CITY COUNCIL MEETING
City of Plainview
November 14, 1995
The Plainview City Council held a meeting at 7:30 p.m., Tuesday, November 14, 1995 in the
Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session
at 7:00 p.m. Mayor Lloyd C. Woods presided. Councilmembers present were: Alton Jackson
Sr.-Precinct 1, Rey Rosas-Precinct 3, Mike Hutcherson-Precinct 4, Barbara Dorman-Precinct
5, Dwain Dodson-Precinct 6, and Irene Favila-Precinct 7. Absent was Mary Virginia Kirchhoff-
Precinct 2.
Staff members present were: James P. Jeffers-City Manager, Ches Carthel-Director of Public
Works, Roland Asebedo-Asst. Fire Chief, Dale Simpson-Civil Service Director, John Castro-
Health Department Director, Muff London-Director for Community Development, Roy L.
Osborne-Police Chief, Barbara Sullivan-Municipal Court Judge, Norman Huggins-Director of
Finance, and Karen McBeth-city secretary.
News media present were: Richard Orr-Plainview Daily Herald, Steven Barrett-Lubbock
Avalanche Journal, and Mike Fox-KKYN Radio.
OPEN MEETING
1. Invocation - Ches Carthel
2. Recognitions - Muff London, Director for Community Development recognized Mr. Rick
Graves for his recycling efforts in Plainview. She read a proclamation designating November
15, 1995, as Texas Recycles Day in Plainview. Mr. Graves thanked Ms. London and the City
Council for their efforts in making recycling a growing effort in Plainview.
Mr. Ben Estes with Texas Natural Resources Conservation Commission said Texas A&M
presents a three day school as a training aid for city water department personnel. Mr. Estes
presented a certificate of excellence to Darryel Pierce, Water Treatment Plant Superintendent.
Only three such certificates are given in the fifteen county region of West Texas. The quality
of waste water management is the criteria used to determine who receives this certificate. Mr.
Pierce thanked Mr. Estes for the certificate, but stated it belonged to everyone in the water
production department as well as Ches Carthel and Jim Jeffers.
Lee Ann Matthews, 209 SE 10th, spoke on the behalf of Turnaround Plainview, she wished
to thank the Plainview Police Department, Hale County Sheriff's Office, J.B. Wheeler Unit,
Laidlaw Transit, Plainview Daily Herald, Fire Department and the City of Plainview for their
support.
Alvin Petty, Director of the Senior Citizens Center, issued an invitation and challenge to; the

Mayor and Council to play indoor balloon volley ball at 10:30 a.m. on December 8, 1995, and
join in their Christmas lunch. The Mayor thanked him for the invitation and said he hoped they
could all join in this event.
Miguel Perez explained his newly organized outreach program which helps young people who
are involved in gangs. He said three months ago there were only 27 young people coming to
his meetings, but now there were about 100. He said he believes he is making a difference in
their lives and wants everyone in Plainview to be aware of this ministry.
3. Consent Calendar - Rey Rosas made a motion to approve the Consent Calendar. Irene
Favila seconded the motion. The motion carried unanimously.

Expenditures were approved.

Parks. Consider adoption of a policy on naming City Parks, buildings and other
facilities. Policy was adopted.
e)
Hale County Appraisal District. Consider nominations to the Hale County
Appraisal District Board of Directors. Dwain Dodson and Mary Virginia
Kirchhoff were nominated to represent the City of Plainview on this board.
Animal Control/Humane Society. Consider a request from the Humane Society
for additional funding. The request was approved.

Board, Committee and Commission Appointments. Consider application for
Airport Board. Norman O. Wright was reappointed to the Airport Board for a
term beginning January 1, 1996 and ending December 31, 1998.
REGULAR AGENDA ITEMS
4. Fair Theatre. - This item was tabled.
Consider entering into a contract with the Fair Theatre Board of Directors
for the management of the Fair Theatre.
Consider purchasing the Fair Theatre.
5. United Americans Against AIDS. Consider a request for planting and "lighting" a tree
in a City park. Soila Reyes, local director for United Americans Against Aids, requested
permission to plant a live fir tree in the park on Sixth Street, by the Chamber of Commerce
office, which will be lit as a memorial to those who have died with AIDS. She asked the City's
help in furnishing the lighting for the tree, which they hope to be lit for the entire month of
December. She said the cost of installing and lighting the tree will be approximately $600 and

it would be appreciated if the City could help with this expense. She said World Aids Day is
December 1, and she asked for community support in remembering all those who have died with
AIDS. Barbara Dorman made a motion to endorse this project and provide up to $600 in
funding and in-kind services for lighting the tree. Dwain Dodson seconded the motion which
carried unanimously.
6. Housing. Consider adopting policy, guidelines for the First-Time Homebuyer Program.
Director for Community Development Muff London, explained this program is funded by a
$300,000 grant which provided for the down payment and closing costs (a minimum of $1,000
and a maximum of $6,000 per applicant) for approximately 50 people who qualify for this
program. It is to assist low-income citizens who live within the city limits of Plainview for the
purchase of a single residential unit (manufactured homes & condominiums accepted) that is the
applicants principal residence. The City has contracted with Caprock Community Action to
administer this program and the home loans will be made through mortgage companies and
banks. The program timeline is effective until May 31, 1997. Applicant selection is on a first
come first serve basis. No one that works for the City of Plainview or any elected official may
participate in this program. Irene Favila made a motion the Council adopt these policy
guidelines for this program. Rey Rosas seconded the motion. The motion passed by unanimous
vote.
Subdivision Platting. Ordinance No. 95-3063. An Ordinance amending the Subdivision
Ordinance No. 89-2087; Providing for an addition to Section 4, Procedure allowing for
administrative approval of amended or minor plats as defined by the Local Government
Code; Cumulativeness clause; Conflicts clause; Severability clause; And effective date.
First Reading.
Ches Carthel, Director of Public Works, gave an overview of the proposed ordinance. He said
it enabled the administrative staff to approve minor and/or amended plats consisting of four or
fewer lots, requiring no water or sewer lines. Amended, for this ordinance, means minor
changes or error corrections. Legislation was provided for this in the last session. It will speed
up the process for the citizens of Plainview, taking less than thirty days. It was approved by
the Planning and Zoning Commission. It will make the process more customer friendly.
Barbara Dorman moved Ordinance No. 95-3063 be approved for its first reading. Mike
Hutcherson seconded the motion. The motion passed unanimously.

Police - Diversity Training. Consider approval of a proposal to provide Diversity
Training to the Police Department.
Roy L° Osborne, Chief of Police, said Dr. Lewis will present a Training Workshop to the Police
Department on Friday, November 17, 1995. He said there will be two session so as to include
everyone without pulling anyone from their duties and it will be paid for from the narcotics
seizure funds. He said the training was to educate and create an awareness in the department
of the changes and differences in the general populous of Plainview. Dwain Dodson made a
motion the diversity training be approved. Barbara Dorman duly seconded the motion which

carried unanimously among the council members present.

Zoning. Ordinance No. 95-3062. Service Station Island and Canopies. An Ordinance
amending the zoning ordinances of the City of Plainview, Texas to amend Section 34:3,
Special front yard regulations, Paragraph 14 and Section 34:4, Side yard regulations,
paragraph 6; Cumulativeness clause; Conflicts clause; Severability clause; And effective
date. Second and Final Reading.
A. Public Hearing - Muff London, Director for Community Development,
reviewed the ordinance, explaining it made the process more customer friendly for those
individuals who were re-doing some older gas stations which were built prior to the
comprehensive master plan which imposes the present set back restrictions. No one spoke for
or against the ordinance.
B. Action - Mike Hutcherson made a motion the ordinance be approved. Rey
Rosas seconded the motion. The motion carried unanimously.
10. Adjournment - Mayor Woods adjourned the meeting at 8:20 p.m.
