MINUTES
The Plainview City Council met in Regular Session on Tuesday,
January 22, 1991, in the Counoil Chambers of City Hall at 7:30
p.m. with Mayor E. V. Ridlehuber presiding. Councilmembers
present were: Alton Jackson - Precinct 1; Mary Virginia Kirchhoff
- Precinct 2; Don Dickson - Precinct 3; Medlin Carpenter -
Precinct 4; Barbara Dorman - Precinct 5; Dwain Dodson - Precinct
6; and Ross Owen - Precinct 7.
Staff Present: James P. Jeffers, City Manager; David Blackburn,
City Attorney; Bill Hogge, Director of Public Works; Norman
Huggins, Director of Finance; Roy Osborne, Director of Public
Safety; Diane Groh, Director for Community Services and Linda
Huddleston, City Secretary.
News Media Present: Richard Orr - Plainview Daily Herald; John
Rigg - Lubbock Avalanche Journal; Randy Ballinger - KKYN; Wes
Naron - KVOP; and Ridley Gibson - Plainview Cable TV.
OPEN MEETING
An Open Meeting was held concerning the following subjects:
1) Invocation (Mayor Ridlehuber)
2) Sewer - Rate Adjustment. Ordinance No. 90-2853. An Ordinance
of the City of Plainview, Texas, amending Section 24-45, Article
II, Chapter 24 of the Plainview City Code; setting the rates to be
charged for the sewer service and the sewer disposal service; and
repealing all ordinances in conflict herewith; and establishing an
effective date. Mayor Ridlehuber established that this ordinance
had been addressed at a public hearing at the last City Council
meeting on Tuesday, January 8, 1991. Councilmember Ross Owen
asked that Norman Huggins, Director of Finance, give a brief
review of the proposed sewer rate adjustment that was presented at
the City Council meeting on January 8, 1991. Mr. Huggins stated
that effective 4/1/91 the sewer rates would increase from $5.30
per month to $6.00 per month and the 34 cents per 1,000 gallons
would increase to 44 cents per 1,000 gallons with a cap of 20,000
gallons for residential customers. Mayor Ridlehuber asked for any
additional presentations and/or comments. Hearing none, a motion
was made by Councilmember Medlin Carpenter to adopt Ordinance No.
90-2853. The motion was duly seconded by Councilmember ~wain
Dodson and carried by a unanimous vote.
3) Water - Rate Adjustment. Ordinance No. 90-2854. An Ordinance
of the City of PlainvieW, Texas, amending Section 24-44, Article
II, Chapter 24 of the Plainview City Code; setting the rates to be
charged for the water service; repealing all ordiD~nces in

conflict herewith; and establishing an effective date. Mayor
Ridlehuber established that this ordinance had been addressed at a
public hearing at the City Council meeting held on January 8,
1991. Councilmember Barbara Dorman asked that Norman Huggins,
Director of Finance, give a brief review of the proposed water
rate adjustment that was presented at the City Council meeting on
January 8, 1991. Mr. Huggins stated that effective 4/1/91, the
monthly water rate would continue to be $8.25 per month, but would
not include the 3,000 "free" gallons that are currently included
in the monthly base rate of $8.25 per'month. There will be a
monthly charge of 90 cents for each 1,000 gallons of water used in
addition to the base rate of $8.25. Mr. Huggins stated that a
penalty of 10 percent of the total bill would be assessed on all
bills not paid before 5:00 p.m. on the 12th day. Past due notices
will be sent out and service will be discontinued if not paid by
5:00 p.m. on the 20th day. Mayor Ridlehuber asked if anyone
present had any additional presentations and/or comments. Hearing
none, a motion was made by Councilmember Barbara Dorman to adopt
Ordinance No. 90-2854. The motion was duly seconded by
Councilmember Ross Owen and carried by a unanimous vote.
4) Zone Change - Central Business District. Ordinance No.
90-2850. An Ordinance Amending Zoning Ordinance No. 89-2798
entitled "The City of Plainview Zoning Ordinance: more
specifically Section 8:1 "Schedule of Uses .Established" Subpart
',Manufacturing, Storage and Warehousing Uses: amending Section
9:6:8, self-storage, mini-warehouse, to exclude hazardous
materials; and establishing an effective date. Mayor Ridlehuber
established that this ordinance had been presented at a public
hearing at the City Council meeting on January 8, 1991. The Mayor
asked if anyone present had any -additional comments. Hearing
none, a motion was made by Councilmember Barbara Dorman to adopt
Ordinance No. 2850. The motion was duly seconded by Councilmember
Dwain Dodsonand carried by a unanimous vote.
5) Zone Case No. 569 - Specific Use Permit. Ordinance No.
90-2851. An Ordinance Amending Zoning Ordinance No. 89-2798 and
the official zoning map of the City of Plainview so as to make the
following changes: Request of J. W. Hamby for a Specific Use
Permit to operate a self-storage, mini-warehouse facility in a CB
(Central. Business District) Zoning District on Lots 11 through. 16,
Block 23, Original Town Addition and located at 314 Broadway.
Mayor Ridlehuber established that this ordinance had been
presented at a public hearing at the City Council meeting on
January 8, 1991. The Mayor asked if anyone present had any
additional comments. Hearing none, a motion was made by
Councilmember Ross Owen to adopt Ordinance No. 2851. The motion
was duly seconded by Councilmember Dwain Dodson and carried by a
unanimous vote.

Mayor E. V. Ridlehuber introduced the following Consent Calendar
for approval:
ALL MATTERS UNDER ITEM 6 CONSENT CALESTDAR ARE CONSIDERED TO BE
ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION IN THE
FORM LISTED BELOW, THERE WILL BE NO SEPARATE DISCUSSION ON THESE
ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE. CLARIFICATION.
ON OBJECTION BY ANY PARTY TO THE INCLUSION OF ANY ITEM ON THE
CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT
CALENDAR. SUCH OBJECTION MAY BE RECORDED ANY' TIME PRIOR TO THE
TAKING OF A VOTE ON THE MOTION TO APPROVE THE CONSENT CALENDAR.
ALL SUCH ITEMS SHALL BE CONSIDERED INDIVIDUALLY IN THE ORDER IN
WHICH THEY ARE OBJECTED TO, IMMEDIATELY FOLLOWING THE
CONSIDERATION OF THE CONSENT CALENDAR.
6) CONSENT CALENDAR

c) Budget Expenditures
d) Alley Closure. Resolution No. R90-202. A resolution of
the City of Plainview, Texas, taking action on the request of
First Baptist Church for closing an alley located at Block 44,
Original Town of Plainview, Hale County, TeXas. (Tabled from
meeting of December 11, 1990 and meeting of January 8, 1991.)
This resolution was tabled at the two previous City Council
meetings due to the lack of all requested information not being
submitted. A motion was made by Councilmember Ross Owen to remove
this item from the consent calendar. Motion was duly seconded by
Councilmember Barbara Dorman and carried a unanimous vote.
e) Boards and Co~R~ssions - Appointments. Resolution No.
R90-210. A resolution of the City of Plainview, Texas making
various appointments and re-appointments to the Boards and
Commissions of the City of Plainview, Texas.
Motion was made by Councilmember Barbara Dorman to adopt the
Consent Calendar as stated. Motion was duly seconded by
Councilmember Ross Owen and carried by a unanimous vote.
Adjournment - Motion as may by Councilmember Ross Owen to adjourn.
Motion was duly seconded by Councilmember Barbara Dorman and
carried by a unanimous vote. There being no further business,
Mayor E. V. Ridlehuber adjourned the meeting at 7:50 p.m.
