Kenny Brown called the meeting to order at 7:00
FIRST ITEM ON THE~ AGE~I)A: 34~rovat of April 2006 minutes. Fred
Willis made motion to approve minutes as presented_ Max Browning seconded.
Motion canqed 5-0.
SECONI) ITEM ON TI~. AGE~I)A: BA Case # 1517 The request of Elias
Alex Martinez on behalf ofLionor B. Rodriguez for a variance of fifteen (15) feet
of the re~uired thh-ty-five (35) foot front setback and four (4) feet six (6) inches of
the required ten (I0) foot side setback as stated in Seetion 34 of the City of
Plainview Zorting Ordinance to comtn~ a 12'X2t' carport in a Single Family
(R-2) Zoning District, and being Block I, Lot 10, Highland Addition. Plainview,
Hale Connty, Texas the same being 413 W. llth Street. Elias Alex Martinez is
present m answer questions of the Board in regards to this case. John Castro
showed the Board a site pta~ of the proposed carport and pictures of the property.
He told the Board that the house is a non-conforming use since it sits in the front
setback. The carport is already existing, but a building permit was not o~ained
and it currently sits in the side fight of way. John Castro said there was no
driveway to the property before the carport was installed on the Denver Street
side of the house. The driveway is currently gravel. Elias Alex Martinez said he
plans to pave the driveway in *tm future and he is tnfing to improve the entire
appearance of the house by upgrading v~/ndow~ among other improvements.
Kenny Brown asked if there was a way to put the carport in the back Elias Alex
Martinez said the back yard is fenced in and they do not want to tear down the
fence. John Bickel asked about putting the carport on the East side of the house
but John Castro said there is was not room for a carport on that side of the house.
John Bickel asked if the carport was properly anchored down. John Castro said

no, but wben the permit is issued, the carport will be reqired to be properly
anchored down if the variance is approved. There were three (3) neighborhood
responses received, ail ia favor of the request. Max Browning made a motion to
approve 'the variance based on this being the only logical place for the carport and
the positive response from the neighborhood and added that the driveway must be
concrete within six (6) momh.q. Fred Willis seconded. Motion carried 5-0

Sigala for a variance of fifteen (15) feet of the required twenty-five (25) foot from
setback and four (4) foot of the required frye (5) foot side setback as stated in
Section 34 of the City of PIainvSew Zoning Ordinance to construct a 20'X20'
carport ia a Single Family {R-2) Zoning District, and being Bloc& 75, East 45
feet of Lots 5 & 6 and the Fast 45 feet out ofthe South 45 feet ofLot 7 except for
the railroad right of way, Highland Addition, Plainview, Hale County, Texas the
same being 1310 W. 15~ Street. Robert Sigala is present to answer questions
from the Board about this request, lohn Castro showed the Board a picture of~
property and a site plan o£ t~ proposed carport. The pictures show how the
house sits veiny near the property line next to the alley and that there is an existing
driveway. This existing concrete slab is where the proposed carport will sit.
Kenny Brown asked il'the carport would be a prefab carport. Robert Sigala said it
would re>t, he would be building it firom metal James Crosstand asked if the
carport could drain toward the alley, and John Castro said it could not. There was
one response from the neighborhood received and it was ia favor of the request.
Fred Willis made a motion to approve the varianee based on this being the only
logical place for a carport and added that tho carport must not drain to the alley.
James Crossland seconded the motion. Motion carried 5-0.
