CITY'COUNCIL MEETING

MINUTES
The Plainview City Council met in Regular Session on Tuesday,
April 12, 1988, at 7:30 P.M., in the Council Chambers of City Hall
with Mayor E.V. . Ridlehuber presiding. The following
Councilmembers were present: Alton Jackson, Terry Clements, Don
Dickson, Bobby James, Junior Brown, Barbara Dorman and Tom Aday.
Staff present were: James P. Jeffers, City Manager; Bill Hogge,
Director of Public Works; Mike McDonough, Director of Municipal
Services; David Blackburn, Assistant City Attorney; Joe Ferguson,
Fire Chief; Roy Osborne, Chief of Police; Barbara Sullivan,
Municipal Court Judge and City Secretary Carla Reese.

Director of Municipal Services delivered the
Mayor E.V. Ridlehuber welcomed the guest.
Mayor E.V. Ridlehuber presented, Barbara Sullivan, Municipal Court
Judge who recognized the Teen Court and Student Government Day
Kids by presenting, them certificates. Doug Wooley a member of
Teen Court presented Mayor E.V. Ridlehuber a gavel for being Teen
Court Judge. Barbara Sullivan, Municipal Court Judge thanked the
Council for their support and Teen Court Members presented each
Councilmember with a key chain.
AUSTIN HEIGHTS. Mike McDonough, Director of Municipal Services
presented request for improvements in the Austin Heights area.
Mote Mill was first item of concern. Mike McDonough, Director of
Municipal Services advised that Code Enforcement had been looking

into the problems at the mote mill and that he had been in contact
with Gerald Hudson of the Texas Air Control Board and he had also
been looking into the problem. Mr. Gerald Hudson of the Texas Air
Control Board also advised that since the fire at the mote mill
Triangle Manufacturing (owner of the mote mill), was not planning
to re-open. Triangle Manufacturing has begun meeting the code
enforcement requirements the City has requested, and Texas Air
Control Board has advised they will not be issued a permit to
re-open. City Staff will continue to monitor the mote mill for
any violation of City Code. Con~ector Street to connect Austin
Heights area with the City to the West. One of the requested
areas of a connector street is Givens Street with 21st Street.
The other connector street is 16th Street with Campbell Street.
City staff feels that 16th Street and Campbell Street is the most
economical and accessible route for a connector street. Total
projected cost for the connector street being $133,200.00, which
includes appraisal cost of $2,500.00, since City does not own
right-of-way, estimated acquisition cost of $65,500.00, to obtain
said right-of-way, and paving and associated cost of $55,200.00.
There will be no relocation charge since said property is not
presently occupied. Train Blocking. Roy Osborne, Chief of Police
stated the City has an ordinance which prohibits trains from
blocking any street or crossing for a period longer than five
minutes, with exemption for trains that are thru trains and take
longer than five minutes to clear the intersection. The ways this
ordinance can be enforced are, a police officer observes the train
blocking the intersection for a period longer than five minutes,
or for a citizen to observe the train blocking the intersections
for an extended period of time and call for a police officer to
come to that location, and the officer observe the train blocking
the intersection for a period longer than five minutes, then the
officer will take enforcement action, or if a citizen has waited
at a intersection for a period longer than five minutes they may
come to the Municipal Court and file charges against that
particular railroad. The following information will be required
in order to file charges in Municipal Court; location of
occurrence, time when train was blocking intersection, railway,
and if possible a train number, with this information, Municipal
Court and the City Attorney will draw up the necessary complaint
to take action against said railway. The person filing the
complaint will be required to provide testimony in court. The
conductor of the train can be fined up to $200.00 for blocking
intersections for extended periods of time. Ozell Shaw, 211 E.
Brazier, stated he was concerned with the location of the
connector street, where the mote mill buildings would be located
on both sides of the street. Mike McDonough, Director of Municipal
Services advised Mr. Shaw the figures for the connector street did
not included the purchase of the mote mill buildings. Mr. Shaw
noted he thought a different location for the connector street
would be better. Mike McDonough, responded the City felt the most
accessible and economical route for a connector street would be
from 16th to Campbell. Councilman Tom Aday made a motion to
pursue inquires for the connector street from 16th to Campbell,

and make inquiries into grant funds which are available. Motion
was duly seconded by Councilwoman Barbara Dorman and carried by
unanimous vote. Jim Jeffers, City Manger pointed out as a
clarification for the Austin Heights residents, that grants come
from the State and .are awarded on a competitive basis, and the
City will pursue the grants but whether or not the grant will be
funded is not within the City's control, and would be difficult.
PARKS - SOFTBALL - COMPLEX LEASE. Mike McDonough, Director of
Municipal Services presented Resolution R88-121, entitled, "A
Resolution of the City Council of the City of Plainview, Texas
awarding a bid and authorizing the Mayor to execute a lease
agreement for the use of the Running Water Draw Regional Park
Softball Complex." Noting this Resolution deals with the bids
allowing the Mayor to authorize a lease agreement for the Running
Water Draw Regional Park Softball Complex. Bids were received
from Plainview Softball Association and YMCA. In the Plainview
Softball Association bid they agreed to pay for electrical
services at the facilities during the baseball season at 100% of
the cost up to $800.00, and also stated they would provide up to
100% of the cost of replacement of light bulbs up to a total of
$300.00. Will provide $1,000,000.00 of liability insurance, with
City only requesting limits of $500,000.00. In the bid received
from the YMCA they agreed to pay for electrical services at the
facility at 75% of the cost or up to $500.00, and replacement of
bulbs at 50% of the cost, or up to $500.00. Will provide a
$500,000.00 liability insurance policy. With Council's direction,
staff discussed with Plainview Softball Association their
specifications along with what the City was proposing. City
proposed to lease all three lighted fields. Plainview Softball
Association requested the foUrth unlighted field be included in
lease which Council agreed to. City proposed the mowing of
outfields would be done on a regular schedule, if outfields needed
mowing more often than their schedule permitted, the persons
awarded the bid would be responsible for the mowing at their own
expense. Plainview Softball Association stated in their proposal
they would do the mowing at the City's expense, but subsequently
they have withdrawn this proposal. Alcohol regulation was not put
in the lease agreement, it will be left up to the lessee to
determine what alcohol regulations they will require. Debbie
Belk, President of Plainview Softball Association has reviewed the
lease agreement with the changes that have been made. Debbie
Belk, President of Ptainview Softball Association noted the
Plainview Softball Association is ready to get started and to work
with the City. Councilman Tom Aday made a motion that the lease
be awarded to the Plainview Softball Association. Motion was duly
seconded by Councilman Terry Clements and carried by unanimous
vote.
Mayor E.V. Ridlehuber presented the following Consent Calendar for
approval. Motion was made by Councilwoman Barbara Dorman to table
Item I) Boards, Commission and Committee Appointments. Motion
was duly seconded by Councilman Tom Aday and carried by unanimous
vote.

d) ELECTRICAL CODE. Second and final reading of Ordinance
No. 88-2747. An ordinance of the City of Plainview, Texas
amending the Electrical Code of the City of Plainview, Texas,
(Ordinance No. 84-2550), specifying requirement for wiring encased
in metal raceways; requirement of electrical ranges and clothes
dryers; outlets per circuits; electrical raceways; direct
burial cables; directing publication of the descriptive caption
of this ordinance with penalty provisions of the Electrical Code;
and providing for an effective date of the ordinance.
e) BUILDING CODE - TRENCH EXCAVATION REQUIREMENTS. Final
reading of Ordinance No. 88-2748. An ordinance of the City of
Plainview, Texas, amending Chapter 6, Article 2, of the City of
Plainview Code of Ordinances entitled Building Code of the City of
Plainview, Texas, for the purpose of including trench excavation
requirements within the Building Code of the City of Plainview in
accordance with State Law; directing publication of the
descriptive caption of this ordinance with penalty provisions from
the Building Code; and providing an effective date of this
ordinance.
f) EMS - FRANCHISE - PLAINVIEW AMBULANCE SERVICE. First
reading of Ordinance No. 88-2750. An ordinance granting a
franchise to Plainview Ambulance Service to operate an
non-exclusive non-emergency transfer ambulance service.
g) PARKS - SOFTBALL - OPTIMIST CLUB. Resolution No.
R88-120. A Resolution of the City Council of the City of
Plainview, Texas authorizing the Mayor to execute a lease
agreement and a concession agreement with the Optimist Summer
Baseball Program.
h) BIDS - SEALCOAT MATERIALS. Resolution No. R88-122. A
Resolution of the City Council of the City of Plainview, Texas
awarding bids for sealcoat materials.
TABLED i) BOARDS, COMMISSIONS AND COMMITTEES APPOINTMENTS.
Resolution No. R88-123. A Resolution of the City Council of the
City of Plainview, Texas appointing various individuals to serve
on the various Boards, Commissions and Committees of the City of
Plainview.
j) BIDS - VEHICLES. Resolution No. R88-124. A Resolution
of the City Council of the City of Plainview, Texas awarding bids
for various vehicles.
k) BUDGET - RESERVE POLICY. Resolution No. R88-125. A
Resolution of the City Council of the City of Plainview, Texas
establishing a Budget Reserve Policy.

Councilwoman Barbara Dorman made a motion to approve the Consent
Calendar as stated. Motion was duly seconded by Councilman Tom
Aday and carried by unanimous vote.
EXECUTIVE SESSION.
Councilman Terry Clements made a motion to adjourn into Executive
Session. Motion was duly seconded by Councilman Tom Aday and
carried with unanimous vote.
Mayor E.V. Ridlehuber reconvened
Executive Session at 10:20 p.m.

LITIGATION STATEMENT. Mayor E.V. Ridlehuber announced that no
statement would be made.
PERSONNEL - SALARY ADJUST~F. NTS. Councilman Junior Brown moved
that Resolution No. R88-119 entitled, "A Resolution of the City
Council of the City of Plainview, Texas implementing salary
adjustments", be tabled. Motion was duly seconded by Councilman
Terry Clements and carried by unanimous vote.
ADJOURNMENT. Councilwoman Barbara Dorman made a motion for the
meeting to be adjourned. Motion was duly seconded by CoUncilman
Junior Brown and carried by a unanimous vote. There being no
further business Mayor E.V~ Ridlehuber adjourned the meeting at
10:25 p.m. ~~
