HomeMy WebLinkAbout93 0810 minO073 MINUTES CITY COUNCIL MEETING August10,1993 The Plainview City Council met 7:30 p.m., Tuesday, August 10, 1993, in the Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session at 7:00 p.m. Mayor E. V. Ridlehuber presided. Councilmembers present were: Alton Jackson, Sr. - Precinct 1, Mary Virginia Kirchhoff - Precinct 2, Don Dickson - Precinct 3, Medlin Carpenter- Precinct 4, Dwain Dodson - Precinct 6, and Irene Favila - Precinct 7. Absent was Barbara Dorman - Precinct 5. Staff members present were: James P. Jeffers- City Manager, Terry Powers- Director of Human Resources, William R. Hogge - Director of Public Works, Muff London - Director of Community Development, Wally Hatch - City Attorney, Bruce A. Watson- Fire Chief, Barbara Sullivan - Municipal Court Judge and Karen McBeth - City Secretary. Guests present were: Debby Gibson - Main Street Coordinator, Roland Asebedo - Fire Marshall and John Castro - Director of Plainview/Hale County Health Department. Media present were: Richard Orr- Plainview Daily Herald and Channel 8 Television. OPEN MEETING 1. Invocation- Medlin Carpenter 2. Recognitions/Oath of Office - Director of Community Development Muff London introduced Debby Gibson who was hired as the Main Street Coordinator. Debby Gibson announced she would be profiled on Channel 11 (NBC) Television this coming Thursday night and felt this would be good publicity for Plainview. 3. Health Department - Consider authorizing the Mayor to execute Texas Department of Health Contract No. C400140, providing funding for services from September 1,1993 through August 31, 1994. John Castro, Director for Plainview/Hale County Health Department reviewed the proposed contract with the State of Texas for the 1993-94 Fiscal Year. He stated there were only minimal changes from the previous contract and he did not foresee any problems with it. He reported that funding will be done on how well they meet their objectives and he had high expectations of meeting all of their objectives. Dwain Dodson made a motion the Mayor be authorized to execute the Texas Department of Health Contract No. C400140; Uedlin Carpenter seconded the motion; the motion passed unanimously among the six council members present. 4. EMS - Rates - Ordinance No. 93-2964. Ordinance No. 93-2964. An Ordinance of the City of Plainview, Texas amending Chapter Four, "Ambulances" of the Code of Ordinances of the City of Plainview, Texas, regarding ambulance rates; severability clause; Cumulativeness clause; Conflicts clause; Effective date; And publication clause. Fire Chief Bruce A. Watson reviewed the proposed ordinance stating that he had researched many cities in the area and comparable sized cities as to their ambulance rates and discovered that Plainview's rates were much lower than the others. He reviewed all the different schedules rates, what these rates covered and what he proposed the rates should be. He stated that all of the rates are within the Medicare/Medicaid allowable charges. Don Dickson made a motion that Ordinance No. 93- 2964 be approved as presented; Dwain Dodson seconded the motion; the motion passed unanimously among 0074 the six council members present. 5. Budget - Consider establishing a timetable for adopting the 1993/1994 Fiscal Year Budget for the City of Plainview. Mayor Ridlehuber gave the following timetable for adoption of the 1993-1994 budget: August 8- Published effective tax rate, August 24- City Council to call for public hearings on the budget for September 14 and September 28, August 26 - Publish legal notice of budget public hearings, September 14 - (a) Public Hearing on proposed budget, (b) First reading of Ordinance to adopt budget, (c) First reading of Ordinance to set tax levy, September 28 - (a) Public Hearing on proPosed budget, (b) Pass ordinance setting tax levy, (c) Pass ordinance adopting 1993-1994 budget, September 30- Newspaper publication of "Notice of Availability of Budget." Don Dickson moved this timetable be accepted; Medlin Carpenter seconded the motion; the motion carried unanimously among the six counci members present. 6. Fire - Personnel - Appointment of Assistant Fire Chief/Fire Marshall by Bruce A. Watson, Fire Chief. Dwain Dodson made a motion this item be tabled for further study; Alton Jackson, Sr. seconded the motion; Irene Favila, Dwain Dodson, Mary Virginia Kirchhoff and Alton Jackson voted for the motion; Medlin Carpenter and Don Dickson voted against the motion; the motion carried 4 to 2. 7. Fire Department - Civil Service - Ordinance No. 93-2965 - An Ordinance of the City of Plainview, Texas, providing for the amendment of Ordinance No. 91-2885 to eliminate the position of Fire Marshall; providing for an increase in the number of personnel in the Firefighter classification; Severability clause; Cumulativeness clause; Conflicts clause; Publication Clause; And effective date. Dwain Dodson made a motion Ordinance No. 93-2965 be tabled for further study; Irene Favila seconded the motion; Irene Favila, Dwain Dodson, Mary Virginia Kirchhoff and Alton Jackson voted for the motion; Medlin Carpenter voted against it; Don Dickson abstained from voting. The motion passed 4 to 1, with one abstention. 8. Consent Calendar- Alton Jackson moved the Consent Calendar be approved as presented; Dwain Dodson seconded the motion; the motion carried unanimously among the six councilmembers present. a) Minutes b) Departmental Reports c) Expenditures d) Boards, Commissions and Committee Appointments. Fire and Building Code Board of Appeals and Canadian River Municipal Water Authority Board. Norman O. Wright was reappointed to the Canadian River Municipal Water Authority Board. e) Speed Zone - Ordinance ,No. 93-2966 - An Ordinance of the City of Plainview, Texas, amending Section 23-168 of the Code of Ordinances with regard to the maximum rate of speed for vehicles traveling eastbound on Fifth Street (U.S. 70) to correct typographical error in Ordinance No. 93-2958; Providing for a penalty; Cumulativeness clause; Conflicts clause; Severability Clause; And effective date. This ordinance was approved and adopted. 9. Executive Session: Discussion of pending or contemplated litigation (Santa Fe Railroad - 16th St. crossing and B.E. Rice Construction Co., Inc.)
