This notice is posted pursuant to the Texas Open Meetings Act. [Tex. Gov't Code Ann. Sec.
551.001 et. seq.] The Council reserves the right to conduct a closed meeting on any agenda items
in accordance with Tex. Gov't Code Ann., Chapter 551, Subchapter D. This meeting is also being
conducted in accordance with the Americans with Disabilities Act [42 USC 12101 et. seq.]. The
facility is wheelchair accessible and handicap parking is available. Requests for sign interpretive
services are available upon requests received at least 48 hours prior to the meeting. To make
arrangements for those services call 296-1107.
The Parks Advisory Commission will meet Thursday, January 14, 2021 at 5:15 P.M., at City Hall
at 901 Broadway, Plainview, Texas 79072.

PARK ADVISORY BOARD
MINUTES
October 8, 2020
The City of Plainview Park Advisory Board, as appointed by City Ordinance Number 95-3035, dated, as approved,
March 28, 1995, held an open meeting Thursday, October 8, 2020 at the Council Chambers of City Hall, 901
Broadway, Plainview, Texas, 79072. Minutes for this meeting are hereby submitted as follows:
FIRST ITEM ON THE AGENDA: Called to order by Doug McDonough at 5:21 p.m.
Members present: Phyllis Wall, Ruby Riggins, Doug McDonough, Sandra Sims, and Homer Marquez.
City Staff present: Ricky Summers, Park Superintendent, Tim Crosswhite, Director of Public Works, Jeffrey
Snyder, City Manager, Judy Rasher, Secretary.
SECOND ITEM ON THE AGENDA: Invocation given by Phyllis Wall.
THIRD ITEM ON THE AGENDA: Approval of January 9, 2020 Minutes. Ruby Riggins made a motion to approve
minutes as presented. Sandra Sims seconded the motion. Motion carried unanimously.
FOURTH ITEM ON THE AGENDA: Consider and take necessary action regarding the use of the 2020-2021 Park
Advisory Funds.
Tim Crosswhite presented to the board a recommendation for the 2020-2021 Park Advisory Funds of $25,000
and the balance of $10,568.00 from the 2019-2020 funds, for a total amount of $35,568.00. The Board
requested a walking trail around Utica Park. The cost of the project would be around $23,000. Tim suggested
that part of the funds be allocated towards 16th Street park for a new pad for the basketball court. The cost for
a half court would be $11,875. The cost for a full court would be $23,750. With the balance of the funds, Tim
suggested a small pad for a basketball court at Little Thunderbird Park. The cost of this project would be
approximately $800. Phyllis Wall made a motion to approve the projects as presented for Utica Park, 16th Street
park and Little Thunderbird Park. Homer Marquez seconded the motion. Motion carried unanimously.
FIFTH ITEM ON THE AGENDA: Consider and take necessary action regarding the park at Thunderbird School.
Jeffrey Snyder presented before the board an overview and concept of the new Thunderbird School and park.
A new restroom, sidewalks, playground and irrigation will be installed and maintained by the City. Jeffrey
Snyder discussed the cost of the project and expense of the new Thunderbird Park. The plan is to improve the
park amenities and facilities at this location. No action taken.
SIXTH ITEM ON THE AGENDA: Meeting adjourned 6:10 p.m.

CLEAN AIR ORDINANCE
ORDINANCENO. 91-2880
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, WITH
REGARD TO HEALTH OF CITY EMPLOYEES, PERTAINING TO
SMOKING IN BUILDINGS OWNED BY, OR UNDER CONTROL OF THE
CITY OF PLAINVIEW; PROVIDING FOR A` PENALTY; PROVIDING
FOR A SAVINGS CLAUSE AND A PENALTY CLAUSE; AND
PROVIDING FOR PUBLICATION.
WHEREAS, the Surgeon General of the United States has reported that
inhalation of tobacco smoke involuntarily can cause disease, including lung
cancer, in healthy non-smokers; and
WHEREAS, the City Council of the City of Plainview believes that its
employees should have the right to choose for themselves on an individual
basis whether to smoke either actively or passively; and
WHEREAS, it is the desire of the City of Plainview to balance the interest of
its employees who smoke against the potential hazard to its employees who are
non-smokers in a manner that will result in the minimum possible burden on
those persons regulated while still meeting the duty to protect the health of
its employees.
NOW THEREFORE BE IT ORDAINED by the City of Plainview, Texas:
Section .1 SMOKING IN BUILDINGS OF CITY OF PLAINVIEW
A. Definitions.
The following definitions shall apply:
1) City's buildings means all of the enclosed area that is used by the
City and its employees and general public, including but not limited
to all or any part of the building used for any of the operations of
the City, such as the City Hall, Police Station, Municipal Court,
Library, Fire Stations, Health Department, City Maintenance
Facilities, Water Treatment Plant, and Waste Water Treatment Plant.
2) Smoke, Smokes or Smoking includes:
a) Carrying or holding a lighted' pipe, cigar, or cigarette of any
kind, or any other lighted smoking equipment or device, or
b) The combustion of any cigar, cigarette, tobacco, or similar
article, or any other combustible substance in any manner, or in any
form; or
c) Emitting or exhaling the smoke of a pipe, cigar, or cigarette of
any kind.

B . offense; Penalt
1) A person commits an offense if in a City building the person smokes
and fails, or refuses, to extinguish smoking materials or move outside
the building upon request by any person to do so.
2) Any person convicted of violating this provision shall be guilty of a
Class C Misdemeanor, punishable by a fine of not less than one dollar
($1.00), nor more than one thousand dollars ($1,000) as set by a judge
or jury.
C . Sims
Signs shall be visibly placed at each public entrance to city buildings
to notify persons entering the premises that smoking is prohibited.
This provision does not include exits used exclusively as emergency
exits.
D . Exceptions
Nothing herein shall preclude the designation of the following premises
as non-smoking areas, but the restrictions contained herein shall not
apply:
1) To the Plainview Chamber of Commerce building the Plainview
Country Club buildings; the Rotary Center; or to the Broadway Street
Shelter; or
2) To an individual participating in an authorized theatrical
performance.
3) In the course of a Police Interview with a WITNESS, VICTIM or
SUSPECT, it may be advantageous to allow that person to smoke for the
purpose of relaxing. In such an event, , the Police Officer conducting
the interview may allow the individual to smoke in their office or work
area during the interview only. This should riot be construed as a
method to circumvent the purpose of ,his ordinance, but to allow the
police department the freedom to conduct criminal investigations in the
most efficient and practical means possible.
Section 2 - Penalty
That violation of any provision of this ordinance shall be deemed a
misdemeanor punishable by a fine of not less than One Dollar ($1.00) nor
more than One Thousand Dollars ($1,000).
Section 3-- Savings Clause
That should any section, paragraph, sentence, clause, phrase or word of this
ordinance be declared unconstitutional or invalid for any reason, the
remainder of this ordinance shall not be affected thereby.

method of publication provided by law.
