M I N U T E S The Plainview City Council met in Regular Session on Tuesday, March 22, 1988, at 7:30 p.m., in the Council Chambers of City Hall with Mayor E.V. Ridlehuber presiding. The following Councilmembers were present: Alton Jackson, Terry Clements, Don Dickson, Bobby James, Junior Brown and Tom Aday. Councilmember Barbara Dorman was absent. Staff present were: James P. Jeffers, City Manager; Bill Hogge, Director of Public Works; Mike McDonough, Director of Municipal Services, Norman Huggins, Director of Finance; David Blackburn, Assistant City Attorney; Roy Osborne, Chief of Police and City Secretary iCarla Reese. News Media present: Richard Orr - Plainview Daily Herald. Guest present: Michael D. Holton, Don Pruitt, Ricky Howard, Louise Ray, and Lionel Garcia. Councilman Terry Clements delivered the invocation. Mayor E.V. Ridlehuber welcomed the guest. AMBULANCE FRANCHISE. Jim Jeffers, City Manager presented the request ofi Plainview Ambulance Service for an ambulance franchise. Councilman Terry Clements made a motion to call a public hearing. Motion was duly seconded by Councilman Junior Brown. Mayor E.V. Ridlehube~ called a public hearing. Don Pruitt spoke on behalf of the PlainView Ambulance Service noting he believed they met all the requirements as stated in the franchise and asked the Council to give Plainview Ambulance Service a favorable decisionby approving the franchise. Councilman Don Dickson made a motion to close the public hearing. Motion was duly seconded by Councilman Terry Clements. Councilman Terry Clements made a motion to instruct staff to prepare the necessary ordinance approving the PlainviewI Ambulance franchise. Motion was duly seconded by Councilman Junior Brown and carried by a unanimous vote. ELECTRICAL CODE. Mike McDonough, Director of Municipal Services presented the first reading of Ordinance No. 88-2747 entitled, "An Ordinance of the City of Plainview, Texas amending the Electrical Code of the City of Plainview, Texas, (Ordinance No. 84-2550), specifying requirement for wiring encased in metal raceways requirements of electrical ranges and clothes dryers, outlets per circuits electrical raceways, direct burial cable directing publication of the descriptive caption of this ordinance with penalty provisions of the Electrical Code and providing for an effective date of the ordinance." Mike McDonough, Director of Municipal Services noted that the Electrical Code was based on the National Electrical Code and was updating changes through the past few years. Electrical Board has held several public hearings in the process of updating the Electrical Code. The Electrical Board 048 unanimously recommended the changes in the Electrical Code be brought before the Council for approval. Councilman Tom Aday made a motion to approve Ordinance No. 88-2747 on first reading. Motion was duly seconded by Councilman Terry Clements and carried by a unanimous vote. BUILDING CODE - TRENCHING. Mike McDonough, Director of Municipal Services presented the first reading of Ordinance No. 88-2748 entitled, "An Ordinance of the City of Plainview, Texas amending Chapter 6, Article 2, of the City of Plainview Code of Ordinances entitled Building Code of the City of Plainview, Texas for the purpose of including trench excavation requirements within the Building Code of the City of Plainview in accordance with State Law, directing publication of the descriptive caption of this ordinance with penalty provisions from the Building Code, and providing for an effective date of this ordinance." Mike McDonough, DireCtor of Municipal Services noted State Law requires the building codes, where excavation of a trench over five foot in depth meets OSHA requirements. The changes in the Building Code will require all trenches within the City, or jurisdiction of the City to meet State and OSHA requirements. City will not require a permit, nor will not be responsible for any inspection of trenches. Motion was made by Councilman Tom Aday to approve Ordinance No. 88-2748 on first reading. Motion was duly seconded by Councilman Junior Brown and carried by a unanimous vote. Mayor E.V. Ridlehuber presented the following Consent Calendar for approval, noting on Item d) Boards, Commissions and Committee Appointments, that Ken Douglass and Rudy Mendoza have been appointed to the Plainview Housing Authority Board, and Item 1) Bid - Fire Alarm City Hall has been awarded to National Guardian Security Services for approval of the low bid. Resolution No. R88-110 entitled, "A Resolution of the City Council of the City of Pla±nview, Texas appointing various individuals to serve on the various Boards, Commissions and Committees of the City of Plainview. (Tabled from City Council Meeting of February 23, 1988). e) TRAFFIC SAFETY COMMITTEE - REPEAL. Ordinance. No. 88-2742. Second reading. Entitled, "An Ordinance repealing Article II, Division 2 Sections 23-31 through 23-42, "traffic safety committee", of the Plainview City Code and; providing for an effective date." f) 911 Emergency Telephone Number. Resolution No. R88-112. A Resolution of the City Council of the City of Plainview, Texas supporting the establishment of an enhanced 911 Emergency Telephone Number and the implementation of the 911 fee and surcharge and election to participate in the 911 Regional Plan in accordance with Article 1432f. O0 043 g) Goals and Timetables. Resolution No. R88-113. A Resolution of the City CounCil of the City of Plainview, Texas establishing goals and timetables for their completion for the City of Plainview. h) Street Light Discontinuance - Unit 4 - Date Street. Resolution No. R88-113. A Resolution of the City Council of the City of Plainview, Texas authorizing the permanent removal of street lights in "Unit 4", with the majority of such being located on Date Street. i) Airport - Runway Extension. Resolution No. R88-115. A Resolution of the City Council of the City of Plainview, Texas authorizing the Mayor and/or the Airport Board, to enter into a contract for engineering services with Parkhill, Smith & Cooper for the~construction of runway and taxiway improvements. j) Reappointing Municipal Court Judge. Resolution No. R88-116. A Resolution of the City Council of the City of Plainview, Texas authorizing reappointing Judge Barbara Sullivan as Municipal Court Judge for the City of Plainview and Teen Court Coordinator. k) Mosquito Aerial Spraying. Resolution No. R88-117. A Resolution of the City Council of the City of Plainview, Texas exercising the City's option to renew and extend a contract for aerial spraying for mosquito control with Southwest Aerial Services, Inc. for the 1988 Season. 1) Bid - Fire Alarm City Hall. Resolution No. R88-118. A Resolution of the City Council of the City of Plainview, Texas awarding a bid for a fire alarm system for City Hall. 7) Executive Session. Executive Session to discuss litigation as authorized by Article 6252-17 Section 2(e). "Alexander v. City of Plainview; Barnett v. City of Plainview." Councilman Tom Aday made a motion to approve the Consent Calendar as stated. Motion was duly seconded by Councilman Terry Clements and carried by a unanimous vote. Councilman Tom Aday made a motion to adjourn into Executive Session. Motion was duly seconded by Councilman Terry Clements and carried by a unanimous vote. There being no further business, Mayor E.V.
