~, '~ would have to be installed. He felt Stop signs would slow traffic down. Mrs. Doris Billingsley, 2009 Ennis,-told the Council she does not want Ennis. St. widened and wants to know what can be done to assure .residents that it will never be widened. Mayor Woods said he felt it would be many, many years before anyone considered widening Ennis, but he could not bind future Councils. Mrs. Billingsley expressed displeasure with the number of large, commercial " 16 wheel" trucks that came _down Ennis at high speed. City Councilmember McGehee asked Mr. Garmon what the major concern was, speed or volume of traffic? Mr. Garmon said, personally, if the speed could be controlled the volume of traffic would take care of itself. He said if people were forced to drive on 30 mph, preferably with the. use of Stop signs, they would use the frontage road for .through traffic. Mr. Garmon said many. people .who signed the petition were concerned their property value was being diminished by the uncontrollable ..speed of traffic. Councilmember McGehee told Mr. Garmon that if the value of property on Ennis Street was truly dinnished they need to go before the Appraisal Board and seek tax relief Councilmember McGehee asked Mr. Gaston what changes he wanted o see made. Mr. Gaston said he did not want anything changed, he just specifically did not want to have it widened or the speed limit increased. Councilrnember Ross Owen told Mr. Garmon thaf he certainly sympathized with the group but wondered why Mr. Garmon thought this problem unique to his street. Mr. Garmon said the speeding problem was. due primarily due. to the uninterrupted length of straight, unblemished length of street. He said most other streets have stop signs or dips to discourage speeders. Councilmember Owen inquired of Mr. Castro what trucks were doing on Ennis Street? Mr. Castro said it was definitely not a truck route, but it was not marked by signs. Mr. David GarYUnage stated that at one time there were.4 way Stop signs at 11th & 16th and wanted to know why they were removed. Mayor Woods asked Mr. Castro to research the files and find out why they were removed. Mayor Woods said the City will form a committee, which will include Mr. Garmon and others from the petitioners to meet with Planning and Zoning Commission as soon as practical. Councilmember McGehee made a motion that all of the concerns of the citizens living on Ennis Street be studied by a group from the petitioners and the Planning and Zoning Commission. Mike Hutcherson seconded . the motion. Councilmember Mary Virginia Kirchhoffasked how many people from the petition would meet withPlanning and Zoning? Mr. Garmon said probably three. Councilmembers from Precincts 2, 4, 5, 6 and Mayor Woods voted in favor of the motion; no one voted against it. T'he motion passed unanimously. 6. Budget Amendmement -.Police Salaries. (First reading) Ordinance No. 96-3104. An Ordinance of the City of Plainview, Texas amending Ordinance No. 96-3090, as such pertains to compensation for certified police officers and establishing an effective date. Councilmember Ross Owen made a motion that Ordinance No. 96-3104 be approved. Councilmember Mike Hutcherson seconded the motion... City Manager Jim. Jeffers told. the Council that. last week the Police Petitioners ~. ~_ Committee and the Council had agreed on an amount of salary increase. To implement this agreement there must be a budget amendment outlining the amount of pay increase, the date of inception and the total amount the budget will be increased.. The final figures are outlined in the ordinance.. Councilmembers from Precincts 2, 4, 5, 6 and Mayor Woods all voted in favor of the motion, which passed unanimously. 7. Open Forum. Hear citizens requests and comments per Open Forum Policy. No one spoke in the Open Forum. 8: Closed Session. Deliberate the appointment, employment, evaluation, reassignment or duties, removal, discipline or dismissal of a public officer or employee, or to hear complaints or charges. (Board of Adjustment,: Senior Citizen Advisory Commission, Board of Minimum Housing Standards and Senior Citizens Advisory Committee): This meeting is authorized by [TEX. GOV. CODE ANN. §551.074; 551.075 (Vernon 1996)]. No Closed Session was held. 9. Boards, Committees and .Commissions.. Consider appointments and/or removals to CityBoards, Committees .and Commissions. Councilmember Ross Owen moved to place Ronald Simmons on the Board ofMinimum Housing Standards; his motion was seconded by Councilmember McGehee; the Mayor and 'four Councilmembers present voted in favor of the motion. 10. Adjournment. -Councilmember Owen moved the meeting be adjourned; the motion was seconded by Councilmember McGehee; the motion carried unanimously. among the Councilmembers and Mayor Woods; Mayor Woods declared the meeting adjourned at 8:30 p.m. and wished all those present a Merry Christmas.
