City Council Meeting
February 25, 1992
The Plainview City Council met in a Regular Meeting on Tuesday, February
25, 1992, in the Council Chambers of the Plainview City Hall at 7:30 p.m.,
with Mayor E. V. Ridlehuber Presiding. Councilmembers present were: Alton
Jackson - Precinct 1; Mary Virginia Kirch_hoff - Precinct 2; Don Dickson -
Precinct 3; Medlin Carpenter Precinct 4; Barbara Dorman - Precinct 5;
Dwain Dodson - Precinct 6; and Ross Owen Precinct 7.
Staff Present: James P. Jeffers - City Manager; Bill Hogge - Director of
Public Works; Norman Huggins - Director of Finance; Diane Groh Director
for Community Services; Terry Powers - Director of Human Resources; Roy
Osborne - Director of Public Safety; Joe Ferguson - Fire Chief; and Karen
McBeth, City Secretary.
Media Present: Randy Ballinger - KKYN; Lisa Hightower - KVOP; John Riggs
Lubbock Avalanche Journai; and Richard Orr - Plainview Daily Herald.
OPEN MEETING
An Open Meeting was held concerning the foilowing subjects:
1. In¥oeation - Medlin Carpenter
2. Oath of Offioe The Oath of Office was administered to the foilowing
persons: K. C. Willis - Human Reiations Committee; Norvene Owen -
Planning & Zoning Committee; David deBusk Board of MiNimum Housing..
Police - David P~lmer - Director of Public Safety Roy L. Osborne, awarded
Officer David Palmer his Sergeant stripes. Director Osborne acknowledged
the excellent job Sergeant Palmer has done and commended him for his faithful
service to the community.
911 - Joe Ferguson - Mr. Bob Nash from Lubbock Emergency Communications
System, presented to Fire Chief Joe Ferguson a certificate of appreciation for
work with the 911 service, not only in Plainview, but throughout the area.
Mayor Ridlehuber and the City Council also commended Chief Ferguson for his
years of faithful service to the City.
3. Recycling Ta~k Force - Carla Edwards, Chairperson of the Recycling
Task Force, reported to the City Council that the ~Task Force has implemented
numerous recycling plans through Tommie Lewis Industries and Daffern Steel,
as well as other independent projects. One such project was the mulching of
Christmas trees this past year with the "chipper" owned by the city. This
mulch is being used by the Parks Department around the City's trees,
thereby saving much needed space in .the present landfill. The task force bas
also initiated the use of a recycling bin at College Hill school for household
metals. Mrs. Edwards hopes to include other schools in this project soon.
The Task Force is looking into including bins for paper and plastic. The
Task Force hopes to promote composting and the "Don't Bag It" program.
Mrs. Edwards reported plans are being made to hold a recycling fair and to
promote and educate the public on the need to recycle tires, paper and

plastics. She hopes in the future many manufactured items will have a
"recycle label" so many more items may be recognized as reusable. She stated
that the public needs to learn to "Reduce, reuse and recycle."
City Manager James Jeffers thanked Mrs. Edwards for her report and thanked
her for the many hoUrs of Work put into the committee.
4. Housing - Rental Rehabilitation City Manager James Jeffers reported
to the City Council that this program, while worthwhile, is more difficult to
administer than the Housing Rehabilitation Program for'~homeowners. The
restriction of not displacing anyone severely limits the rehabilitation process.
Mr. Jeffers noted that this was not funded 100% with State funds; the
property owner must match the amount spent. Mr. Jeffers felt the need to
secure clean, well repaired rental property was important for the citizens of
Plainview, and the money for rehabilitating rental property will be spent in
other cities if not Plainview. He felt Plainview would be well served to secure
such funding. Mr. Jeffers stated that each project would be submitted to the
Council for its approval, before being repaired under this program. He stated
that the South Plains Association of Governments would administer the
program. The City's building department will qualify the property.
Councilmember Dwain Dodson made a motion the City apply for this program;
Councilmember Don Dickson seconded it; the motion carried unanimously.
5. Sanitation - Rate Adjustment- Ordinance No. 92-2908. An Ordinance of
the City of Plainview, Texas, amending Sec. 24047, entitled "Refuse Collection
Fees; Water Termination" of the Code of Ordinances of the City of Plainview,
Texas. Finance Director Norman Huggins explained to the Council that with
the building of the new sanitary landfill, the need to raise sanitation rates
was unavoidable. He explained that the initial projected cost of the landfill
had doubled due to the mandates by the Federal government. Mr. Huggins
reported the City had an option to buy 300 acres of land on which to build
the proposed landfill. The proposed increase in costs would be from $8.20 to
$12.80 a month on individual residence rates; and a similar percentage on
commercial rates. He reviewed the figures in the proposed ordinance for the
Council. Councllmember Barbara Dorman made a motion the ordinance be
approved; Councilmember Medlin Carpenter seconded the motion; the motion
carried unanimously.
6.- T~affic Code - Ordinance No. 92-2909. An Ordinance of the City of
Plainview, Texas, amending the Plainview City Code Chapter 23, Article XIV,
entitled, "Stopping, Standing and Parking." Director of Public Safety Roy
Osborne reviewed the proposed ordinance, explaining this was the first step
in allowing volunteer enforcement of the handicap parking zones by certain
individuals. This would be a very small, very carefully selected group which
would be allowed to cite those persons illegally parking in the designated
handicap parking areas. Those volunteers would only be allowed to give
tickets for this specific violation. Councilmember Barbara Dorman made a
motion the ordinance be adopted; Councilmember Dwain Dodson seconded the
motion; the motion carried unanimously.
7. Amusement, Teml~o~-ary Commercial - Ordinance No. 92'2910. An
Ordinance amending the zoning ordinance no. 89-2798; providing for an
amendment to ss9:5, Retail and Service type uses; providing for a
cumulativeness clause; providing for a conflicts clause; and providing for an
effective date. Diane Groh, Director of Community Services explained that

this ordinance would provide short term outdoor amusements a way to get a
license without having to go through the Planning & Zoning Board each time.
The ordinance provides for specific zoning districts for this type activity
Councilmember Ross Owen made a motion to call for public hearing; Barbara
Dorman seconded the motion; the motion carried unanimously. Mayor
Ridlehuber asked if anyone wished to speak, either for or against. No one
came forward. Counci]member Barbara Dorman made a motion the public
hearing be closed; Dwain Dodson seconded the motion; the motion carried
unanimously. Mayor Ridlehuber asked for a motion on the ordinance;
Counci]member Medlin Carpenter made a motion Ordinance No. 92-2910 be
adopted; Councilmember Dwain Dodson seconded the motion; the motion
carried unanimously.

Resolution of the City of Plalnview, Texas, relating to the
reimbursement of City funds to be expended for costs of acquisition of
certain land and construction thereon of a solid waste landfill from the
proceeds of sale of debt obligations; and resolving other matters
incident and related thereto.
f) Sanitation - Landfill - Finance. Resolution No. 92-204. A
Resolution of the City Council of the City of Plainview, Texas,
authorizing the Mayor to execute an agreement for financial advisory
services with First Southwest Company.
g) Sanitation - Landfill - Finance. Resolution No. 92-105. A
Resolution of the City Council of the City of Plainview, Texas,
authorizing the Mayor to execute an agreement for bond attorney
services from Fulbright and Jaworski.
h) Electrical Code - Ordinance NO. 92-2911. An Ordinance amending
Ordinance No. 84-2550 of the Electrical Code of the City of Plainview;
Providing for an amendment to ssl.4(d). Maintenance Electrician;
Providing for a Cumulativeness Clause; Providing for a Conflicts
Provision and Providing for an EffectiVe Date.
Councilmember Barbara Dorman made a motion the Consent Calendar be
adopted as presented; Councilmember Medlin Carpenter seconded the motion;
the motion carried unanimously.
8. E~:eCUtive Session - Councilmember Don Dickson made a motion the
Executive Session be tabled until a later date; Councilmember Alton Jackson
seconded the motion; the motion carried unarimously.

9. Adjournment - Councilmember Don Dickson made a motion the meeting
adjourn; Councilmember Alton Jackson seconded the motion; the motion carried
unanimously. Mayor Ridlehuber declared the meeting adjourned at 8:15 p.m.
