CITY COUNCIL MEETING
City of Plainview
December 14, 1993
The City Council of the City of Plainview, Texas, met in a regularly scheduled meeting at
City Hall, 901 Broadway, Plainview, Texas, at 7:30 p.m. on December 14, 1993, with
Mayor E. V. Ridlehuber presiding. Councilmembers present were: Alton Jackson Sr. -
Precinct 1, Mary Virginia Kirchhoff-Precinct 2, Don Dickson - Precinct 3, Mike Hutcherson
Precinct 4, Dwain Dodson - Precinct 6, and Irene Favila - Precinct 7. Absent was
Barbara Dorman - Precinct 5.
Staff present were: James P. Jeffers - City Manager, Roy L. Osborne - Director of Public
Safety, Bill Hogge - Director of Public Works, Wally Hatch - City Attorney, Norman
Huggins - Director of Finance, Muff London - Director for Community Development, and
Karen McBeth - City Secretary.
Media present: Richard Orr - Plainview Daily Herald.
Guests present: Tom Gooch and John Seifert of Houston, Texas, and John C. Williams
of Canadian River Municipal Water Authority.
Open Meeting:
1. Invocation - Don Dickson
2. Recognitions - Muff London, Director for Community Development, introduced a
big as life blue dinosaur, temporarily named Trash-a-Sarus which will be used in the
schools to introduce and educate young people to recycling and beautification programs
championed by the City of Plainview. Debra Chandler, who wears the costume, goes to
the schools and teaches children that recycling and keeping the city beautiful is part of
learning to be responsible. Muff London and the Council commended Ms. Chandler for
her work and thanked her for her efforts.
3. Zone Case No. 615 * 410 & 412 W. 9th Street - Ordinance No. 93-2982. Request
of the City of Plainview and Rickey Davis for rezoning of Lots 7 and 8, and the South 9
feet of lot 9, Block 64, of the Alexander-Westmoreland Addition [410 and 412 W. 9th
Street] from MF-1 [Multi-family] District to a Commercial - 2 [Light retail and Commercial]
District. Director for Community Development Muff London reviewed the case, showing
slides depicting the area in question. She reported the Planning and Zoning Commission
had approved this case and since this property had essentially been an antique shop for

more than twenty years this was really the zoning needed for this piece of property.
Dwain Dodson moved to open a public hearing; Mary Virginia Kirchhoff seconded the
motion; the motion passed unanimously among the six councilmembers present. Mayor
Ridlehuber asked for those speaking for the change in zoning to come forward to speak;
no one came. The Mayor then aske,,d those speaking against the zone changed to come
forward; no one came. Don Dick,;on moved the public hearing close; Dwain Dodson
seconded the motion; the motion passed unanimously. Mayor Ridlehuber declared the
public hearing closed. Dwain Dodson made a motion Zone Case 615, as outlined in
Ordinance No. 93-2982, be approved as presented; Don Dickson seconded the motion;
the motion passed with six voting for the ordinance and one council member absent.
4. Water Study Report * Tom Gooch, of Freese and Nichols, Inc. - Tom Gooch,
Project Manager for the water supply and treatment study done by Freese and Nichols,
Inc. reported on the $140,000 study. He noted that a grant from the Texas Water
Commission supplied $60,000 of the study. The study documented the present and
projected future needs for ground water for the City of Plainview and the surrounding
area. John Seifert showed diagrams and topographical maps of the Ogalalla Aquifer from
which Plainview pumps its underground water. He presented the rate of water level
decline in the area since 1930. City well levels have been dropping continually since that
time. Plainview has fifteen wells and at the present time they are performing adequately.
Mr. Gooch continued his report and advised the city to obtain as much water as allowed
through the Canadian River Municipal Water Authority to be mixed with local groundwater
for the city's use. The Mayor thanked Mr. Gooch and Mr. Seifert for their report.
5. Consent Calendar - Mary Virginia Kirchhoff moved the consent calendar be
approved as presented below; Alton Jackson Sr. seconded the motion; the motion carried
unanimously among the six councilmembers present.

Expenditures were approved.

Bids were awarded as follows:
2 Mid-size 1/2 ton pickups bid was awarded to Jack Morris Ford in the
amount of $9,793.85 each. Bids from McGavock Motors for $11,212.96
each, Hendrix GMC for $10,060.00 each, and Gardner Chevrolet for
$10,805.00 were rejected.
I full size 3/4 ton cargo van was awarded to Gardner Chevrolet in the
amount of $14,130.00. Jack Morris Ford submitted a bid for $13,618.50;
McGavock Motors submitted a bid of $16,292.45; and Hendrix GMC
submitted a bid for $13,852.00. Although Gardner Chevrolet's bid was not

the lowest, but it met the specifications most advantageous to the City of
Plainview.
Fire Vehicle - 1 Full size 3/4 ton pickup cab & chassis - Tabled for futher
study.

Police - Environmental Officer Grant Application. Resolution No. R93-
121. A Resolution of the City Council of the City of Plainview, Texas
authorizing the city to pursue a 50/50 matching grant to continue funding of
the environmental control officer position within the City for an additional one
year period. Resolution passed.

Plat Preliminary * Farmer's Place. A Resolution of the City of Plainview,
Texas, approving the preliminary plat of Farmer's Place, Plainview, Hale
County, Texas. Plat was approved.
g)
Final Plat * Kruse Subdivision. A resolution of the City of Plainview,
Texas, approving the final plat of Kruse Subdivision, Unit No. 1, out of Block
1, Alabama Addition, Plainview, Hale County, Texas. Plat was approved.
h)
Confidentiality * Utility Records. Consider approving a request for
confidentiality form and not charging for maintaining customer requests for
confidentiality of their utility records. Form and no charge was
approved.
National Association of Towns and Townships. Consider application for
membership. One year membership was approved, with no one authorized
to attend meetings without Council authorization.
Toll Free Calling. Consider authorizing City Administration to promote toll
free calling to Plainview from area communities and to provide assistance
to those communities if requested. Administration was so authorized.

Chamber of Commerce Tourism and Conventions Football Playoffs.
Consider authorizing the Director of Public Safety to provide up to two police
officers and one staffed EMS unit at the City's expense as an inducement
for future football playoff games for Plainview. Director of Public Safety was
so authorized.
Executive SeSsion - was not held.
Streets - 16th Street Railroad Crossing - No action taken.

8. Texas Political SUbdivision. Class Action: BankrUptcy Claim Against national
Gypsum Company .Proposed Class Action Against Other Manufacturers. Dwain
Dodson made a motion that the City Attorney be authorized to take action within the
parameters established in the Pre-Session; Don Dickson seconded the motion; the motion
carried unanimously among the six councilmembers present.
9. Adjournment Dwain Dodson made a motion the meeting
Hutcherson seconded the motion; the motion carried unanimously.
