MINUTES The Plainview City Council met in Work Session on Thursday, August 20, 1987, at 11:30 A.M. at the Plainview Country Club with the following Councilmembers present: Alton Jackson, Bobby James, Don Dickson, and Terry Clements. Absent were: Mayor E.V. Ridlehuber, Tom Aday, Barbara Dorman and Junior Brown. Staff present: Director of Municipal Services Mike McDonough, Assistant City Attorney David Blackburn, Director of Public Works Bill Hogge, Chief of Police Roy Osborne, and City Secretary Sheryl Owen. Visitors present: Richard Orr - Plainview Daily Herald, and Cathy Donahue - K.V.O.P. COUNTY FIRE SUPPRESSION. City Manager Jim Jeffers briefed the Council on the current fire services contract with the County. Mr. Jeffers explained that Mr. Paul Lyle and some other interested parties had made a request to the City to endorse a committee to develop and review the pro's and con's of developing a fire district. Council discussed such committee and the fire district. It was then moved by Councilman Clements to endorse the request for a committee to study the fire district. Motion was duly seconded by Councilman Dickson. Motion carried unanimously. STREET LIGHTs - BROADWAY. City Manager Jim Jeffers explained that staff recommends not to turn off the lights between 2nd and llth Street on Broadway, but to go ahead with the rest that were proposed. Mr. Jeffers explained that cost figures on said lights had not been received yet, but as soon as they were they would be given to the Council. It was moved by Councilman Dickson seconded by Councilman Jackson to turn off said lights. Motion carried unanimously. BOARDS AND COMMISSION HANDBOOK. City Manager Jim Jeffers briefed the Council on the proposed Boards and Commissions Handbook. Mr. Jeffers asked the Council if they would like to make changes in the attendance requirements and the succession of appointment requirements. Suggestion was made on the attendance requirements that the Committee recommend the dismissal after a member has had 1 of 4 three consecutive or five absences in a year and then Council take final action on their dismissal. On succession of appointments Council agreed to change the consecutive years from two to no restriction. After a lengthy discussion it was moved by councilman Jackson seconded by Councilman James to table the Boards and Committees Handbook for further study. Motion failed on tied motion. It was then moved by Councilman James seconded by Councilman Clements to go ahead with the Handbook as proposed. Motion: For - Councilman James, Dickson and Clements. Against - Councilman Jackson. RECREATIONAL VEHICLES IN FRONT YARDS. It was moved by Councilman James seconded by Councilman Clements to table this item. Motion carried unanimously. PLANNING AND ZONING COMMISSION APPOINT~RNTS. City Manager Jim Jeffers informed the City Council that only one application had been received for the P & Z. It was his suggestion that the Council try to get some more applications. It was moved by Councilman Dickson seconded by Councilman Clements to do such. Motion carried unanimously. LEASE AGREEMENT - 7TH STREET PARK. City Manager Jim Jeffers explained the Lease Agreement situation on the three buildings on Joliet Street in the 7th Street Park. Mr. Jeffers indicated that the parties of the buildings had expressed that they could not afford the insurance requirements. It was moved by Councilman Dickson seconded by Councilman Clements not to pursue the Lease Agreement and instructed staff to send letters to the parties of the buildings informing them of their responsibilities. Motion carried unanimously. CABLE T.V. City Manager Jim Jeffers explained to the Council that the Representatives of Plainview Cable T.V. would be attending the Work Session on September 17, 1987. City Manager Jim Jeffers presented the following regular Agenda: 1) INVOCATION 2) OPENING OF COUNCIL: This meeting of the Plainview City Council is being conducted in compliance with the Texas Open Meetings Law. 3) PUBLIC HEARING. Ordinance No. 87-2713 (cumulative zoning) - see Consent Calendar Item d). 2 of 4 4) Consideration of Resolution No. R87-284 entitled, "A Resolution of the City Council of the City of Plainview, Texas expressing an intent to lower the City of Plainview tax levy from $.62 to $.59 and increase the effective tax rate from $.5478 to $.59 and establishing a date, time and place for a public hearing on the proposed tax levy." 5) Consideration of Resolution No. R87-285 entitled, "A Resolution of the City Council of the City of Plainview, Texas calling for a public hearing on the proposed 1987-1988 Budget for the City of Plainview." ALL MATTERS UNDER ITEM 6 CONSENT CALENDAR ARE CONSIDERR~ TO BE ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION IN THE FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE CLARIFICATION. ON OBJECTION BY ANY PARTY TO THE INCLUSION OF ANY ITEM ON THE CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT CALENDAR. SUCH OBJECTION MAY BE RECORDED ANY TIME PRIOR TO THE TAKING OF A VOTE ON T~E MOTION TO APPROVE THE CONSENT CALENDAR. ALL SUCH ITEMS SHALL BE CONSIDERED INDIVIDUALLY IN THE ORDER IN WHICH THEY ARE OBJECTED TO, IMMEDIATELY FOLLOWING THE CONSIDERATION OF THE CONSENT CALENDAR. 6) CONSENT CALENDAR a) Minutes b) Department Reports c) Budget Expenditures d) Consideration on first reading Ordinance No. 87-2713 entitled, "An ordinance amending Ordinance No. 82-2478 entitled, "The City of Plainview Zoning Ordinance" more specifically Section 17:2 entitled, "use regulations" sub-part 1, and establishing an effective date." (Cumulative Zoning) e) Consideration on first reading Ordinance No. 87-2718 entitled, An ordinance adopting and enacting the Plainview City Code," compiled and codified by authority of the City Council; containing the permanent, general ordinance of the City; repealing all ordinances and parts of ordinances of a permanent, general nature not included in the Code in full or by reference; providing a penalty for wrongfully changing or tampering with the Code; regulating the bringing of the Code up to date; providing for certification of copies of the Code, and for sale of copies thereof; and prescribing the time when the Code shall become effective." 3 of 4 f) Consideration of Resolution R87-283 entitled, "A Resolution of the City Council of the City of Plainview, Texas authorizing the Mayor to enter a Lease Purchase Agreement in order to acquire a computer for the Police Department."
