MINUTES The Plainview City Council met in Work Session on Thursday, April 9, 1987, at 11:30 a.m. at the Plainview Club with Mayor Ridlehuber presiding and the following Councilmembers present: Alton Jackson, Terry Clements, Don Dickson, Barbara Dorman, Bobby James, Junior Brown and Tom Aday. Staff present: City Manager Jim Jeffers, Assistant City Attorney David Blackburn, Director of Finance Norman Huggins, Director of Public Works Bill Hogge, Chief of Police Roy Osborne, and City Secretary Sheryl Owen. Visitors present: Cathy Donahue - K.V.O.P. Plainview Daily Herald. and Richard Orr - Fireworks Stand. City Manager Jim Jeffers explained the status on the fireworks stand as proposed by J. Pink Dickens. Council explained that no action would be taken until they had had a chance to talk to Mr. Dickens about such. Quino¥ street Drainage. City Manager Jim Jeffers explained that the thirty days were up on the consideration of the Quincy Street Drainage Project. Councilman Junior Brown agreed to talk to Mr. Peterson about such, and advised Mr. Peterson that the City would be pursuing any of his suggestions. Street Lights - Columbia. City Manager Jim Jeffers explained that · the City was still waiting for information from Southwestern Public Service. Sewer Rates. City Manager Jim Jeffers presented a rough draft of the Ordinance on the proposed sewer service rates to the City Council for study. Pro-rata Ordinanoe. Director of Public Works Bill Hogge made a presentation on the proposed Pro-rata Ordinance. He advised the Council to study the Ordinance and make any comments or changes. Work Session Meeting Place. It was consensus of the Council to change meeting places for the Work Sessions to the Plainview Country Club. City Manager Jim Jeffers presented the items for the Agenda for the April 14, 1987 Council Meeting: 1) INVOCATION 2) OPENIN~ OF COUNCIL: This meeting of the Plainview City Council is compliance with the Texas Open Meetings Law. being conducted in 1 of 3 3) Consideration on second and final reading of Ordinance NO. 8?-2694, entitled, "An Ordinance declaring public necessity for the improvement of a certain designated portion of a certain designated street in the City of Plainview, Texas specifying the nature and type of such improvement, establishing the manner of effectuation and method of procedure thereof, designating and separating a unit of work, allocating division of payment of cost, providing rule for apportionment of cost, fixing time, terms and conditions of payment of cost and providing and defining assessments therefore, specifying nature of assessment liens and personal liability, providing for issuance and provisions of assignable certificates in evidence of assessment for cost, and directing the City Engineer to monitor plans and specifications for the improvements of designated units and to publicly advertise for sealed competitive bids with specified cause." (Southwest Third Assessment Program) 4) Consideration on first reading Ordinance No. 87-2699 entitled, "An Ordinance relating to taxation of telecommunications services; repealing the application of the exemption provided for in Section 4B(a) of Article 1066C V.A.T.C.S.; providing for notification to the Comptroller of the State of Texas; providing that no such tax provided for hereunder shall serve as an offset to or to reduce 9ny amount payable by any provider of telecommunications service pursuant to any franchise, street use ordinance, charter provision, statutes or any other imposition of the City of Plainview; making this Ordinance cumulative; providing a severability clause; and providing for an effective date." 5) PUBLIC HEARING - Zone Case 547 - Request of Houston Hamby, on behalf of West Texas Gas, Inc., for rezoning 1601 Quincy from a Single Family Residential District to a Commercial Retail District. ALL NATTERS UNDER ITEM ~ CONSENT CALENDAR ARE CONSIDERED TO BE ROUTINE BY THE CITY COUNCIL ANDWILL BE ENACTED ON A MOTION IN THE FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE CLARIFICATION. ON OBJECTION BY ANY PARTY TO TwR INCLUSION OF ANY ITEM ON THE CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT CALENDAR. SUCH OBJECTION HAY BE RECORDED ANY TINE PRIOR TO THE TAKING OF A VOTE ON THE MOTION TO APPROVE THE CONSENT CALENDAR. ALL SUCH ITEMS SHALL BE CONSIDERED INDIVIDUALLY IN THE ORDER IN WHICH THEY ARE OBJECTED TO, IMMEDIATELY FOLLOWING THE CONSIDERATION OF THE CONSENT CALENDAR. 6 ) CONSENT CALENDAR a) Minutes b) Department Reports c) Budget Expenditures d) Consideration on Resolution No. R87-224 entitled, "A Resolution of the City Council of the City of Plainview, Texas authorizing the Director of Finance to change carriers as it pertains to the City of Plainview Workman,s Compensation Insurance Program." 2 of 3 e) Consideration on Resolution No. R87-23! entitled, "A Resolution of the City Council of the City of Plainview, Texas appointing Kimberly Lashawn Adams as Deputy City Secretary." f) Consideration on Resolution No. R87-232 entitled, "A Resolution of the City Council of the City of Plainview, Texas appointing members to various boards and committees of the City of Plainview." g) Consideration on second and final reading Ordinance No. "An Ordinance amending Chapter 32, , 87-2695 entitled, Traffic Plainview City Code prohibiting the parking of tractor trailers on public streets." h) Consideration on first reading Ordinance No. 87-2696 entitled, "An Ordinance amending Zoning Ordinance No. 82-2478 in the official zoning map of the City of Plainview, Texas so as to make the following changes: Zone Case No. 547, request of Houston Hamby on behalf of West Texas Gas, Inc., for rezoning of the South 14 feet of Lot 12, and all of Lots 13, 14 and 15, Block 1, High School Addition from an R-l(Single-Family Residential) zoning district to a CRD (Commercial Retail District) zoning district of for commercial uses and located at 1601 Quincy." i) Consideration on final reading Ordinance No. 87-269? entitled, "An Ordinance of the City Council of the City of Plainview, Texas to appropriate certain specific funds out of the 1980 Utility Bond Construction Fund for an approved project." j) Consideration of final reading Ordinance No. 87-2698 entitled, "An Appropriation Ordinance of the City Council of the City of Plainview, Texas appropriating funds from the Sanitation Depaxtment for the acquisition of equipment." 7) Executive Session: Discussion of the purchase or real property as authorized by Article 6252-17, Section 2(f). 8) Consideration of ReSolution No R87-233 entitled, . "A Resolution of the City Council of the City of Plainview, Texas authorizing the City Manager to submit a proposal for the purchase of real estate within the parameters discussed in Executive Session."
