MINUTES
The Plainview City Council met in Work Session on Thursday,
November 5, 1987, at 11:30 a.m. at K'Bobs Restaurant with Mayor
E.V. Ridlehuber presiding and the following Councilmembers
present: Alton Jackson, Terry Clements, Don Dickson, Bobby James,
Barbara Dorman, Junior Brown and Tom Aday.
Staff present were: City Manager Jim Jeffers, Director of Fire
and EMS Joe Ferguson, Chief of Police Roy Osborne, Director of
Public Works Bill Hogge, and Director of Municipal Services Mike
McDonough.
Guest present were: Jim Ferrell,
Plainview Chamber of Commerce.

EMS FRANCHISE ORDINANCE. Since no one had any questions or
comments no discussion was conducted on the proposed EMS Franchise
Ordinance. A copy of the proposed Ordinance is in the hands of
Plainview Ambulance Service and the City Manager will be meeting
with a representative from such in the near future in order to
discuss the proposed Ordinance.
SWIMMING POOLS. After a lengthy discussion Councilman Aday moved
that the Austin Heights Pool be demolished as soon as practical
and that the closed 16th Street Pool have no action taken,
concerning capping or demolition, for the next two seasons in
hopes of identifying some group which may be interested in
operating the pool. Aday added that if the 16th Street Pool were
not leased in the next two seasons then it should be brought to
the Council for consideration for demolition or capping. Motion
was duly seconded by Councilwoman Dorman and carried by the
following vote: For: Jackson, Clements, Dickson, Dorman, Brown
and Aday. Against: James.
FOURTH OF JULY FIREWORKS. After a lengthy discussion Councilman
Clements moved that the City of Plainview agree to "lease" park
land to the Chamber of Commerce to conduct a fireworks display
with the Chamber of Commerce being responsible for the security of
the event and the City is to do everything practical to limit its
liability. Clements added that City personnel are to provide the
same support services as two years ago. Motion was duly seconded
by Councilman Aday and carried by a unanimous vote.
COUNTRY CLUB LEASE. In reviewing the second draft of the proposed
Country Club Lease, as prepared on August 14, 1987, it was the
consensus of the City Council that Section 1.03, which called for
a thirty day written notice cancellation clause by either party,

be deleted. It was the consensus of the City Council that in
Section 2.01 subpart F, calling for the placement of a City
Councilmember as an ex-officio member of the Board of Directors,
be deleted in its entirety. The Council was reminded that Section
2.02, entitled Value Received, was an attempt to comply with State
Statutes concerning the leasing of City properties. It was the
consensus of the City Council that a clause should be added to the
contract noting that all improvements, fixtures and furnishings
were the property of the City of Plainview. After a lengthy
discussion on whether or not the City Council should approve green
fees, Councilwoman Dorman moved that said Section calling for the
approval of green fees by the Council be deleted. Motion was duly
seconded by Councilman Dickson and carried by a unanimous vote.
There being no other proposed changes on the Country Club Lease,
Mayor Ridlehuber instructed City Staff to prepare the final draft
and submit it for preliminary review by Country Club Officials.
CITY COUNCIL REGULAR AGENDA FOR NOVEMBER 10, 1987. The City
Council reviewed the following topics for possible action on
November 10, 1987:

This meeting of the Plainview City Council is being conducted in
compliance with the Texas Open Meetings Law.
3) Consideration on first reading Ordinance No. 87-2731 entitled,
"An Ordinance of the City of Plainview, Texas amending Section 4-3
of the Plainview City Code establishing rates for ambulance
service."
4) Consideration on first and final reading Ordinance No. 87-2732
entitled, "An Ordinance of the City of Plainview, Texas requiring
a consumer or seller of natural gas to obtain from the City a
permit to transport gas through pipe lines constructed on the
public ways; setting fees for such permitting and for the use of
public ways; setting permit requirements; providing for
relocations and penalties and declaring an emergency."
5) .Consideration on second and final reading Ordinance No.
87-2702 entitled, "An Ordinance of the City of Plainview, Texas
granting to Energas Company (a Texas Corporation with itsv×
principal offices in the City of Dallas, Dallas County, Texas) the
franchise and rights to conduct in said City the business of
acquiring, maintaining, constructing, laying, repairing, removing,
replacing, installing, operating, and disposing of a gas system
for the sale, transportation and distribution of natural gas
within the municipal boundaries of the City and to the residents
and businesses located therein for light, heat, power, and any
other purposes and the right to use the present and future

streets, roads, highways, alleys, public ways, and real property
in said City and owned or controlled by said City for said
purposes; prescribing the terms and conditions to which said
franchise and rights are subject; and prescribing the term of
said franchise and rights."
ALL MATTERS UNDER ITEM 6 CONSENT CALENDAR ARE CONSIDE~RD TO BE
ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION IN THE
FORM LISTED BELOW. T~RRE WILL BE NO SEPARATE DISCUSSION OF THESE
ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE CLARIFICATION.
ON OBJECTION BY ANY PARTY TO THE INCLUSION OF ANY ITEM ON THE
CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT
CALENDAR. SUCH OBJECTION MAY BE RECORDED ANY TIME PRIOR TO THE
TAKING OF A VOTE ON THE MOTION TO APPROVE THE CONSENT CALENDAR.
ALL SUCH ITEMS SHALL BE CONSIDERED INDIVIDUALLY IN THE ORDER IN
WHICH THEY ARE OBJECTED TO, IMMEDIATELY FOLLOWING THE
CONSIDERATION OF THE CONSENT CALENDAR.

87-2725 entitled, "An Ordinance amending Chapter 1, General
Provisions, of the Plainview City Code providing for a general
penalty for certain offenses as such are defined by State Law."

87-2726 entitled, "An Ordinance of the City of Plainview, Texas
amending the 1987-1988 Budget through the appropriation of an/
additional $9,000.00 in expenses in the Emergency Medical Services
Department."
f) Consideration on first reading Ordinance No. 87-2728
entitled, "An Ordinance of the City of Plainview, Texas amending
the 1987-1988 Budget through the appropriation of an additional
$7,000.00 in expenses from the Parks Improvement Fund."
g) Consideration on first reading Ordinance No. 87-2729
entitled, "An Ordinance amending Chapter 18, Parks and Recreation,
of the Code of the City of Plainview prohibiting certain
activities within the parks; providing for exceptions,
application and appeal therefrom; providing for a penalty and a
severability provision." J
h) Consideration on first and final reading Ordinance No.
87-2730 entitled, "An Ordinance prohibiting the parking, stopping
or standing of any motor vehicle on a portion of Smyth Street,
Plainview, Texas, providing a penalty and providing for the
passage of such Ordinance as an emergency."

i) Consideration of Resolution No. R87-303 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
appointing Representatives to serve on the County Wide Fire
Suppression Committee."
j) Consideration of Resolution No. R87-302 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
extending time for consideration of the Southwestern Public
Service rate decrease request."
k) Consideration of Resolution No. R87-304 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
casting votes for individuals nominated to the Board of Directors
of the Hale County Central Appraisal District Board of Directors."
1) Consideration of Resolution No. R87-305 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
awarding bids for traffic signal equipment at the Intersection of
16th and Quincy."
There being no further business Mayor Ridlehuber adjourned the
Meeting at 1:20 p.m.
