PLAINVIEW COUNTRY CLUB
11:30 A.M.
MINUTES
The Plainview City Council met in Work Session on Thursday, July
9, 1987, at 11:30 A.M. at the Plainview Country Club with Mayor
Ridlehuber presiding and the following Councilmembers present:
Don Dickson, Bobby James, Tom Aday, Alton Jackson, Terry
Clements, and Junior Brown. Councilwoman Barbara Dorman was
absent.
Staff present: City Manager Jim Jeffers, Director of Municipal
Services Mike McDonough, Assistant City Attorney David Blackburn,
Director of Public Works Bill Hogge, Chief of Police Roy Osborne,
and City Secretary Sheryl Owen.
Visitors present: Richard Orr - Plainview Daily, Cathy Donahue -
K.V.0.P., Jimmy James, John Kirchoff, John Warrick, James
Robison, Travis Roberts - Hunter Associates, Jim Robertson -
Hunter Associates and Lee Lawrence - Hunter Associates.
CUMULATIVE ZONING. City Manager Jim Jeffers opened the floor
for review on cumulative zoning. Mr. John Warrick, James
Robison and John Kirchoff expressed their interest in cumulative
zoning as it pertained to the downtown area. After discussion
it was consensus of the Council to authorize staff to amend the
ordinance 'and add the cumulative zoning to the Agenda for
action.
Director of Municipal Services Mike McDonough, introduced three
representatives from Hunter Associates; Travis Roberts, Jim
Robertson and Lee Lawrence. Travis Roberts explained the
proposal to provide zoning ordinance revisions and Comprehensive
Master Plan Update. Mr. Jim Jeffers explained to the Council
that the Contract would be reviewed by legal counsel and would
be on the regular Agenda to be approved on Tuesday, July 14,
1987.
pRO-RATA ORDINANCE. Director of Public Works Bill Hogge
explained the proposed changes in the Pro-rata Ordinance. He
explained that it would be put on the Agenda for July 14, 1987,
for first reading and public hearing.
WATER TAPS. Director of Public Works Bill Hogge explained the
water taps in paved alleys. It was the consensus of Council to
go with staff recommendations on the proposed water taps as
outlined in Resolution No. R87-272.

STREET LIGHTS. City Manager Jim Jeffers advised the Council to
go and look at the lights on Broadway Street that were proposed
to be turned off.
NORTH QUINCY. City Manager Jim Jeffers explained to the Council
that the Planning and Zoning Commission advised that a
consultant be hired to look at the proposed North Quincy - I 27
Connecting Road. Mr. Jeffers advised that a study would be
forthcoming through Hunter Associates.
SUPERCONDUCTING SUPERCOLLIDER. Mayor Ridlehuber summarized the
City of Amarillo's request for funding for the Superconducting
Supercollider. After discussion on the request City Council
requested that more information be provided from the City of
Amarillo on such for further review.
EMS FRANCHISING ORDINANCE. City Manager Jim Jeffers informed
the Council that letters had been sent out soliciting comments
on the proposed EMS Ordinance and all comments were due by July
30th.
City Manager Jim Jeffers presented the regular Agenda for the
City Council Meeting to be held July 14, 1987, he advised that
the Energas Ordinance would be tabled again.

2) OPENING OF COUNCIL:
This meeting of the Plainview City Council is being conducted in
compliance with the Texas Open Meetings Law.
3) Consideration on second reading Ordinance No. 87-2702
entitled "An Ordinance of the City of Plainview, Texas, granting
to Energas Company (a Texas Corporation with its principal
office in the City of Dallas, Dallas, County, Texas) the
franchise and rights to conduct in said City the business of
acquiring, maintaining, constructing, laying, repairing,
removing, replacing, installing, operating, and disposing of a
gas system for the sale, transportation, and distribution of
natural gas within the municipal boundaries of the City and to
the residents and businesses located therein for light, heat,
power, and any other purposes and the right to use the present
and future streets, roads, highways, alleys, public ways, and
real property in said City and owned or controlled by said City
for said purposes; prescribing the terms and conditions to which
said franchise and rights are subject; and prescribing the terms
of said franchise and rights."

4) Consideration on Ordinance No. 87-2711 entitled, "An
Ordinance closing the public hearing given to the property
owners abutting Southwest Third Street in the City of Plainview,
Texas within the limits hereinafter described and defined, as to
the special benefits to accrue to said property owners and said
property thereof by virtue of the improvement of Southwest Third
Street within said limits, and as to any errors, invalidities or
irregularities in any of the proceedings or contracts therefore;
finding and determining that each and every parcel of property
abutting said street within the limits defined will be
specifically benefited and enhanced in value at least to the
amount of the cost to said improvements proposed to be, and as,
assessed said abutting property and the real and true owners
thereof, and levying an assessment for the cost of improving such
streets within the limits defined, fixing a charge and lien
against all said abutting properties, and the real and true
owners thereof; providing for the manner and method of
collection of said assessment; declaring an emergency and
providing that this ordinance shall become effective immediately
upon its passage."
5) Consideration on second and final Ordinance No. 87-2704
entitled, "An Ordinance amending Zoning Ordinance No. 82-2478
and the official zoning map of the City of Ptainview so as to
make the following changes: Zone Case No. 548; request of Mike
McDonough, Director of Municipal Services, on behalf of the City
of Plainview for rezoning of 91.68 acres of land from R-1
(Single-Family Residential) and A-O (Agricultural-Open Space)
Zoning Districts to a C.R.D. (Commercial Retail) Zoning District
and being the 1800 through the 3900 Blocks of Southwest Third
Street."
6) Consideration of Resolution No. R87-266 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
addressing concerns as expressed by the Frisco Neighborhood
Committee."
7) Consideration on second and final reading Ordinance No.
87-2709, entitled, "An Ordinance calling for a special election
to be held in the City of Plainview, Texas, on the questions of
the adoption of a one-half percent (1/2%) local sales and use
tax within the city; designating the day of the election and the
polling places; appointing election officials therefore;
providing that all duly qualified resident elector shall be
qualified to vote; prescribing form of ballot; providing for
notice of said election; and containing other provisions
relating thereto."

ALL MATTERS UNDER ITEM 8_ CONSENT CALENDAR ARE CONSIDERED TO BE
ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION IN
THE FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION OF
THESE ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE
CLARIFICATION. ON OBJECTION BY ANY PARTY TO THE INCLUSION OF
ANY ITEM ON THE CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED
FROM THE CONSENT CALRNDAR. SUCH OBJECTION MAY BE RECORDED ANY
TIME PRIOR TO THE TAKING OF A VOTE ON THE MOTION TO APPROVE THE
CONSENT CALRNDAR. ALL SUCH ITEMS SHALL BE CONSIDERED

accepting a proposal to provide zoning ordinance revision and
Comprehensive Master Plan Update."
f) Consideration of Resolution No. R87-267 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
authorizing the distribution of the third annual citizen
participation survey."
g) Consideration of Resolution No. R87-268 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
accepting a request for proposal for a personnel audit."
h) Consideration of Resolution No. R87--269 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
appointing an individual to serve on the Canadian River
Municipal Water Authority Board of Directors."
i) Consideration on first reading Ordinance No. 87-2710
entitled, "An Ordinance of the City of Plainview, Texas amending
the Plumbing Code of the City of Plainview, Texas, (Ordinance No.
85-2587), deleting distance requirements for gas lines near
electrical wires; prohibiting the use of copper wire or
aluminum water tubing for gas service; prohibiting plumbing

vents from being exposed on the exterior of buildings from the
ground to the roof lines; directing publication of the
descriptive caption of this ordinance with penalty provisions of
the Plumbing Code; and providing for an effective date of this
ordinance."
j) Consideration on final reading Ordinance No. 87-2712
entitled, "An Ordinance prescribing the speed limit on Quincy
Street in the City of Plainview, Texas, at the locations
hereinafter designated, repealing all ordinances in conflict
herewith and prescribing a penalty for the violation of this
ordinance and declaring an emergency."
It was moved by Councilman Aday seconded by Councilman Brown to
go into Executive Session on pending litigation as authorized by
Article 6252-17, Section 2(e). (Southwest Third Assessment
Program). After Executive Session it was moved by Councilman
Dickson seconded by Councilman James to adjourn the Executive
Session. There being no further business pending the Meeting
adjourned.
