November 26, 1996
The City Council of the City of Plainview met in a regularly scheduled meeting in City Hall, 901
Broadway, at 7:30 p.m. on Tuesday, November 26, 1996. The notice of this meeting was posted
at 5:00 p.m. on November 20, 1996 at City Hall. The Council met in pre-session at 7:00 p.m.
Mayor Lloyd C. Woods presided. Councilmembers present were: Mary Virginia Kirchhoff-
Precinct 2, Rey Rosas-Precinct 3, Mike Hutcherson-Precinct 4, Ross Owen-Precinct 5, Bobby
McGehee-Precinct 6 and Irene Favila-Precinct 7. Action may be taken on each item of the
agenda.
Staff members present: Jim Jeffers-City Manager, Wally Hatch-City Attorney, Will Mull-Interim
Police Chief, John Castro-Director of Community Services, Ches Carthel-Director of Public
Works, Cindy Gasaway-Main Street Coordinator, and Karen McBeth-City Secretary.
Guests present. were: Peggy Eason, Patty Ratliff, .Darla Newland, Jess Barrera, Mike Glenn, Jim
Ferrell, Stan Branam and .Andrew Houseley.
1. Invocation -The Honorable Bobby McGehee

2. Recognitions -Andrew Houseley was allowed to announce that a group of athletes were
:coming: to Plainview to put on an exhibition and to speak out .against the use of drugs and alcohol.
3. Consent Calendar - Councihnember Ross Owen moved to approve the Consent Calendar.
His motion was seconded by Councilmember Irene Favila. All six Councilmembers present and
the Mayor voted in favor of the motion.
a) Minutes were approved.
b) Departmental Reports were accepted.
c) Expenditures were approved..
d) Roofing Registration -Ordinance No. 96-3101. An Ordinance of the City of
Plainview, Texas, amending Chapter 1, Section -103 -Violations. To provide
a registration process and fine for roofing contractors; Providing for a
severability clause; Directing .publications of the descriptive caption together
with penalty provisions of this ordinance; And effective date. Second Reading.
The ordinance was .approved.

4. Police Pay Referendum. Consider offering an alternative minimum salary proposal.
Mayor Woods recognized Jess Barrera, of the Plainview Police Association. Jess Barrera, a
Detective with the Plainview Police Department, spoke as the President of the Plainview Police
Association. He thanked. the Mayor and Council for the opportunity to present a proposed salary
increase petition. Det. Barrera said the proposed salary increases would bring the department into
line with other cities and. it .would help solve the extremely high turnover rate of young officers.
He stated thatpresently Plainview serves as a training ground for other police departments. The
Council questioned Det. Barrera about other pay increases in the future. Detective Barrera said
this was cone-time increase establishing the minimum for entrance level and each step up the
.chain of command and any future. increase would be the normal percentages given to ail city
.employees, per budget allotments. The petition submitted to the 1Vlayor and Council establishes
exact increase amounts for each position. The petition submitted requested a city wide election
to vote on the- police-pay increase.
The Mayor and Council asked questions about the percentages, stating that some positions were
at a higher percentage than others. Barrera said it was an effort to encourage and reward officers
for loyalty and longevity. Mayor Woods asked if the petitioners committee was amenable to
negotiating with the Council regarding the pay increase.
Det. Barrera said they would be willing to negotiate. He stated he did not want to have to hold
an election ifthe Association could get a serious and reasonable offer.
City ..Manager Jim Jeffers said that according to State law only two groups of City employees
could petition for pay increases - .fire and police. He told the .Council that they have a choice;
enter into negotiations as soon as possible or call for an election. The election must be called by
December 4, 1996. If the Council begins negotiations and a .settlement is reached, or the
Petitioners withdraw their request,. an election will not have to be called. Mr. Jeffers said turnover
is a consideration and any counterproposal should be structured toward keeping new officers. The
City Manager stressed that all employees or all the City departments axe important. He thanked
the police officers and petitioners for their interest in the City.
Mayor Lloyd C. Woods made a motion to officially negotiate and approve making a counter offer
to be formulated after meetings to be scheduled within the next few days, at which a quorum of
Councilmembers are to be present. Mike Hutcherson seconded the. offer. Councilmembers from
Precincts 2, 3, 4, 3, 6 and..the Mayor voted in favor of the motion. Councilmember Irene Favila,
Precinct 7 .voted against the motion.
5. Election -Police Pay Referendum. Ordinance No. 96-3100. An Ordinance of the City
ofPlainview calling and setting the date for a Special Municipal Election; Setting date for run-off
election; Designating Precincts and polling places; besignating, .pursuant to Chapter 141 of the
Texas Local Government Code, the election to vote for or against the adoption of the proposed
minimum salaries for each rank, pay grade, or classification in the City of Plainview Police
Department; And effective date of the proposed minimum salaries; And posting Notice of

Election. Second Reading; Councihember Buddy McGehee moved to table Ordinance No. 96-
- 3100. The motion was seconded by Councilmember. Rey Rosas and passed by unanimous vote.
Mayor Lloyd: Woods declared a four minutes recess. The Council Meeting resumed immediately
following this recess.
6. Sanitary Landfill .Charges. Ordinance No. 96-3102. An ordinance of the City of
Plainview, Texas, amending Section 22-35, Sanitary Landfill Charges and Rules of the Plainview
Code of Ordinances; Cumulativeness clause; Severability clause; Conflicts clause; And effective
date, Second Reading. Councilmember Ross Owen moved to approved Ordinance No. 96-3102.
Councilmember McGehee seconded the motion. Director of Public .Works asked the Council if
they had any questions regarding the ordinance. ' No one had any. Councilmember Rosas asked
if the City. had received any calls or letters regarding the ordinance. Mr. Carthel said no. The
Mayor and Councilmembers from'Precincts 2, 4, 5 and b voted in favor of the motion to approve.
Councilmembers Rey Rosas-Precinct 3 and Councilmember Irene Favila-Precinct 7 voted against
the motion. The motion carried.
7. Plat Exemption -Happy Union Baptist Church -Northwest Corner of Bullock and
Hearn Streets. Consider a request from Happy Union Baptist Church to be exempt from platting
requirements. Councilmember Bobby McGehee made the motion to approve the request and it
was seconded by Councilmember ..Mike Hutcherson. Ches Carthel said the staff recommends
approval of this request. Councilmember McGehee amended his motion to include that a contract
be drawn up stating that if at sometime in the: future this property would. need to be platted, that
the Happy Union Baptist Church will comply with any future platting requirements. The Mayor
and all six Councilmembers voted in favor of the amendment regarding the contract and in favor
of the motion to grant the request. No one voted against either motion.
8. Zone Case 634. Ordinance No. 96-3103. An Ordinance amending the zoning map of the
City of .Plainview, Texas to rezone property located at 24th and Columbia from an M-1, Light
Manufacturing District o a C-3, Commercial General Business Zoning District; Cumulativeness
clause; Conflicts clause; Severability clause; And effective date. First Reading.. Councilmember
Bobby McGehee made. a motion to approve. Ordinance No. 96-3103 for its first reading.
Councilmember Ross Owen seconded the motion. Director of Community Services reviewed the
ordinance stating that it was approved by the Planning and Zoning Commission. The Mayor and
all six Councihnembers present approved the ordinance for its first reading. No one voted against
it.
9. Open. Forum. Hear citizens requests and comments per Open Forum Policy. No one
spoke on the Open Forum.
10. Closed Session.:. Deliberate the appointment, employment, evaluation, reassignment or
duties, removal, discipline or .dismissal of a public .officer or employee, or to hear complaints or
.charges. (Board of Adjustment,-Senior Citizen Advisory Commission, .Board of Minimum
Housing Standards and Senior Citizens Advisory.Committee). This meeting is authorized by
[TEX. GOV. CODE ANN.§551.074, 551.075 (Vernon 1996)]. No Closed Session was held.

11. Boards, Committees and Commissions. Consider appointments and/or removals to City
Boards, Committees and. Commissions. On a motion by Councilmember McGehee, which was
seconded by Councilmember Hutcherson, the following appointments were made: Ronald
Simmons to the Board of Minimum Housing, Freddy Willis was appointed to the Board of
Adjustment, by unanimous vote.
12. ...Adjournment. -Councilmember Ross. Owen moved. to adjourn.. Councilmember
Hutcherson seconded .this .motion which carried unanimously. Mayor Woods declared the meeting
adjourned at 9:46 p.m.
