Plainview City Council
January 23, 1992
The City Council of Plainview, Texas met in a Work Session on Thursday,
January 9, 1992, at 11:30 a.m. at the Plainview Country Club, with Mayor
E.V. Ridlehuber presiding.. Councilmembers present were: Alton Jackson -
Precinct 1; Mary Virginia Kirckhoff - Precinct 2; Don Dickson - Precinct 3;
Medlin Carpenter - Precinct 4; Dwain Dodson - Precinct 6; and Ross Owen -.
Precinct 7. Absent was Barbara Dorman ' Precinct 5.
Staff Present: James P. Jeffers - City Manager; Diane Groh - Director for
Community Services; Roy Osborne - Director of Public Safety; Bill Hogge -
Director of Public Works; Norman Huggins Director of Finance; Terry
Powers - Director of Human Resources; Wally Hatch - City Attorney; and
Karen McBeth -City SeCretary.
Guests Present: Jim Mock, David Wilder, Terry Teague, and Jim Ferreil.
Media Present: Richard Orr, Plainview Daily Herald.
Mayor Ridlehuber called the meeting to order. The City Council reviewed the
following agenda items for the upcoming meeting of January 28, 1992.
OPEN MEETING
An Open Meeting will be held concerning the following subjects:
1. Invocation - M~ary Virginia Kirchhoff
Oath of Office - Boards, Committees and Commissions.
Redistr/cting - Consideration of adoption of a redistricting plan.

Hotel/Motel. Tax - Pl~inview Muniaipal Count~ny Club. Soliciting public
comment; and consideration of action on a request for use of Ho.tel/Motel
Tax reserve funds for the remodeling of the Plainview Municipal
Country Club so as to better accommodate conventions.
Plainview Highe~ Education Facilities Co~-~don. Ordinance No.
92-2898. An ordinance by the City Council of Plainview, Te~a.~,
requesting, ordering, approving and authorizing the creation of the
"Plainview Higher Education Facilities Corporation" to act for, and on
behalf of the City pursuant to and in accordance with the provisions of
Section 53.35(b) of the Texas Education Code, as amended; approving
the articles of incorporation for. its creation and initial bylaws governing
its affairs; appointing the initial board of directors therefor; and
making certain findings, recitals; and prowsxons in regard to said
corporation and matters incident and related to its establishment,
operations, and affairs.
Park~ - Duck Pond. Consideration 'of a proposal to develop the "Duck
Pond" located near the intersection of E~ni~ and 10th Street, as a City
Park.

Fire - Key Rate. A report on the status of the City of Plainview
challenge to the State Board of Insurance Key Rate determination.
Police - Personnel Fringe Benefits. Ordinance No. 92-2899. An
Ordinance of the City Council of Plainview, Texas, establishing certain
fringe benefits for the City of Plainview Police Department.

BE ROUTINE BY THE CITY COUNCIL AND WU,L BE ENACTED ON A MOTION
IN THE FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION

CLARIFICATION. ON OBJECTION BY ANY PARTY TO THE INCLUSION OF

An Ordinance of the City of Plalnview, Texas, amending Chapter 24,
"Utilities" of the Code of Ordinances of the City of Plainview, Texas, to
add a provision for State and Federal Prison Rates; Severability clause;
Cumulativeness clause; Conflict clause; and effective date.
f) Ambulance Rates - Ordinance No. 92-2896. An Ordinance of the
City of Plalnview, Texas, amending Chapter 4, "Ambulances" of the
Code of Ordinances of the City of Plalnview, Texa~, establishing rates
for ambulance service to a proposed State or Federal prison; Providing
a severability clause; Providing a c~mulativeness clause; Providing a
conflict clause; and providing for an effective date.
g) Budget Amendn~ut - Ordinance No. 92-2900. An Ordinance of the
City of Plainview, Texas, amending the Parks Department budget of the
General Fund of the 1992-1992 Budget.
h) Taxicabs - Ordinance No.92-2895. An Ordinance of the City of
Plainview, Texas, amending Chapter 7, "Business and Occupations", of
the City Code of the City of Plainview, with regard to Taxicabs.
i) Speed Zone - Ordinance No. 92-2893. An Ordinance of the City of
Plainview, Texas, fixing the max~mnm rate of speed for motor vehicles;
allowing for speed zones; providing for penalty and declaring an

Plainview, Texas, fixing the maximum rate of speed for motor vehicles;
allowing for speed zones; providing for penalty; and declaring an
emergency.

Basel~dl I~o~. Authorization for Mayor to execute a Lease
Agreement for the City of Plainview Optimist Summer Baseball 'Program
and a 1992 concession agreement for the Optimist st~mmer Baseball

l) Sanita~On - Lan~ Resolution No. R92-101. A Resolution of the
City of Plainview, Texas, declaring the intention to issue certificates of
obligation; providing for proceeds to be used for costs related to
engineering, permitting and construction fees, purchase of land, laudfill
and liner construction costs; and providing for re-imbursement to City
from certificate proceeds for certain expenditures made prior to
availability of certificate of obligation proceeds.

Discussion of evaluation of a public officer of employee (Director for

Discussion of purchase, exchange, lease, or value of real property or
negotiated contract for prospective gift. (Sunbelt Savings building
located at 304 West 6th Street, Plalnview, Texas). This meeting is
authorized by (TEX. REV. CIV. STAT. ANN. art. 6252-17, Sec. 2(f)
(Vernon Supp. 1990).).

The Council turned to the Agenda for today.
City Manager Reports:
Nursing Home - Mr. Jeffers reported that a group of local citizens are
planning to establish a nursing home for Aizheimer patients. They will be
requesting this to be placed on a future agenda, for consideration of an
application for Texas Capital Fund.

Sanitation Rates - The City Manager reported that a proposed increase in
sanitation rates will be introduced on the agenda in February, 1992.
16th 8t~-eet I~oject - Mr. Jeffers reported that the right of way is continuing
to be gathered, and that to date no further correspondence l~a~ been received
from the AT&SF Railroad.
Bean Time Foodm - Mr. Jeffers reported this will be on the agenda in
February. They will be asking for the city to pay one half the cost of sewer
lines to their facility, which is the old Jimmy Dean plant, which the City had
earlier informally endorsed.
YMCA - This will also be on the agenda sometime in February.
Police I4-andieap Propomml - Roy Osborne reported on a proposed volunteer
enforcement program on handicap parkin'g violations.
Cable TV Rates - Mr. Jeffers reported the City does now regulate cable TV
rates, ff the rate increase does not exceed 5%.
American Dim~bil~ties Act - Terry Powers, Director of Human Resources,
reported this legislation governs hiring practices, public service
accommodations, telecommunications as well as access to services and
programs. This encompasses parks, buildings, restrooms, etc. This may
require structural changes in some areas. Also the use of sign lang~age and
equipment for the hearing impaired. This al~o covers all city contracts with
any other entities. He stated he would keep us posted as we learn of other
things required to meet this legislation.
Mayor Ridlehuber declared the meeting adjourned at 1:05 p.m.
