MINUTES The Plainview City Council met in Regular Session on Tuesday, June 23, 1987, at 7:30 P.M. in the Council Chambers of City Hall with Mayor Ridlehuber presiding and the following CoUncilmembers present: Don Dickson, Barbara Dorman, Bobby James, Tom Aday, Alton Jackson, Terry Clements, and Junior Brown. Staff present: City Manager Jim Jeffers, Director of Municipal Services Mike McDonough, Assistant City Attorney David Blackburn, Director of Public Works Bill Hogge, Chief of Police Roy Osborne, City Attorney Tom Hamilton and City Secretary Sheryl Owen. Visitors present: Sid Cooper, Richard Orr - Plainview Daily Herald, Mrs. Nolen Oldfield, Jerry N. Smith, Mr. & Mrs. Ralph Nafzger, Jakie M. Harris, J.B. Wheeler, Tony Ricketts - K.V.O.P., Barry Miller, James Thomas, Mrs. Robert Tipton, Robert Tipton, T.C. Wall, Frank Gabriel, Geraldine Wellendorf, and Dickie Wall. Mayor presented the following items: PUBLIC HE]%RING - Southwest Third Street property assessments pursuant to Ordinance No. 87-2707. It was moved by Councilwoman Dorman seconded by Councilman Clements to open the public hearing. Motion carried unanimously. Bill Hogge Director of Public Works briefed the Council on the Southwest Third Assessments. David Blackburn Assistant City Attorney introduced Sid Cooper the Real Estate Appraiser for the Southwest Third Assessments. Mr. Cooper presented testimony on each parcel of property. The following persons spoke for the Southwest Third Project: J.B. Wheeler, Dickie Wall, Franklin Ebeling. Those opposed: Don Graff - Attorney representing Ralph Nafzger requested that Mr. Nafzger's property not be assessed. Larry Smith - Attorney from Amarillo representing Mrs. Nolen Oldfield spoke against the assessment project. Barry Miller and RandY Kidd representatives of Ridgecrest Development Corporation expressed concerns about the City having the right to draw on their line of credit for Southwest Third Project in accordance with the subdivision ordinance. Jakie Harris spoke against the assessment. It was then moved by Councilman Aday seconded by Councilman Brown to close the public hearing. Motion carried unanimously. It was moved by Councilman Aday to accept the testimony that had been heard and instruct the Assistant City Attorney to prepare an ordinance on the assessments being set at some value to be considered at the next Council Meeting. It was seconded by Councilman Brown. Motion carried unanimously. 1 of 4 Consideration on second reading Ordinance No. 87-2702 entitled, "An Ordinance of the City of Plainview, Texas, granting to Energas Company (a Texas Corporation with its principal office in the City of Dallas, Dallas, County, Texas) the franchise and rights to conduct in said City the business of acquiring, maintaining, constructing, laying, repairing, removing, replacing, installing, operating, and disposing of a gas system for the sale, transportation, and distribution of natural gas within the municipal boundaries of the City and to the residents and businesses located therein for light, heat, power, and any other purposes and the right to use the present and future streets, roads, highways, alleys, public ways, and real property in said City and owned or controlled by said City for said purposes; prescribing the terms and conditions to which said franchise and rights are subject; and prescribing the terms of said franchise and rights." It was moved by Councilwoman Dorman seconded by Councilman Clements to table this ordinance for further review. Motion carried unanimously. Consideration on second and final reading Ordinance No. 87-2704 entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 548; request of Mike McDonough, Director of Municipal Services, on behalf of the City of Plainview for rezoning of 91.68 acres of land from R-1 (Single-Family Residential) and A-O (Agricultural-Open Space) Zoning Districts to a C.R.D. (Commercial Retail) Zoning District and being the 1800 through the 3900 Blocks of Southwest Third Street." It was moved by Councilwoman Dorman seconded by Councilman James to table this ordinance until the regular Council Meeting on July 14. Motion carried unanimously. Consideration on second and final reading Ordinance No. 87-2705 entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 549; request of Mike McDonough, Director of Municipal Services, on behalf of the City of Plainview for rezoning of four tracts of land totaling 56.855 acres out of Survey No. 41, Block JK-2, Survey No. 42, Block JK-2, and the J.M. Pressler Homestead Survey from R-1 (Single-Family Residential) Zoning District to a C.G.B. (Commercial General Business) Zoning District and located in the 900 through 2000 Blocks of South Highway 87 Business Route." It was moved by Councilman Clements seconded by Councilman Aday to approve this ordinance on second and final reading. Motion carried unanimously. Consideration on second and final reading Ordinance No. 87-2706 entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 and the official zoning map of the City of Plainview so as to make the following changes: Zone Case No. 550; request of Paul Scott and Scott Tractor for rezoning of 9.06 acres of land out of the west half of Block JK-2, Section 29, Hale County, Texas from an R-1 (Single-Family Residential) Zoning District to a C.G.B. (Commercial General Business) Zoning District for commercial uses and located in the 700 and 800 Block of South Interstate Highway No. 27." It was moved by Councilwoman Dorman seconded by Councilman Dickson to approve this ordinance on second and final reading. Motion carried unanimously. 2 of 4 Mayor presented the Consent Calendar as follows: CONSENT CALENDAR a) b) c) Minutes Department Reports Budget Expenditures d) Consideration on first reading Ordinance No. 87-2709, entitled, "An Ordinance calling for a special election to be held in the City of Plainview, Texas, on the questions of the adoption of a one-half percent. (1/2%) local sales and use tax within the city; designating the day of the election and the polling places; appointing election officials therefore; providing that all duly qualified resident elector shall be qualified to vote; prescribing form of ballot; providing for notice of said election; and containing other provisions relating thereto." e) Consideration of Resolution No. R87-259 entitled, "A Resolution of the City Council of the City of Plainview, Texas selecting an auditor to complete the 1986-1987 Fiscal Year Audit." f) Consideration of Resolution No. R87-260 entitled, "A Resolution of t~e City C6uncil of the City of Plainview, Texas authorizing the Mayor to enter into an Agreement for Legal Services to be provided to the City of Plainview." g) Consideration of Resolution No. R87-261 entitled, "A Resolution of the City Council of the City of Plainview, Texas approving the preliminary plat of Morton and Spears Addition, Plainview, Hale County, Texas (to become Westridge Addition, Unit No. 8, Plainview, Hale County, Texas)." 'h) Consideration of Resolution No. R87-Z62 entitled, "A Resolution of the City Council of the City of Plainview, Texas authorizing the Mayor to execute a Lease Agreement with the Optimist Summer Baseball Program." i) Consideration of Resolution No. R87-263 entitled, "A Resolution of the City Council of the City of Plainview, Texas accepting the bid of Lucia Martinez for the property located at 615 East Sth Street." j) Consideration of Resolution No. R87-264 entitled, "A Resolution and Agreement granting to the Optimist S~mmer Baseball Program Association permission to operate concessions in designated park areas of the City of Plainview, prescribing the conditions of such permission and the term for which said permission is granted." T/%BLED k) Consideration of Resolution No. R87-265 entitled, "A Resolution of the City Council of the City of Plainview, Texas accepting a proposal to provide zoning ordinance revision and Comprehensive Master Plan Update." 3 of 4 It was moved by Councilwoman Dorman seconded by Councilman James to approve the Consent Calendar as presented with the exception of Item (k) Resolution Po. RS?-265 being tabled for further review. Motion carried unanimously. It was moved by Councilman Brown seconded by Councilman Aday to move into Executive Session to discuss pending litigation as authorized by Article 6252-17, Section 2(e). (Southwest Third Assessment Program). Council reconvened into Regular. Session, out of Executive Session. Councilman Aday made a motion to adjourn the Meeting, motion was duly seconded by Councilman Brown, motion carried unanimously and meeting adjourned.
