CITY COUNCIL MEETING

MINUTES
The Plainview City Council met in Regular Session on Tuesday,
January 12, 1988, at 7:30 p.m., in the Council Chambers of City
Hall, with Mayor E.V. Ridlehuber presiding. The following
Councilmembers were present: Alton Jackson, Terry Clements, Don
Dickson, Barbara Dorman, Junior Brown, Bobby James and Tom Aday.
Staff present were: James P. Jeffers, City Manager; Mike
McDonough, Director of Municipal Services; Bill Hogge, Director
of Public Works; Roy Osborne, Chief of Police; and City Secretary
Carla Reese.
News Media present were: Cathy Donahue - K.V.O.P., Richard Orr -
Plainview Daily Herald and Jamie Chavez - KLBK TV in Lubbock.
Guest present were: Carl Holland, Jesus Garza, Feliz Rodriguez,
Walter R. Jackson, Jimmy Garcia, Donna Loflin, Raymond Cisneros,
Freddie Benford, John Hooten, Billy Rawlinson, Del Essary, Mike
Evans, Larry Cornett,. Curtis Thomas, Manuel Castaneda, Arthur
Wall, Lesal McNutt, T.C. Collins Jr., Jim Adams and Don Pruitt of
the Plainview Ambulance Service.
Mayor E.V. Ridlehuber delivered the invocation and welcomed the
guest.
Mayor Ridlehuber recognized and commended employees of the City
Water, Sewer, Street and Sanitation Departments, and any other
departments that helped in working during the bad weather to empty
dumpster, fix broken water mains, work on streets and sand
intersections. Also Police and Fire Departments were commended
for working thru the bad weather.
~Z ORDINANCE. Jim Jeffers, City Manager, presented the EMS
Franchise Ordinance No. 88-2738, noting this replaces the
ordinance which has been in effect since 1958. This ordinance
establishes the Fire Department EMS, as the only emergency
ambulance, because of the advanced life support. The ordinance
has a provision to allow another ambulance service to operate on a
non-emergency basis. Don Pruitt of the Plainview Ambulance
Service, stated he felt the ordinance was very amendable and
acceptable. Councilman Tom Aday made a motion to approve
Ordinance No. 88-2738 on the first reading. Motion was duly
seconded by Councilman Clements, and carried by a unanimous vote.
ALAR~ ORDINANCE. Roy Osborne, Chief of Police, presented the
Alarm Ordinance, noting the purpose of this ordinance was to
control false alarms. There is a provision in this ordinance

after six false alarms at each site, there will be assessed a
$10.00 fine per alarm up to twelve alarms. After twelve alarms
the permit could be revoked. There will be a police monitoring
fee of $5.00 per month, per alarm device, and a permit fee of
$10.00 for a two years permit. Councilman Terry Clements
commented if false alarms caused by severe weather were taken into
consideration, Roy Osborne, Chief of Police advised they would not
consider an alarm false when caused by severe weather, telephone
line outage and entry for attempted robbery. Councilwoman Barbara
Dorman made a motion to call a public hearing. Motion was duly
seconded by Councilman Tom Aday.
Mayor Ridlehuber presented the reading of Alarm Ordinance No.
88-2737 for public hearing. No members were present in favor or
who objected to Alarm Ordinance No. 88-2737. Councilman Terry
Clements made a motion to close the public hearing. Motion was
duly seconded by Councilman Aday and carried by a unanimous vote.
Councilwoman Dorman made a mOtion to approve Alarm Ordinance No.
88-2737 on the first reading. Motion was duly seconded by
Councilman Don Dickson and carried by a unanimous vote.
Mayor Ridlehuber presented the following Consent Calendar with the
Agenda Addendum.

d) PLAT-FINAL CITY ADDITION. Resolution No. R87-317
entitled, "A Resolution of the City Council of the City of
Plainview, Texas approving the final plat of City Addition, Unit
No. 2, Plainview, Hale County, Texas."
e) STREET LIGHTS. Resolution No. R88-100 entitled, "A
Resolution of the City Council of the City of Plainview, Texas
discontinuing street lights within the City." (Midblock on Joliet
Street between 7th and 8th Street; and Midblock on Kokomo Street
between 7th and 8th Street)
f) BOARDS, COMMISSIONS AND COMMITTEE APPOINTNRNTS.
Resolution No. R88-101 entitled, "A Resolution of the Mayor and
the City Council of the City of Plainview, Texas appointing
various individuals to serve on the various Boards, Commissions
and Com~aittees of the City of Plainview." (Planning and Zoning
Commissions and Board of Adjustment)
g) STREET USE PERMIT - BUCHANAN AGENCY. Consideration of
Resolution No. R88-102, entitled, "A Resolution of the City
Council of the City of Plainview, Texas authorizing the Mayor to
execute a street use agreement with the Buchanan Agency involving
properties at 121 East 7th and 120 East 7th."

h) MONICIPAL COURT WARRANT OF ARREST AND DRIVING SAFETY
COURSE. Consideration on first reading Ordinance No. 88-2734
entitled, "An Ordinance of the City of Plainview, Texas amending
Article 10, municipal court, of the Plainview City Code by adding
Section 2-231 relating to fines and special expenses to
incorporate changes made in State Law as more fully set out
herein; providing for expenses and an effective date."
i) LIABILITY PLAN - OFFICER AND EMPLOYEE. Consideration on
first reading Ordinance No. 88-2735 entitled, "An Ordinance of the
City of Plainview, Texas amending Chapter 4, "Administration",
Article 12, "officer and employee liability plan", of the
Plainview City Code, as amended; amending a provision regarding
the limits of coverage as such are set forth by State Law; and
providing an effective."
AGENDA ADDENDUM
Consideration of Resolution No. R88-103 entitled, "A Resolution of
the City Council of the City of Plainview, Texas authorizing the
submission of a Texas Emergency Shelter Grants Program Application
to the Texas Department of Community Affairs and Authorizing the
Mayor to act as the City's executive officer and authorized
representative in all matters pertaining to the City's
participation in the Emergency Shelter Grants program."
Councilman Terry Clements made a motion to approve the Consent
Calendar with the Agenda Addendum. Motion was duly seconded by
Councilman Tom Aday, and carried by a unanimous vote.

Motion was duly seconded by Councilman Tom Aday and carried by a
unanimous vote.
There being no further business, Mayor E.V. Ridlehuber adjourned
the Meeting at 7:47 p.m.
