MINUTES
PLAiNVIEW CITY COUNCIL MEETING
February 3, 2000
The Plainview City Council met at 11:30 a.m. at the Plainview Convention Center on February
3, 2000, with Mayor Lloyd C. Woods presiding. Councilmembers present were Sam Parker,
Precinct 1; Mary Jane Shanes, Precinct 2; Rey Rosas, Precinct 3; Mike Hutcherson, Precinct 4;
Ross Owen, Precinct 5; and Irene Favila, Precinct 7. Councilmember Bobby McGehee, Precinct
6, had an excused absence.
Staff members present were Jim Jeffers, City Manager; John Castro, Director of Community
Services; Greg Zielinski, Code Enforcement; William Mull, Police Chief; Sharon Wyatt, Main
Street Coordinator; John Berry, Director of Public Works; Rick Cox, Street Superintendent;
Norman Huggins, Director of Finance; Wally Hatch, City Attorney; Gary Glass, Fire Chief; and
Karen McBeth, City Secretary.
Guests present were Mr. J. W. Hamby, and Mrs. Janice Glass.
OPEN MEETING
1. John Castro gave the Invocation.
2. Review January 25, 2000, City Council Agenda.
The City Council and staff reviewed the Agenda for January 25, 2000. They discussed the
advisability of re-bidding the asphalt purchase for the coming seal coat season. The city received
only one bid for asphalt and two no-bids. The consensus was to re-bid it.
Director of Community Services John Castro reviewed Ordinance No. 00-3238, Zone Case 684.
An ordinance amending the zoning map of the City of Plainview, Texas for rezoning lots lB7,
block 57 (600 block of Utica); Lots 5-6 block 41 (1900 Block West 6th St.); Lots 1-2, block 44
(2000 block West 6th St.); Lots 7-8, Block 41 and lots 11-4, block 44 (500 block Smyth St.);
from a Single-Family Residential (R-l) and Commercial Retail (C-2) zoning district to a College
and University (U) zoning district. All lots are located in the College Hill Addition, Hale
County, Plainview, Texas; Cumulativeness clause; Conflicts clause; Severability clause; And
effective date. First reading. Mr. Castro said the Planning and Zoning Commission received no
objections to the rezoning of the area around Wayland Baptist University, and the commission
recommends approving the request. The area will be used as a parking lot. The Council
expressed no objections.
Ordinance No. 00-3239. Zone Case 685. An Ordinance authorizing the issuance of a Specific
Use Permit to operate an Arcade in a Central Business (CBD) zoning district, addressing being
622 Ash St.; Cumulativeness clause; Conflicts clause; Severability clause; And effective date.
First reading. John CaStro told the Council the arcade business will have parking problems, there
are not enough spaces to accommodate the proposed clientele. At night, with other businesses
closed, there won't be a parking problem. However, this Zone Case received some definite

opposition. There were four letters opposing this business and only one in favor of it. The
Planning and Zoning Commission has recommended denying issuance of a Specific Use Permit.
It was noted that the Council would have at least six votes in favor of the Zone Case because of
the number of protests.
Ordinance No. 00-3240. An Ordinance of the City of Plainview, Texas amending Chapter 20 of
the Plainview Code of Ordinances (Plumbing/Mechanical Code); Cumulativeness clause;
Conflicts clause; Severability clause; And effective date. First reading. Mr. Jeffers told the
Council if the mechanical code is adopted a third code enforcement officer will be needed The
start up cost of hiring the third officer will be $46,139.00. The annual on-going cost will be
$27,640 and will be partially offset by about $10,000 in revenues. The inspection fees cost 3¢
per square foot on new construction. The mechanical code allows homeowners to pull their own
permits and do their own work; a bona fide maintenance person can change out existing systems;
all with proper permits and inspections. A mechanical code, as with all codes, is meant to insure
the safety of the homeowner and to prevent damage to property. If adopted, the mechanical code
would go into effect at some future date, other than the date on which the ordinance passes.'
At 12:20 p.m. Mayor Woods adjourned the meeting.
