MINUTES
The Plainview City Council met in Regular Session on Tuesday, June 11,
1991, in the Council Chambers of City Hall at 7:30 p.m. with Mayor E. V.
Ridlehuber presiding. Councilmembers present were: Alton Jackson -
precinct 1; Mary Virginia Kirchhoff - Precinct 2; Don Dickson - Precinct 3;
Medlin Carpenter Precinct 4; Barbara Dorman Precinct 5; Dwain Dodson
- Precinct 6; and Ross Owen - Precinct 7.
Staff Present: James P. Jeffers, City Manager; Bill Hogge, Director of
Public Works; Terry Powers, Director of Human Resources; Roy Osborne,
Director of Public Safety; Diane Groh, Director for Community Services; and
Linda Huddleston, City Secreta~.
News Media Present: Richard Orr Plainview Daily Herald; Scott Fitzgerald

OPEN MEETING
An Open Meeting was held concerning the following subjects:
1) Mayor E. V. Ridlehuber delivered the invocation

Zone Case No. 571 - Specific Use Pm-mit - Carnival. Ordinance No.
91-2863. An ordinance amending zoning ordinance No. 89-2798 and the
official zoning map of the City of Plainview so as to make the following
change. Request of Joe Walker on behalf of the Plainview Jaycees for a
Specific Use Permit on Lots 3-13, Westridge Addition, Unit 6, for the
purpose of operating a carnival in a C-3 Zoning District located at 4405
Olton Road. Mayor Ridiehuber established that a public hearing was
held on this item at the May 28, 1991 City Council meeting. Hearing no
further comments or questions, a motion was made by Councilmember
Barbara Dorman to adopt Ordinance No. 91-2863. The motion was duly
seconded by Councilmember Dwain Dodson and carried by a unanimous
vote.

Zone Case No. §?2 - Mesa Verde. Ordinance No. 91-2864. An
ordinance amending zoning ordinance no. 89-2798 and the official zoning
map of the City of Plainview so as to make the following change.
Request of City of Plainview for rezoning of Lots 1, 2, 3, 4, 5 and 7,
Mesa Verde, Unit 1, from a Specific Use Permit to a C-3 Zoning District
located at 1001 North 1-27. Mayor Ridlehuber established that a public
hearing was held on this item at the May 28, 1991 City Council meeting.
Hearing no further comments or questions, a motion was made by
Councilmember Dwain Dodson to adopt Ordinance No. 91-2864. The
motion was duly seconded by Councilmember Ross Owen and carried by
a unanimous vote.

Zone Case No. 573 - Specific Use Permit - Catmival. Ordinance No.
91-2865. An ordinance amending zoning ordinance no. 89-2798 and the
official zoning map of the City of Plain-view so as to make the following
change. Request of Joe Walker on behalf of the Plainview Jaycees for a
Specific Use Permit on Lot 1, Mesa Verde, Unit 1, for the purpose of
operating a carnival in a C-3 Zoning District and located at 1001 North
1-27. Mayor Ridlehuber established that a public hearing was held on
this item at the May 28, 1991 City Council meeting. Hearing no further
comments or questions, a motion was made by Counci]member Medlin
Carpenter to adopt Ordinance No. 91-2865. The motion was duly
seconded by Councilmember Alton Jackson and carried by a unanimous
vote.
Mayor E. V. Ridlehuber introduced the following consent calendar for
approval:

a nonprofit organization, with the proceeds going back to the
community, the filing fees for zone cases 571 and 573 are waived.

Bids - (3) pickup service bodies - (1) contractors dump bed and
hoist - (1) 30 yard "side load" refuse packer body.
Sanitation department bids were received for a 14 foot contractors
body from Harmon Tank Co. of Lubbock -- $4,989.: and American
Equipment and Trailer of Lubbock -- $5,830: with the bid being
awarded to Harmon Tank Co.

Sanitation department bids were received for a refuse packer body
from EMCO Industries of Plainview for $29,867 with an optional
container spraying device for $1,250. The bid is awarded to
EMCO.
For departments 25 and 40 a low profile service body for 3/4 ton
cab and chassis: Bid from Harmon Tank Co. of Lubbock for
department 40 $2,277 and department 25 $2,546: Bid from
American Equipment and Trailer for $2,227. Bid is awarded to
Harmon Tank Co.
For department 39 one ultra-low profile service body for 3/4 ton
cab and chassis. Bid from Harmon Tank Co. of Lubbock for
$2,263: Bid from American Equipment and Trailer for $2,627. Bid
is awarded to Harmon Tank Co.
For department 25 and 40 an optional flip top for low profile unit.
Bid from Harmon Tank Co. of Lubbock for $269: Bid from
American Equipment and Trailer for $404. Bid is awarded to
Harmon Tank Co.

Zoning 75 percent rule'. Consideration of authorization of
amendment to zoning ordinance deleting local requirements
regarding the "75 percent rule" in the City's zoning ordinance.
City staff is authOrized to prepare an application for an amendment
to the zoning ordinance deleting the local 75% rule override
requirement.

Peddlers and Solicitors Ordinance. Ordinance No. 91-2870. An
ordinance of the City of Plainview, Texas amending the Plainview
City code, Chapter 7, Article VI entitled "Peddlers, itinerate
vendors, and solicitors."
j)
TDOC - Housing Rehabilitation. Resolution No. R91-117. A
resolution of the City of Plainview, Texas, authorizing the
following officers of the City of Plain~iew to enter into an
agreement with the Texas Department of Community Development
Program and the authorizing of certain offices as authorized
signatures on legal documents pertaining to the City's
participation in the Community Development Program.

Board of Adjustment - Consideration of Appointment.

A motion was made by Councilmember Dwain Dodson to approve the consent
calendar with the removal of item g) for clarification. The motion was duly
seconded by Councilmember Alton Jackson and carried by a unanimous vote.
g)
Budget Amendment - Parks. Ordinance No. 91-2871. An
ordinance of the City of Plainview, Texas, amending the 1990-91
Parks Department budget.- After clarification of questions and
concerns pertaining to item g), a motion was made by
Councilmember Don Dickson to adopt Ordinance No. 91-2871. The
motion was duly seconded by Counciimember Dwain Dodson and
carried by a unanimous vote.

Adjournment - A motion was made by Councilmember Ross Owen to
adjourn the meeting.~ The motion was duly seconded by Councilmember
Don Dickson and ca, tied by a unanimous vote. There being no further
business, Mayor E. V. Ridlehuber adjourned the meeting at 8:00 p.m.
