MINUTES
The Plainview City Council met in Regular Session on Tuesday,
August 25, 1987, at 7:30 P.M. in the Council Chambers of City Hall
with Mayor E.V. Ridlehuber presiding and the following
Councilmembers present: Tom Aday, Bobby James, Junior Brown, Don
Dickson, Barbara Dorman, Alton Jackson and Terry Clements.
Staff present: City Manager Jim Jeffers, Director of Municipal
Services Mike McDonough, Assistant City Attorney David Blackburn,
Director of Public Works Bill Hogge, Chief of Police Roy Osborne,
and Director of Finance Norman Huggins.
Visitors present: Carl Willoughby and John Warrick.
News media: Richard Orr - Plainview Daily Herald, and Cathy
Donahue - K.V.O.P.
Invocation was given by Mayor E.V. Ridlehuber.
Mayor Ridlehuber opened the Meeting and welcomed the guests.
CUMIILATIVE ZONING. Mike McDonough, Director of Municipal
Services, advised the City Council that for many years there was
an assumption that the City had cumulative zoning, with the
specifics being that an apartment complex could be constructed in
a commercial zone. With the recent litigation involving
properties at the Intersection of 16th and the 1-27 Service Road,
it was noted that in fact that the ordinance did not allow for
cumulative zoning. The Council had expressed an interest in
correcting the "wording problem" and a hearing had recently been
held by the Planning and Zoning Commission and no protest had been
received. Councilwoman Dorman moved that a public hearing be held
on the adoption of Ordinance No. 87-2713 as it pertains to
cumulative zoning. Motion was duly seconded by Councilman
Clements and carried by a unanimous vote. Carl Willoughby and
John Warrick spoke in favor of the zoning change because of some
specific business interest that they had. There being no further
comment Councilman Dickson moved that the public hearing be
closed. Motion was duly seconded by Councilman Clements and
carried by a unanimous vote.

TAX L~VY. Mayor Ridlehuber introduced Resolution No. R87-284
entitled, "A Resolution of the City Council of the City of
Plainview, Texas expressing an intent to lower the City of
Plainview, tax levy from $.62 to $.59 and increase the effective
tax rate from $.5478 to $.59 and establishing a date, time and
place for a public hearing on the proposed tax levy."
Councilwoman Dorman moved that said Resolution be adopted. Motion
was duly seconded by Councilman Clements and carried by a
unanimous vote. ~ ~~ ~/~ ~_
BUDGET PUBLIC HEARING. Mayor Ridlehuber introduced Resolution No.
R87-285 entitled, "A Resolution of the City Council of the City of
Plainview, Texas calling for a public hearing on the proposed
1987-1988 Budget for the City of Plainview." Motion was made by
Councilwoman Dorman to adopt said Resolution. Motion was duly
seconded by Councilman Clements and carried by a unanimous vote.
Mayor Ridlehuber introduced the following topics on the Consent
Calendar:

d) Consideration on first reading Ordinance No. 87-2713
entitled, "An ordinance amending Ordinance No. 82-2478 entitled,
"The City of Plainview Zoning Ordinance" more specifically Section
17:2 entitled, "use regulations" sub-part 1, and establishing an
effective date." (Cumulative Zoning)
e) Consideration on first reading Ordinance No. 87-2718
entitled, An ordinance adopting and enacting the Plainview City
Code," compiled and codified by authority of the City Council;
containing the permanent, general ordinance of the City;
repealing all ordinances and parts of ordinances of a permanent,
general nature not included in the Code in full or by reference;
providing a penalty for wrongfully changing or tampering with the
Code; regulating the bringing of the Code up to date; providing
for certification of copies of the Code, and for sale of copies
thereof; and prescribing the time when the Code shall become
effective."
f) Consideration of Resolution R87-283 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
authorizing the Mayor to enter a Lease Purchase Agreement in order
to acquire a computer for the Police Department."

Councilman Brown moved that all items on the Consent Calendar be
adopted. Motion was duly seconded by Councilman Clements and
carried by a unanimous vote.
Adjournment. Motion was made by Councilman Clements to adjourn
the Meeting. Motion was duly seconded by Councilman Aday and
carried by a unanimous vote. There being no further business
Mayor Ridlehuber adjourned the Meeting at 8:57 p.m.
