MINUTES
CITY COUNCIL WORK SESSION
November 7, 1996
The City Council of the City of Plainview met in a Work Session on Thursday, November 7th,
at the Plainview Convention Center at 11:30 a.m. The agenda and notice of this meeting was
posted at City Hall on November 1, 1996, at 5:00 p.m. Mayor Lloyd Woods presided.
Councilmembers present were: Mary Virginia Kirchhoff-Precinct 2, Rey Rosas-Precinct 3, Mike
Hutcherson-Precinct 4, Ross Owen-Precinct 5, Bobby R. McGehee-Precinct 6 and Irene Favila-
Precinct 7.
Staff members present were: Jim Jeffers-City Manager, Ches Carthel-Director of Public Works,
Norman Huggins-Director of Finance, Del Essary-Solid Waste Superintendent, Wally Hatch-City
Attorney, Shane Harrell-Legal Assistant, and Karen McBeth-City Secretary.

Mayor Woods called the meeting to order at 11:35 a.m. A quorum was present. The Council
reviewed the agenda for the City Council meeting of November 12, 1996.
Liaison Reports -Councilmember Irene Favila attended the Housing Authority meeting and
reported that two houses are being constructed at 28th & Fresno, and two more are ready to begin.
Three families have been approved to purchase these houses through the First Time Homebuyers
program. She encouraged everyone to go by and see these houses under construction.
She also reported the Youth Advisory Meeting met at 7:00 a.m. this morning and five student
representatives attended. They held elections and will meet again in two weeks.
Councilmember Mike Hutcherson reported to the Council that the grocery store building being
renovated by Lowe's has finished the parking lot and work is continuing on the building.
City Mana eg r Reports - Mr. Jeffers told the Council that the Clean Rivers Act adopted by
Legislation places an assessment on each member city as a contribution to keep up the State's
water ways.. There is a $4,537.50 due from the City on November 30, 1996. Texas Natural
Resource Conservation Commission can assess apenalty - 5 % per month the first two months -
and then 1 % per month - by State law, but the fine is not to exceed twice the amount of the
required fee, and/or confinement to jail not to exceed 90 days. The agricultural community
refused to pay this and nothing was done to them, and later they were exempted by legislature.
To date, there has been no direct benefit to the City of Plainview by being a part of the Brazos
River Authority, which administers the -Clean River Program in Plainview. This year this
legislation sunsets and may not be re-authorized. If, however, the City did not pay the
assessment, it might jeopardize the West Texas Environmental Association's standing with
TNRCC, since the Brazos River Authority has agreed to assist in a site specific stream standard.

The Council had no objection to paying this assessment and it will be placed on the next agenda.
Charter Implementation - Mr. Jeffers reviewed excerpts from the newly implemented City Charter
so as to familiarize the Council and Staff with parts which directly affect the inter-relationship of
Staff and Council. Other parts of the newly adopted Charter will be studied in the future.
Mayor Woods adjourned the meeting at 1:07 p.m.
