CITY COUNCIL MEETING
City of Plainview
March 26, 1996
The Plainview City. Council held a meeting at 7:30. p.m., Tuesday, March 26, 1996 in the
Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in
Pre-Session at 7:00 p.m. The. agenda for this meeting was posted at 5:00 p.m. on March 20,
1996. Mayor Lloyd C. Woods presided. Councilmembers present were: Alton Jackson
Sr.-Precinct One, Mary Virginia Kirchhoff-Precinct Two, Rey Rosas-Precinct Three, Mike
Hutcherson-Precinct Four, Barbara Dorman-Precinct Five, Dwain Dodson-Precinct Six, and
Irene Favila-Precinct 7.
Staff members present were: James P. Jeffers-City Manager, Ches Carthel-Director of
Public Works, Wally :Hatch-City Attorney, Dale Simpson-Civil Service Director, John
Castro-Director of Community Services, Roy L. Osborne-Police Chief, Norman
Huggins-Director of Finance, Barbara Sullivan-Municipal Court Judge and Karen
.McBeth-city secretary.

OPEN MEETING
1. Invocation -The Honorable Rey Rosas
2. Recognitions/Oath of Office -Mayor Lloyd Woods. read a Certificate of Appreciation
for .Walter Jackson, long time city employee who recently passed away.
The .city secretary administered the Oath of Office to Irma Luna who was named to the
Parks Advisory Board.
3. Consent Calendar - Councilmember Dwain Dodson made a motion that all items on the
Consent Calendar be approved, except for Ordinance No. 96-3069, and his motion was
seconded by .Barbara. Dorman. The motion passed by unanimous consent.
a) .Minutes were approved.
b) Departmental Reports were accepted.
c) Expenditures were approved.
d) Board, Committee .and Commission Appointments: Plainview Housing
Authority. Kevin Walker was appointed to the Plainview Housing. Authority
Board of Directors and city secretary Karen McBeth administered his Oath

e) Budget Amendment -Parks -Golf Course. Ordinance No, 96-3069. An
Ordinance of the City of Plainview, Texas, amending Ordinance No. 9S-30S6,
the 1995-1996 Budget of the City of Plainview, as such: pertains to .Golf Course

' 4. Ethics. Consider. a proposal from Bruce Rider for a Code o£Ethics. Mayor Woods said
the Council Relations Committee Poli and the newl elected Ci Charter both addressed

Bruce Rider. thanked he Mayor and Council for .addressing. this important issue.
S. Housing: Resolution No, R96-116. A .Resolution of the City of Plainview, Texas,
authorizing the Mayor to enter into contracts with. EDM, Inc., and Finalaco Group for the
development of an affordable:.rental housing project. Barbara.Dorman moved'to table this
agenda item; Irene Favila seconded the motion. Alton Jackson Sr., Mary Virginia Kirchhoff,
Rey Rosas, Mike Hutcherson, Barbara Dorman, .Dwain Dodson and Irene Favila each. voted
' for the motion when asked. The motion carried. This item was tabled.
6. Plat -Westgate. Consider approval of the preliminary plat on the Westgate Subdivision,
Unit No. 4. Director of Public Works Ches Carthel reviewed the plat for proposed
development by Betenbough & Company. The plat covers 12 acres and. the Betenbough's
have requested .four variances regarding set back regulations and .the use of roll over curb
and gutter. The proposed development is in the Westgate Subdivision and covers
~ connecting .streets. Mr. Carthel recommended approval .subject to; Approval. by the Board

to drainage analysis approval. Dwain .Dodson made a motion to approve the plat subject
to the stipulations as recommended by Director of Public Works. Barbara Dorman
seconded the motion.. When polled by the city secretary the following Councilmembers
voted far the motion: Alton Jackson Sr., Mary Virginia Kirchhoff, Rey Rosas, .Mike.
Hutcherson, Barbara Dorman, Dwain Dodson and Irene Favila. The motion carried
unanimously.
7. Enterprise Project -Excel. Resolution. No. R96-117. A Resolution.- of the City of
Plainview, Texas, nominating Excel Corporation for Enterprise project designation. Grady
Elder, .Executive Director of the PlainviewJHale County Industrial Foundation spoke in
recommendation. of the resolution on behalf of the Industrial Foundation. Steve Mellinger,
General.Manager of Excel-Corporation, asked the.Council to approve the resolution for it
enhanced Excel's ability to compete fora millions of dollars in ..capital improvement money.
He said his company plans to expand each department aver the next five year period. It will
add.200 jobs to the. Plainview economy. Irene. Favila moved that Resolution No. R96-117
be approved.. Rey Rosas seconded the motion. Alton Jackson, Mary Virginia Kirchhoff, Rey
Rosas, Mike Hutcherson, Barbara Dorman, Dwain Dodson and Irene Favila. each voted for
the motion when asked by the city secretary. Resolution No. R96-117 passed unanimously.
8. Agenda. Action. Consider adoption of a policy guideline for agenda action. Following
a .short discussion, Dwain Dodson moved to table: this. item until after the May 4, 1996,

General Election and let the new Councilmembers address this issue. The motion died for
lack of a second. Barbara Dorman made. a motion the Agenda Action Policy be approved
.and Rey. Rosas seconded the motion. Alton Jackson, Mary Virginia Kirchhoff, Rey Rosas,
Mike Hutcherson, Barbara Dorman and Irene Favila voted in favor of the motion. Dwain
Dodson voted against. the motion. The motion passed. and the Agenda Action Policy
guideline was adopted.
9. West Texas .Environmental Alliance. Consider participation in the West Texas
Environmental Alliance. Mayor Lloyd Woods explained that over the past year and a half,
regional cities have met to combat some of the unfunded mandates which have proved so
costly to the West Texas area, particularly for Plainview regarding its wastewater treatment
.plant. The group has formally organized under the name of West Texas Environmental
Alliance and asks Council approval for. City support. Dwain Dodson moved to approve
participation. by the City of Plainview in the West Texas Environmental Alliance. Irene
Favila seconded the motion. The following Councilmembers voted in favor of the motion:.
Alton Jackson Sr., Mary Virginia Kirchhoff, Rey Rosas, Mike Hutcherson, Barbara Dorman,
Dwain Dodson .and .Irene Favila. The motion carried unanimously.
10. Community Development Block Grant. Resolution No. R96-118. A Resolution of the
City of Plainview, authorizing the submission of a Texas Community Development Program
application to the Texas Department of Housing and Community Affairs for the Community
Development Fund. John Castro, Director for Community Services, explained this resolution
authorized the City to apply for block .grant funds to help provide first time sewer service
along the east US70 corridor recently annexed and he asked that consideration of this item
be tabled. Dwain Dodson moved that consideration of Resolution No. R96-118 be tabled
and Barbara Dorman seconded the motion. Alton Jackson Sr., Mary Virginia Kirchhoff,
Rey Rosas, Mike Hutcherson, Barbara Dorman, Dwain Dodson. and Irene Favila all voted
in favor of the motion.
Mayor Lloyd Woods declared a short recess .and the Council continued after about four
minutes.
11. Election -May 4,1996 General Election. Ordinance No. 96-3067. An Ordinance calling
and setting the .date for the regular Municipal Election; Designating precincts/wards and
polling places for Precincts 5, 6 & 7; Designating the Election of a Councilmember for
Precincts 5, 6 & 7; Designating early ..voting .ballot board judge; Setting hourly .rate for
. election officials; And posting notice of election. Second and Final Reading.. Karen McBeth,
city .secretary, reviewed the Election Ordinance for the Council explaining that it was
required so as to hold the scheduled General Election on May 4, 1996. Barbara Dorman
moved that Ordinance No. 96-3067 be approved as presented and Mike Hutcherson
seconded the motion. Mary Virginia Kirchhoff, Rey Rosas, Mike Hutcherson, Barbara
Dorman, Dwain Dodson, Irene Favila and Alton Jackson Sr. voted in favor of the motion
and the ordinance was adopted by unanimous consent.
-'~ 12. Electrical Code: Amendment. Ordinance No. 96-3068. An Ordinance amending the
i City of Plainview Code of Ordinances, Chapter 10, Amending Section 10-41, 10-66, 10-82,
k ~ 10-83,10-121 and 10-131; Cumulativeness Clause; Conflicts Clause; Severability Clause; And

Effective Date. Second and Final. Reading. Dwain Dodson moved .that Ordinance No.
96-3068 be .approved... Rey Rosas seconded the motion. Rey Rosas, Mike Hutcherson,
Barbara Dorman, Dwain Dodson, .Irene. Favila, Alton Jackson Sr. and Mary Virginia ~W 4~
Kirchhoff voted unanimously in fav®r of the motion. Ordinance No 96-3068. was adopted.
13. Open Forum. Hear citizen requests per Open Forum policy. No.:one had asked to
speak on the Open Forum.

This .meeting is authorized by [TEX. GOV. CODE ANN. 551.071, Sec. 2(e)(Vernon
Ann.)].Barbara Dorman made a motion that no Closed. Meeting be held. Dwaine Dodson.:
seconded the motion.'When polled by the city secretary Mike Hutcherson, Barbara Dorman,
Dwain Dodson. and Irene Favila voted in favor of the motion. Alton Jackson Sr., Rey Rosas
and Irene Favila voted against the. motion. The motion. carried. four to three in favor.: No
Closed Meeting was held. ,
16. Litigation. Possible action taken per discussion in Closed Meeting. No action taken.
17. Adjournment. The Mayor adjourned .the meeting at 8:10 p.m.
