CITY COUNCIL MEETING
May 23, 1991
MINUTES
The Plainview City Council met on Thursday, May 23, 1991, at 11:30 a.m., at
the Plainview Country Club with Mayor E. V. Ridlehuber presiding.
Councilmembers present were: Mary Virginia Kirchhoff Precinct 2; Medlin
Carpenter - Precinct 4; Barbara Dorman - Precinct 5; Dwain Dodson -
Precinct 6; and Ross Owen - Precinct 7. Councilmembers absent: Alton
Jackson - Precinct 1.
Staff Present: James P. Jeffers, City Manager; Bill Hogge, Director of
Public Works; Norman Huggins, Director of Finance; Roy Osborne, Director of
Public Safety; Diane Groh, Director for Community Services and l.lnda
Huddleston, City Secretary.
News Media Present: Richard Orr - Plainview DaVy Herald and Scott
Fitzgerald - Lubbock Avalanche Journal.
The City Council reviewed the following agenda items for the upcoming
meeting on May 28, 1991:
NOTICE
CITY COUNCIL MEETING
This notice is posted pursuant to the Texas Open Meetings Act. (TEX. REV.
CIV. STAT. ANN. art. 6252-17 (Vernon Supp. 1990).)
The Plainview City Council will hold a meeting at 7:30 p.m., Tuesday, May
28, 1991, in the Council Chambers of the Plainview City Hall at 901
Broadway. The Council will meet in Pre-Session at 6:30 p.m.
OPEN MEETING
An Open Meeting will be held concerning the following subjects:
1) Invocation (Ross Owen)
2) Oath of Office - Various Boards and Commissions of the City.
3)
Zone Case No. 574 - Specific Use Permit - Rest Homes or
Homes. Ordinance No~ 91-2866. An Ordinance amending Zoning
Ordinance No. 89-2798 "The City of Plainview Zoning Ordinance";
more specifically amending Section 8:1 "Schedule of Uses Established",
to allow Rest Homes or Nursing Homes in an R-1 (Single-Family
Residential District) with a Specific Use Permit, and establishing an
effective date.

4) Public Hearing
a)
Cm. nival. Request of Joe Walker on behalf of the Plainview
Jaycees for a Specific Use Permit on Lots 3-13, WeStridge
Addition, Unit 6, for the purpose of operating a carnival in a
C-3 Zoning District located at 4405 Olton Road.
b)
Mesa Ve~-de. Request of City of Plainview for rezoning of Lot 1,
Mesa Verde, Unit 1, from a Specific Use Permit to a C-3 Zoning
District located at 1001 North 1-27.
c)
C. ax-nival. Request of Joe Walker on beb~tf of the Plainview
Jaycees for a Specific Use Permit on Lot 1, Mesa Verde, Unit 1,
for the purpose of operating a carnival in a C-3 Zoning District
and located at 1001 North 1-27.

EMS Fmmehise - PtAinview Ambulance Sea-vice. Ordinance No. 91-2868.
An ordinance amending Ordinance No. 88-2750, granting a franchise
to Plainview Ambulance Service; allowing the franchise 88-2750 to
be considered for renewal annually.
6) Cable TV - Review of rate adjustment and program changes.
ALL MATTERS UNDER ITEM 7 CONSENT CALENDAR ARE CONSIDERED TO
BE ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION
IN THE FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION
ON THESE ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE
CLARIFICATION. ON OBJECTION BY ANY PARTY TO THE INCLUSION OF
ANY ITEM ON THE CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED
FROM THE CONSENT CALENDAR. SUCH OBJECTION MAY BE RECORDED
ANY TIME PRIOR TO THE TAKING OF A VOTE ON THE MOTION TO
APPROVE THE CONSENT CALENDAR. ALL SUCH ITEMS SHALL BE
CONSIDERED INDIVIDUALLY IN THE ORDER IN WHICH THEY ARE OBJECTED
TO, IMMEDIATELY FOLLOWING THE CONSIDERATION OF THE CONSENT

Housing Authority - RTC. Resolution No. R91-116. A
resolution of the City of Plainview, Texas, endorsing the
Plainview Housing Authority's application for acquisition of two
properties to be used for lower income households, currently
controlled by the Resolution Trust Corporation.
Sanitation - Rate Adjustment. Ordinance No. 91-2869. An
ordinance of the City of Plainview, Texas, amending Section
24-47 entitled "Refuse Collection Fee; Water Termination" of the
Code of Ordinances of the City of Plainview, Texas.
Loading Zone. Consideration of a request from Jack Oswald to
alter the loading zone in the 100 block of West 6th Street.

Street Closu~. Consideration of Gerald Autry, as the
Independent Executor of the Estate of Lorsne Autry, Petition and
Ortl{nAuee for Closing of A St~met located at: BEGINNING at the
Northwest corner of Survey 57, Block A-l, Hale County, Texa~
(which is also the N.E. corner of Section 58, Block A-i, Hale
County, Texas); THENCE South 1752.8 feet along the West line of
Survey 57, Block A-l, to the intersection of the Northeasterly
right-of-way line of South Interstate Highway No. 27.

The Council turned to the agenda for today's meeting.
Water Billing Proeedu~e~ - Norman Hugging, Director of Finance, outlined for
the Council two options for consideration at the regular Council meeting on
Tuesday. The current billing system which became effective April 1, 1991,
has created numerous customer complaints, due mainly to the harsh wording
of the second notice bill. The current policy gives customers 14 days to pay
their bill without a penalty and 22 days before service is disconnected. The
first option Huggins presented to the Council would give customers 21 days to
pay their bill with no penalty and service would not be disconnected until the
29th day. The second option provides the same 21 day period to pay b]ll~
prior to penalty, but also adds an additional 11 days to the disconnect
period.
Zoning - ?§ Pez~ent Rule - Diane Groh, Director for Community Services,
review with the Council the current City code on adopting amendments which
the Planning and Zoning Commi.~sion have recommended against. Groh stated
that a three fourths vote of all Councilmembers is needed to override the
Planning and Zoning Commission, but is a local requirement and may be
changed.
Prison - State Fadlities - Jim Jeffers, City Manager, advised the Council that
the Plainview/Hale County Industrial Foundation would decide at their next
meeting ff they will pursue considering the Plainview/Hale County area as a
site for a state prison.
Boards, Co, nmi~aions and Co, m, fittee AlxPain~ - Jim Jeffers, City
Manager, reminded Council of the continued need for Boards, Commissions
and Committee applicants. Jeffers stated that the Charter Study Committee
has only 5 applications on file.
Health l)~~nt - Pe~onnel Po~ - Jim Jeffers, City Manager,
reminded Council of Health Department personnel policy concerns that were
discussed at a previous work session. Jeffers stated that there is continued
confusion as to whether the Health Department came under City or County
personnel policies which has created ongoing conflicts for over a year.
Jeffers stated that he, Councilmember Don Dickson and Mayor Ridlehuber are
pushing for a quick resolution to ending the conflict and avoid additional
conflict by placing the Health Department under City personnel policies with
the exception of the Health Director. According to Jeffers, James Belk has
no problem with the Health Department functioring under City personnel
policies.

Sanitation - Reey-.ling - Jim Jeffers, City Manager, advised the Council that
the Recycling Committee met on May 21, 1991. In attendance were Jim
Jeffers, Terri Allen, Carla Edwards, Joe Walker, Rick Graves and Tomagene
Stockley. The committee will attempt to recruit individuals from Wayland, the
news media, cable, citizens and the schools. Goals are to identify, develop
and maintain markets, with emphasis on waste reduction to begin with.
Recycling is a part of economic development. The committee will be making
recommendations to the Mayor and City Council. The next meeting will be on
June 11, at Daffern Steel and then at TLI.
Iuan~ - Bill Hogge, Director of Public Works, updated the Council on the
progress, or lack of, in permitting the landfill. Harem will be meeting with
the Texas Health Department on Tuesday on behalf of the City of Plainview.
Fl-iseo;Mol{no P~eet (16th Stl-eet) - Jim Jeffers, City Manager, advised the
Council that there was nothing new to report on this project.
There being no further business,' Mayor E. V. Ridlehuber adjourned the
meeting at 1: 00 p.m.
