John Bickel called the meeting to order at 7:00
FIRST ITEM ON TH~ AGF_a'~I)A: Approval of March 2006 minutes. Max
Browning made motion to approve minutes as presented. Fred Willis seconded.
Motion carried 4-0.
SECOND ITEM ON ~ AGENDA: BA Case # 1513 The request of Joe and
Norma Garcia for a variance of twenty-one (21) feet of the required twenty-five
(25) fool: front setback as stated in Section 34 of the City of Plainview Zoning
Ordinanr~ to conshmct a 20'X20' carport in a Single Family (R-2) Zoning
District, and being Block 3, Lot 3, Evergreen Addition, Plainview, Hale County,
Texas the same being 604 W. 27~ Street. Pearl Garcia, Joe and Norton Garcia's
daughter, is present to answer questions of the Board in regards to this case. John
Castro showed the Board a site plan of the proposed carport and pictures of the
property and he reminded the Board that this case bad been tabled at the previous
meeting for more detailed information about the property lines. He said that
although the fenced property adjacent to Joe Garcia's house would appear to be
included with the ownership of the house, Joe Garcia does not own the property
that is fenced. John Castro told the Board that the carport would line up with the
house and extend partially in front of the house. There were four (4) responses
received from the neighborhood, all in favor of the request. Max Browning made
a motion to approve the ~uSance based on this being the only logical place for the
carport and the positive responses from the neigbborhood_ Fred Willis seconded.
Motion carried 4-0.

THIRD ITEM ON THE AGEI~A: BA Case g 1514 The request of Julio C.
Hernandez for a variance of ten (10) feet of the required twemy (20) foot rear
setback as stated in Section 34 of the City of Plainview Zoning Ordinance to
constrm~ a 30'X30' shop to be entered from the alley in a Single Family (R-2)
Zoning District, and being Block 4, Lots 3 & 4, Hil~crest Addition, Ptainview,
Hale County, Texas the same being 302 NE gApine Street. Juiio Hernandez is
present 'to answer questions from the Board. John Castro showed the Board a site
plan of the proposed shop and pictures of the property. He said there was one
responm received from the neighborhood in favor of the request. There was a
second response received which was checked "I am in favor of' with the
following comments added: "I am not for or against this, all I know is in the past
they have drain their lawn mowers oil in the back alley. They need more than
dumpster just for this address. They dump grass in alley. This holds water and
makes holes in alley when trash truck drive over the piles of grass. I think this
will be worse the more travel going up and down alley killing the green grass that
grows in the alley." Julio Hernandez explained he needs the shop to be able ro
service his lawn mowing equipment. John Castro said staffrecommends approval
as long ,as the building is not higher than twelve (12) feet at the highest point.
When asked if the height restriction would be a problem, Juiio Hernandez said he
would make it work. He said the building would be pitched to drain onto his
propertL not the alley. Fred Willis made motion to approve the variance based on
staff recommendation with the stipulation that the shop not be higher than twelve
(12) feet at the highest point and that the building not drain onto the alley. James
Crossland seconded. Motion carried 40.
FOURTH ITEM Obi ~ AGEing[DA: BA Case # 1515 The request of Jaime
and Mary Jane Cazares for a variance of m'enty-fonr (24) feet of the required
twenty-five (25) foot front setback and one (1) foot of the required five (5) foot
side setbeck as stated in Section 34 of the City of Plainview Zoning Ordinance to
construct a 12'X25' carport in a Single Family (R-2) Zoning District, and being
Block 18, Lot 16, Thunderbird Addition, Ptainview, Hale County, Texas the same
being 1304 Thunderbird Drive. lalme Cazares is present to answer questions
from the Board John Castro showed the Board pictures of the property and a site
plan of the proposed carport. He pointed out to the Board that this carport is one
foot larger than what the ordinance defines for a normal carport. John Bickel
asked why does he want the larger carport and laime Cazares said it is because he
has a long bed track_ John Castro said there were three (3) responses received
from the neighborhooc~ all in favor of the request. James Crossland asked which
direction 'would water drain from the cm?ort. Jaime Cazares said the water would
drain toward the street. John Bickel asked approximately where would the
ra~enty-five (25) foot carport line up on the property. John Castro said k would be

approximately one foot inside the existing sidewalk_ Max Browning made motion
to approve the variance for the oversized carport based on the positive responses
from the; neighborhood and this being the only logical place for a carport. Fred
Willis seconded. Motion carried 4-0.
FIFTH ITEM ON THlg AGENDA: BA Case # 1516 The request of Eleazar
Flores for a variance of twenty (20) feet of the required twenty-five (25) foot from
setback and one (1) foot of the required five (5) foot side setback as stated in
Section :34 of the City of Ptalnview Zoning Ordinance to construct a 21'X21'
carport in a Single Family (R-2) Zoning District, and being Block 98, Lot 3,
Alexander Westmoreland Addition, Plainview, Hale Cotmty, Texas the same
being 907 Houston Street_ Eleazar Flores is present to answer questions from the
Board..John Castro showed the Board a site plan of the requested carport and
pictures of the property. He said there were two (2) responses received fi.om the
neighborlhood in favor of the request and no negative responses. Fred Willis
asked how close to the house would the carport be built. Eleazar Flores said the
carport would be built approximately one (I) foot fi.om the house and lined it up
with the side of the house. Max Browning asked which direction would water
drain from the carport. Ele~r Flores said water would drain to the sides wkich
should be no problem to the neighboring property since there is a large yard
separating the two houses. James Crossland made motion to approve the variance
based on ]positive responses fi.om the neighborhood and this being the only logical
place for 'the carport, adding that concrete must be poured underneath the carport.
Fred Willis seconded the motion_ Motion carried 4-0.
