HomeMy WebLinkAbout01.23.06 BA MinutesBOARD OF ADJUSTMENTS MINUTES 01/23/06 BOARD MEMBERS PRESENT: John Bickel, Fred Willis, Kenny Brown, James Crossland, Max Browning STAFF MEMBERS PRESENT: John Castro, Director of Community Services, Katy Seals - Community Services Secretary OTHER GUESTS PRESENT: Danny Murphree, Robert Garcia, F. G. Jones Kenny Brown called the meeting to order at 7:00 FIRST ITEM ON THE AGENDA: John Bickel and Fred Willis sworn in. SECOND ITEM ON THE AGENDA: Approval of November 2005 minutes. (No December meeting due to no quorum). Kenny Brown made motion to approve minutes as presented. Fred Willis seconded. Motion carded 5-0. THIRD ITEM ON TglF, AGENDA: BA Case # 1508. The request of Angel Ramos on behalf of Jose E. Isaguirre Jr. for a variance of twenty-four (24) feet of the required twenty-five (25) foot front setback and five (5) of the required five (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 24'X20' carport in a Single Family (R-2) Zoning District, and being Lot 8, Unit 1, Thunderbird Addition, Plainview, Hale County, Texas the same being 1304 W. 25th Street. There is no one present to answer questions of the Board in regards to this case. John Castro showed the Board a site plan of the proposed carport and pictures of the property. He also showed the Board a map showing properties within two hnndred (200) feet who were notified. There was one (1) response received and it was in favor of the request. James Crossland asked if the poles would be outside the sidewalk and John Castro said no because encroachment on the fight-of-way is not allowed. Kenny Brovm made a motion to approve the request based on this being the only logical place for a carport and added that a gutter must be installed on the neighbor's side to prevent drainage onto the neighbor's property. Max Browning seconded. Motion carded 5-0. FOURTH ITEM ON TITle. AGENDA: BA Case # 1509. The request of Pedro Luevano for a variance of t-wanty-four (24) feet of the required twenty-five (25) foot front setback and one (1) foot of the required tSve (5) foot side setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 12'X22' carport in a Single Family (R-2) Zoning District, and being West Half of Lots 7&8, Block 10, Original Town, Plainview, Hale County, Texas the same being 309 E. 4th Street. There is no one present to answer questions of the Board in regards to this case. John Castro showed the Board a site plan of the proposed carport and pictures of the property. He also showed the Board a map showing properties within two hundred (200) feet who were notified. There were two (2) responses received and both were in favor of the request. James Crossland asked if the carport would pass building inspections and John Castro said it is very well constructed and properly anchored down. Max Browning made a motion to approve the request based on this being the only logical placement for a carport and the poSitive responses from the neighborhood. Fred Willis seconded. Motion carried 5-0. FIFTH ITEM ON THE AGENDA: BA Case # 1510. The request of Precision Metal Works on behalf of FiG. Jones for a variance of twenty-nine (29) feet of the required thirty (30) foot front setback ard eight (8) feet of the required eight (8) foot side setback as stated in Section 34 of the City of Plalnview Zoning Ordinance to construct a 12'X22' carport in a Single Family (R- 2) Zoning District, and being South 26' of Lot 2 and the North 10' of Lot 3, Block 2, Robersun Subdivision, Plainview, Hale County, Texas the same being 1319 Vernon Street. The homeowner F. G. Jones and Robert Garcia with Precision Metal Works are present to answer questions of the Bored. John Castro showed the Board a site plan of the proposed carport and pictures of the property. He also showed the Board a map showing properties within two hundred (200) f~et who were notified. There were two (2) responses received and both were in favor of the request. Fred Willis asked which direction would water drain from thc carport. Robert Garcia said the carport would slope toward the street to allow drainage away from the house and neighbor's property. Max Browning asked what type materials would be used to construct the cmrport and Robert Garcia said it would be constructed of metal. Fred Willis made a motion to approve the variance based on the positive responses from the neighborhood and this being the only logical placement for a carport. Kenny Brown seconded. Motion carded 5-0. SIXTH ITEM ON THE AGENDA: BA Case # 1511. The request of Wayland Baptist University for a variance of ten (10) feet from the maximum height requirements of forty-five (45) feet as stated in Section 34 of the City of Plainview Zoning Ordinance to constrnct a structure that is fifty-five (55) feet in height in a University (U) Zoning District, Block 58, College Hill Addition, Plainview, Hale County, Texas the same being 2207 W. 7th Street. Danny Mm'phree is present from Wayland Baptist University to answer questions l}om the Board. John Castro showed the Board a site plan of the proposed building and pictures of the property where the proposed bulldin~ would be built. He also showed the Board a map of the properties within two hundred (200) feet of the site and noted that most of the properties in this area are owned by Wayland Baptist University, including many residential houses. The proposed building would be located in the interior part of the campus. John Castro said that staff feels that the lisnit on height restriction in a University Zone has to do with protecting the residential homes surrounding a university. Since Wayland owns the property immediately adjacent to the structure to the north, staff feels that the intent of the ordinance is basically follOwed and no harm is done to the private owners in the immediate vicinity. He said that not allowing this vah~nee would create an unnecessary hardship on the University by them having to alter the building plans significantly. James Crossland asked if the alley would be closed. John C .a~tro said the preeess to close the alley is in place and that the University will have to re-route a major sewer line before building could begin. Danny Murphree said all these issues are being addressed and the University will pay to re-route the sewer Line and other utilities as necessary. He said the building xaAll be a Student Activity Center with classrooms, gymnasium (not for cornpetitinn with limited seating), weight room, aerobic room, and meeting room. He said the Board of Adjustments January 23, 2006 Minutes athletic department would most likely relocate to this building when completed. There were no written responses received from the neighborhood, however Mr. Castro did receive an inquiry from Roger Dowdy, a property owner at the comer of 7t~ Street and Vernon. Kenny Brown asked how high this building would be in comparison to other buildings on campus. Danny Murphree said the building would be close in height to the library. James Cmssland made a motion to approve the variance since the building will be located in the interior part of the Wayland Baptist University campus and the height would not impose on private property owners in the area.
