Plainview City Council
WORK SESSION
June 17, 1993
The City Council of the City of Plalnview, Texas, met in a Work Session at 11:30
a.m., Thursday, June 17, 1993, at the Plalnview Country Club, 2902 West 4th St.,
Plalnview, Texas. Mayor E. V. Ridlehuberpresided. Councilmemberspresent were
Alton Jackson - Precinct 1, Don Dickson - Precinct 3, Medlin Carpenter - Precinct
4, Barbara Dorman - Precinct 5, Dwain Dodson - Precinct 6, and Irene Favila -
Precinct 7. Absent was Mary Virginia Kirchhoff - Precinct 2.
Staff present were: Wally Hatch - City Attorney, Barbara Sullivan - Municipal Court
Judge, Roy L. Osborne - Director of Public Safety, Bruce Watson - Fire Chief,
Norman Huggins - Director of Finance, Carl Holland - Superintendent Support
Services, and Karen McBeth - City Secretary.
Media present: Richard Orr - Plalnview Dally Herald.
Guests present: Rollie Hyde, Graddy Tunnell and Keith Billington who came to voice
support for the FmHA projects.
Mayor Ridlehuber called the meeting to order at 11:35 a.m. The Council reviewed
the agenda for the upcoming meeting of June 22, 1993. The Council then heard
reports from City Attorney Wally Hatch~
Mr. Ridlehuber recognized Mr. Hyde, Mr. Tunnell and Mr. Billington and asked if
they wished to address the Council. Mr. Tunnell said he was there to offer their
support and help in whatever area they could toward getting the housing projects
approved by FmHA and seeing the housing built. The Council thanked each of the
gentlemen for their time and effort toward this end.
Southwest 3rd Street - Councilmembers Mary Virginia Kirchhoff and Dwaln Dodson
visited with Norman Dulaney regarding extending SW 3rd through his lot of salvage
autos. They also discussed additional right-of-way with Mr. Dulaney. Mr. Dulaney
agreed to negotiate with the Council regarding the additional 40 feet of right-of-way
needed for the street and Mr. Dulaney stated he would begin moving the old autos
and other paraphenalia from the area needed to cut a street. The Council expressed
no objections.
Insurance * Workers Compensation/Liability - Norman Huggins, Director of Finance,
reported to the Council that TPS rates are presently 18% below the general basis
schedule rate for the State of Texas and they will give an additional 10% off on the
Workers Compensation and liability policies. He reported they will give this same
discount on the property and casualty coverage. TPS indicated that the more
coverage we place with them (multi-line) we can get additional lower rates. The

Council did not object to leaving the coverage with TPS and to let Mr. Huggins get
a quote from TPS on the law enforcement liability, public officials liability and the
boiler and machinery coverage. Councilmember Dwain Dodson said he would like to
get bids from local insurance agents so as to be perceived as being fair.
Feedlot - City Attorney Wally Hatch reported he had visited with Mr. Armstrong by
telephone frequently in the past few days regarding the opening of the feedlot just
outside the city limits in the vicinity of 13th St., Juniper St. and on east to Winchell
St. Mr. Hatch stated that there are approximately 50 head of cattle in the feedlot at
the present time and that Mr. Armstrong said he would discuss moving only if the
city were to assist him in locating an alternate location and moving. Mr. Armstrong
stated that otherwise, he intends to stay where he is.
Mr. Huggins addressed the Council stating that at a recent seminar he attended he
became aware that a legal error in the handling of certain drug seizure funds needed
to be corrected. He felt the error was of significant importance that the Council
should be aware of it. He said that there was a Statute on the books requiring any
monies received from the seizure of drug funds and/or property to be included in the
General Funds of the city and disbursed only upon consent of the CRy Council. At
the present time these funds are being handled as they have in the past, that is
through the Police Department in a separate fund. Mr. Huggins stressed that he was
not complaining about anything the funds had been used for, nor was he insinuating
that the Police Department had in any way misapplied these funds, he was only
stating that as the Treasurer of the City of Plainview, he was legally liable for
seeing that these funds were handled according to State law, and he wanted the
Council aware of it. A lengthy discussion followed and Roy L. Osborne, Director of
Public Safety stated that he had been unaware of the legality of the situation and
that he was taking steps to remedy any errors which had occurred. The Council
thanked Mr. Huggins and Chief Osborne for bringing this to their attention and
appreciated the fact that the correction of any errors was being handled
expeditiously.
Mayor Ridlehuber declared the meeting adjourned at 2:00 p.m.
