CITY COUNCIL MEETING
City of Plainview
November 12, 1996
The .Plainview City Council held, a meeting at 7:30 p.m., Tuesday, November 12, 1996 in the
Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session at
7:00 p.m. The Notice and Agenda for this meeting was posted in City Hall at 5:00 p.m. on November
6, 1996. Mayor. Lloyd C. Woods presided. Councilmembers present were: Rey Rosas-Precinct 3,
Ross Owen-Precinct 5, .Bobby. R. McGehee-Precinct 6, and Irene Favila-Precinct 7. Absent
Councilmembers were: Mary Virginia Kirchhoff-Precinct 2 and Mike Hutcherson-Precinct 4.
Staffmembers present: Ches Carthel-Director of Public Works, John Castro-Director of Community
Services, Cindy Gasaway-Main Street Coordinator, William Mull-Interim Police Chief, Gary Glass-
Fire Chief and Karen McBeth-City Secretary.
OPEN MEETING.
1. :Invocation -The Honorable Lloyd.Woods
Pledge of Allegiance -The Honorable Rey Rosas
2. Recognitions - Ches Carthel, Director of Public Works recognized several City employees
who took part in the fall. Clean Up Campaign,. and helped many senior citizens clean up their
residences and alleys, as well as helping clean up thecity in general. They devoted time from their
weekend to make Plainview a better place in which to live, and demonstrated they live up to the
"higher standard" to which city employees are encouraged to adhere.
3. Consent Calendar -Councilmember Irene Favila moved that the Consent Calendar be
approved as presented. Councilmember Ross Owen seconded the motion, which carried unanimously
by vote of the Mayor and Precincts 3, 5, 6 and 7.
a) Minutes were approved.
b) Departmental Reports were accepted.
c) Expenditures were approved.
d) Election -Police Pay Referendum. Ordinance No. 96-3100.. An Ordinance of the
City of Plainview calling and setting the date for a Special Municipal Election; .Setting
date for run-off election; Designating Precincts and polling places; Designating pursuant to
Chapter 141 of the Texas Local Government Code the. election. to vote for or against the
adoption of the proposed minimum salaries for each rank, pay grade, or classification in the

City ofPlainview Police Department; And effective date of the proposed minimum salaries;
And posting Notice of Election. First Reading. Was approved for the First Reading.
e) Crimestoppers Assistance Agreement. Consider renewal of assistance agreement
between the City of Plainview and Plainview/Hale County Crimestoppers. Renewal
was approved in the amount of $3,000 and for a period of one year, expiring on
October 1, 1997.
REGULAR AGENDA ITEMS
4. Hotel/Motel Taz -:Chamber of .Commerce. Consider approval of the Hotel/Motel Tax
expenditures of the Plainview Chamber of Commerce in accordance with the agreement between the
City and Chamber. Jim Ferrell, Executive Vice President ofthe Chamber of Commerce addressed
the. Council, stating he appreciated the partnership. the Chamber has with the .City in the using
Hotel/1VIote1 tax. He said there has been a change in direction the Chamber has taken in attracting
new :.conventions, ,meetings. and. tourists. He asked Lori Glenn, the Director fore Convention and
Tourism for the Chamber to explain his to he Council. Lori Glenn, who lives at 2905 Stevens, said
she is spending all. of her time in recruiting new meetings and conventions to Plainview. She. is using
the-funds to bring in new business. rather just funding activities which have been held here for many
years.. She works with a committee and feels they have accomplished a great deal this past year. The
South Plains Bankers Association is including Plainview in its rotation system and will meet for two
days every third year. The South Plains Expo for recreational. vehicles,. sports and' cars was held here,
.while not well attended it was a good learning experience. "Living on the Draw" was another event
that. was a success and hopes to be repeated. She helps with meetings, makes signs, fills give away
"Ditty Bags," makes name tags, as well as other things. Along with Cindy Gasaway, she created a
tourism brochure which helps promote Plainview. She has a page on the Internet and gets good
responses from it.
Councilmember Ross Owen asked about the noticeably smaller amount to be spent for
advertising/brochures reflected in their 1996-97 Budget, .and Jim Ferrell said that their outdoor
advertising cost is being shared with Wayland Baptist University .and this cut. some of the expense in
half. Mr. Owen moved that the expenditures of the Plainview Chamber of Commerce be approved.
Councilmember Rey Rosas seconded his motion and the motion was approved unanimously when the
Council was polled by the City Secretary...
5. Police Pay Referendum -Consider appointment of the City of Plainview chief negotiator and
negotiating team to meet with the Petitioners Committee regarding the police pay referendum issue.
Rey Rosas made a motion to appoint City Manager Tim Jeffers as the chief negotiator, along with
staff support and a member of the City Council to sit in and observe, and/or help with negotiations.
Councilmember Irene Favila seconded the motion.
Mayor Lloyd Woods said he felt Mr. Jeffers, and any staff members. he thought would be helpful,

.should form the entire team. He said a Councilmember, or Mayor, being present might make some
feel intimidated and this would not be good for negotiations.
Councilmember Ross Owen. said that Mr. Jeffers is the City Manager, he should be in charge, and if
he feels like a Councilmember should be there,. he is free to ask them, but ultimately Mr. Jeffers
should make the. decisions regarding the negotiations.
Councilmember Irene Favila said. she felt a Councilmember should be involved in this process,
because the Council has to answer to the citizens and one or two Councilmembers should be present
during all negotiations.
Mayor Woods called for a vote. Councilmembers from Precincts 3 and 7.voted in favor of the
motion; Councilmembers from Precinct 5 and 6, and the Mayor voted against the motion. The motion
failed.
Councilmember Bobby McGehee made a motion to name Jim Jeffers as the chief negotiator, with the
authority to enlist the. assistance of the staff as he desires, the City Council as he desires, or from any
citizen and/or expert as he desires, but any and all assistance is at the discretion of the City Manager.
Ross.Owen seconded this motion. Mayor Woods, .Councilmembers McGehee and Owen voted in
favor of the motion. Councilmembers. Rosas and Favila voted against the motion. The motion
carried..
6: Roofing Registration. Ordinance No. 96-3101. An Ordinance of the City of Plainview,
Texas, amending Chapter 1, Section 103 -Violations, To provide. a registration process and fine for
roofing contractors; Providing for a severability clause; Directing publications of the. descriptive
caption together with penaltyprovisions of this ordinance; And effective date. First Reading. Bobby
McGehee, .Councilmember Precinct 6, made the motion. to approve Ordinance No. 96-3101 for its
First Reading and was duly seconded by Ross Owen, Councilmember from Precinct 5.
Director of Community Services John Castro reviewed the ordinance, stating that this was a way of
protecting Plainview property owners from unscrupulous roofers who come in after a hail storm and
take advantage of the situation: By requiring anyone who does roofing for hire to register with the
City of Plainview, giving their correct name and address. where they can be reached should any
property owner have a problem with their quality of work or roofing materials. No fee is required,
no bond is required.
The Mayor and all .four Councilmembers voted in favor. of the motion and it passed for the First
Reading.
7. Sanitary Landfill Charges.. Ordinance No. 96-3102. An Ordinance of the City of
Plainview, Texas, amending Section 22-35, Sanitary Landfill Charges and Rules of the Plainview
Code of Ordinances; Cumulativeness clause; Severability clause; Conflicts clause; And et~ective date.
First Reading. The motion to approve Ordinance No. 9b-3102 was made by Councilmember Rey

Rosas and seconded by Councilmember McGehee.
Chen Carthel, Director of Public Works, reviewed the proposed ordinance, stating the revisions
focused primarily on roofing, construction and demolition debris brought to the landfill for disposal
by contractors, but also includes homeowners who. do the work themselves. This type refuse will only ~
be admitted to the landfill at a cost of $41 per ton. Individuals who must replace the roof on their
home can no longer use their water bill to dump at the landfill without additional cost. It was noted
that in the case of roofing material, this cost would most likely be borne by insurance companies and
added onto the estimates and final billing submitted to them for payment. Mr. Carthel said the next
cell of the landfill,. which is being prepared now, will cost more than the last one and there is not
sufficient cushion to pay for the expanding landfill
Councilmember. McGehee .said the landfill should be paid for by those who use it, and roofing,
construction and demolition debris takes up the greater portion of the landfill.
..Councilmember Rey Rosas said he felt it was penalizing those. individuals who were bettering their
homes: by improving them and this was an additional cost to the taxpayer.
Councilmember Ross Owen asked how much it cosf to open a new .cell. in the landfill. Mr. Carthel
said the current cell. they are preparing will cost $450 thousand dollars.
Mayor Woods called for the vote: -The Mayor and Councilmembers of Precincts 5 and 6 voted in
favor of the motion to approve; Councilmembers of Precincts 3 and 7 voted against the motion; the
.motion passed and. Ordinance No. 63-3101 was approved for .its first reading.
8. Open Forum. Hear citizens requests and comments per Open Forum Policy. Councilmember
Rey. Rosas invited the Council and. the public to attend the Open House to be held at Unger Memorial
Library on December. 4, 1996. The Library will also host Business After Hours on March 24, 1997.
He also said a blood drive will be held there on November 27, 1996,. and encouraged everyone to
participate.
Mr. Rosas displayed a plaque given to John Sigwald, the Librarian at Unger, for Distinguished
Service to Literacy.
9. Closed Session. Deliberate the appointment, employment, evaluation, reassignment or duties,
removal, discipline or dismissal of a public officer or employee, or to hear complaints or charges.
(Bond Infrastructure Advisory Committee, Board. of ..Adjustment, Senior Citizen Advisory
Commission, Board of Minimum Housing Standards and Parks Advisory Commission). This meeting
is authorized. by [TEX. GOV. CODE ANN. § 551.074, 551.075 (Vernon 1996)]. A Closed Session
wasnot held.
10. Boards, Committees and Commissions. Consider action. per Closed Session regarding
appointments and or removals to City Boards, Committees and. Commission.. Without holding a

Closed Session, Bobby McGehee moved that Bill Hogge be appointed to the Senior Citizens
Advisory Committee and Freddy Willis be appointed to the Board of Adjustment. Rey Rosas
seconded the motion and it passed unanimously by the Mayor and' four Councilmembers present.
11. Adjournment.- Ross Owen moved to adjourn the meeting and Bobby McGehee seconded
the motion. The motion carried unanimously and Mayor Woods declared the meeting adjourned at
