MINUTES The Plainview City Council met in Regular Session on Tuesday, March 24, 1987, at 7:30 p.m. in the Council Chambers of City Hall with Mayor Ridlehuber presiding and the following Councilmembers present: Alton Jackson, Terry Clements, Don Dickson, Bobby James, Barbara Dorman, Junior Brown and Tom Aday. Staff present: City Manager Jim Jeffers, Director of Municipal Services Mike McDonough, Assistant City Attorney David Blackburn, Director of Public Works Bill Hogge, Chief of Police Roy Osborne, Director of Public Safety Johnnie Ballew, and City Secretary Sheryl Owen. Invocation was given and Mayor Ridlehuber welcomed opened the Meeting. the guest and Mayor Presented Ordinance No. 87-2691 on second and final reading, entitled, "An Ordinance of the City of Plainview, Texas adopting the 1987 Edition of the National Electrical Code (NFPA 70-1987) and repealing all provisions, editions of the National Electrical Code heretofore adopted; providing penalties for violation of this Ordinance; providing for severability clause; directing publication of the descriptive caption together with penalty provisions of this Ordinance; and providing for an effective date." 1 of 4 Director of Municipal Services Ordinance. It was then moved Councilman Clements to approve unanimously. Mike McDonough explained ~he by Councilman Aday seconded by the Ordinance. Motion carried Mayor Ridlehuber then welcomed the Frisco Neighborhood Committee to make public comment on the Frisco Addition to the City Council. Lionel Garica and the Frisco Neighborhood Committee spoke to the Council on improvements that they would like to be made to the Frisco Addition. A lengthy discussion was held, however, no action was taken. Mayor presented Ordinance No. 87-2694 on first reading entitled, "An Ordinance declaring public necessity for the improvement of a certain designated portion of a certain designated street in the City of Plainview, Texas specifying the nature and type of such improvement, establishing the manner of effectuation and method of procedure thereof, designating and separating a unit of work, allocating division of payment of cost, providing rule for apportionment of cost, fixing time, terms and conditions of payment of cost and providing and defining assessments therefore, specifying nature of assessment liens and personal liability, providing for issuance and provisions of assignable certificates in evidence for assessment for cost, and directing the City Engineer to monitor plans and specifications for the improvement of designated units and to publicly advertise for sealed competitive bids with specified clause." (Southwest Third ASsessment Program) Director of Public Works Bill Hogge explained Assistant City Attorney David Blackburn explained process for Southwest Third. Mr. Ralph Nafzger and Mrs. Oldfield spoke to the Council and indicated that they had promised previously that there would be no more cost to them they donated the land to the City. Council assured them that Would check into this. It was then moved by Councilman seconded by Councilman Brown to approve the Ordinance on reading. Motion carried unanimously. the Ordinance. the assessment Nolan been after they Aday first PUBLIC COMMENT - Tele-Communications Services: City Manager Jim Jeffers explained the excise tax of one percent on certain tele-communications services. Mr. Jeffers explained that certain tele-communications services were exempt from local sales tax. He indicated that as of October 1, cities were given the right to lift said exemption. No comments were made. Mayor Ridlehuber presented the following Consent Calendar and explained that Item E, Resolution No. R87-224 would be tabled from the Consent Calendar pending on further information on such: Consent Calendar: a) MinUtes b) Department Reports c) Budget Expenditures 2 of 4 d) Consideration of Resolution No. R87-223 entitled, "A Resolution of the City Council of the City of Plainview, Texas appointing members to various boards and committees of the City of Plainview." T/%BLED: e) Consideration of Resolution No. R87-224 entitled, "A Resolution of the City Council of the City of Plainview, Texas authorizing the Director of Finance to change carriers as it pertains to the City of Plainview Workman, s Compensation Xnsurance Program." f) Consideration of Resolution No. R87-225 entitled, "A Resolution of the Mayor and City Council of the City of Plainview, Texas accepting the resignation of Planning and Zoning Commissioner Antonio Garoia." g) Consideration of Resolution No. R87-227 entitled, "A Resolution of the City Council of the City of Plainview, Texas accepting resignation of Board of Adjustment Member Michael A. McDonald". h) Consideration of Resolution No. R87-228 entitled, "A Resolution of the City Council of the City of Plainview, Texas awarding a contract and authorizing the Mayor to enter into a contract for the construction of sanitary sewer and water main extensions on Southwest Third Street (FM 3466), Plainview, Texas." i) Consideration of Resolution No. R87-229 entitled, "A Resolution of the City Council of the City of Plainview, Texas approving the final plat of Bryan Addition, Unit No. 9, Plainview, Hale County, Texas." j) Consideration of Resolution No. R87-230 entitled, "A Resolution of the City Council of the City of Plainview, Texas authorizing the Director of Municipal Services to solicit proposals for updating and revising the City of Plainview Comprehensive Master Plan and Zoning Ordinance.,, k) Introduction and first reading of Ordinance No. 87-2695 entitled, "An Ordinance amending Chapter 32, traffic, Plainview City Code prohibiting the parking of tractor-trailers on public streets. 1) Consideration on second and final reading Ordinance No. 87--2693 entitled, "An Ordinance of the City of Plainview establishing a fund for self-insurance against property and liability claims; providing for future additions to said funds; providing for administrative action on certain claims and expenditures related to self-insurance." 3 of 4 Mayor Ridlehuber called for the motion to go into Executive Session, it was moved by Councilman Aday seconded by Councilman Brown to go into Executive Session. Motion carried unanimously. EXECUTIVE SESSION: Discussion of the purchase of real property authorized by Article 6252-17, Section 2(f). as Council reconvened at 9:25 P.M., it was moved by Councilman Brown seconded by Councilman Clements to adjourn the meeting.
