October 22, 1996
The Plainview City Council held a meeting at 7:30 p.m., Tuesday,- October 22, 1996 in the Council
Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session at 7:00 p.m.
The notice of this meeting was posted in City Hall at 5:00 p.m. on October 15, 1996. Action may
be taken on each agenda item. Mayor Lloyd C. Woods presided. Councilmembers,gresent were:
.Mary. Virginia Kirchhoff-Precinct 2, Rey Rosas-Precinct 3, Mike Hutcherson-Precinct 4, Ross Owen-
Precinct 5, Bobby R. McGehee-Precinct 6 and Irene Favila-Precinct 7. Precinct 1 is without
representation until. Special Election of January 18, .1997.
.Staff members present were: Jim Jeffers-City Manager, Wally Hatch-City Attorney, John Castro-
Director of Community Services, Ches Carthel-Director of Public Works, Roland Asebedo-Asst. Fire
Chief, William Mull-Interim Police Chief Norman Huggins-Director of Finance, and Karen McBeth-
City .Secretary.
News media present:. Richard .Orr-Plainview Daily Herald and Wayland. Baptist University video
crew.
OPEN MEETIN
1. .Invocation -The Honorable Rey Rosas
Pledge of Allegiance -Scout Kyle Dickson
2. Recognitions -Mayor Woods recognized Hale County Crisis Center. volunteers for their
good work and they help they give to battered women and children.
3. Consent Calendar -Bobby R. McGehee moved to approve the Consent Calendar. Rey Rosas
seconded the motion. The motion carried unanimously:
a)' Minutes were approved.
b) Departmental Reports. were accepted.
- c) Expenditures were approved.:.
d) Records Management Plan -Ordinance No. 96-3098. An Ordinance of the City
of Plainview, Texas, establishing an active and continuing records management
program to be administered by a records management officer: Second Reading,
Passed and approved.
e) Council Relations Policy. Consider .adoption for the present City

Councilmembers. Approved and adopted.

f) Fire/EMS Mutual Aid Agreement with Hale Center. Consider authorizing the
Mayor to execute a Mutual Aid Agreement. The Mayor was so authorized..
g) EMS. Consider. authorizing the. Mayor to execute an agreement with the South
Plains Emergency Medical Services for mutual aid.. Mayor Woods was so
authorized.
REGULAR AGENDA ITEMS
4. Notice of Election -.Ordinance No. 96-3099. An Ordinance calling and setting the date for
the Special Municipal. Election; Setting date for run-off election; Designating Precinct and polling
place; Designating the election of a Councilmember from Precinct 1; Appointing election officials;
Setting hourly xate for Election officials; And: posting notice of Election. Second and Final
Reading. Ross Owen made the motion to approvethe.Notice of Election Ordinance and Mike
Hutcherson seconded the motion. City Secretary Karen McBeth reviewed the ordinance,. stating the
election was necessary to fill the Precinct 1 Councilmember position due to the resignation of Alton
Jackson. The election will be on 7anuary 18, 1997. She reminded the Council that the first day to
file for a place on the ballot is November 26, 1997 and the last day to file is December 19. The first
day of Early Voting in person is December 30, and the last day of Early Voting: in person is January
14. A candidate may announce his intention to file anytime prior to November 26, but cannot actually
file until that date. Mayor Woods asked for a vote, and all six Councilmembers and the Mayor voted
to approve the Ordinance.
5. Petition to Increase Salaries -Police. Consider development of an offer on alternative
minimum .salary proposal in response to the Petitioners Committee request to raise the Minimum
Yearly Salaries for certain sworn members of the Plainview Police Department. Bobby R. McGehee
made a motion that the City develop and offer an alternative minimum salary proposal and negotiate
.with the Petitioners Committee regarding minimum salaries for the Police Department. His motion
was secondedby Rey Rosas. City Manager..told the Council that State laws give Police and Fire
municipal employees the right. to Petition for.. wage increases, and. they are. the only groups of
municipal employees which may do so. He said that even though the Police Department is the only
group .that has. petitioned. for such an increase, any action taken. will nonetheless impact both
departments. A petition was circulated on behalf of the Police Department and it was certified by the
city secretary on October 8. The petition calls for a thirty percent (30%) increase. Administration
is analyzing that request now. Mr. Jeffers said the Council has three options: (1}Grant the increase;
(2) Reject the request and call an election; or (3}Negotiate with the Petitioner's Committee. He said
if the Council. negotiates and. an agreement is ,not reached, an election will be called for January 18,
1997. Councilmember McGehee asked why January 18? Mr: Jeffers .explained it was the next
available Uniform ElectionDate, and State law set this date. There were no further questions and
there were six Councilmember votes and one Mayoral vote in favor of the motion.

6. ' Open Forum. Hear citizens requests and comments per Open Forum Policy. No one, spoke
during this portion of the meeting.
7. Closed Session. Deliberate the appointment, employment, evaluation, reassignment or duties,
.removal, discipline or dismissal of a public officer or employee, or tohear complaints or charges.
(Bond Infi-astructure Advisory Commission, Diversity Task Force, Board of Adjustment, Senior
Citizen Advisory Commission,. Council Liaison to .Housing. Authority and Parks Advisory
Commission and City Attorney evaluation). This meeting is .authorized by [TEX. GOV. CODE
ANN. § 551.074, 551.075 (Vernon 1996)]. Ross Owen made the motion to go into Closed Session,
and it was seconded by Mike Hutcherson. On a unanimous vote the motion carried.
8. Boards, Committees, and Commissions. Consider. appointments and/or removals to Bond
Infrastructure. Advisory Commission, Diversity Task Force, Board of Adjustment, Senior Citizen
Advisory Commission and Council Liaison. to Housing Authority and Parks Advisory Commission.
At 8:05 p.m., the Council reconvened in Open Meeting...Mike Hutcherson made the motion to
appoint Irene Favila- Councilmember Precinct 7, as the Liaison to the Plainview Housing Authority,
to replace Alton Jackson, Councilmember Precinct 1, who recently resigned. Her appointment was
approved unanimously by the Mayor and the"six Councilmembers present.
9. Personnel. Consider action per the discussion. in Closed Session regarding appointment,
employment, evaluation, reassignment or duties of a public officer or employee. No action was taken.
10. Adjournment. Ross Owen moved to adjourn the meeting. Rey Rosas seconded his motion.
The motion carried unanimously. Mayor Woods declared the meeting adjourned at 8:10 p.m.
PASSED AND APPROVED on November 12, 1996.
