MINUTES The Plainview City Council met in Regular Session on Tuesday, May 10, 1988, at 7:30 p.m. in the Council Chambers of City Hall with Mayor E.V. Ridlehuber presiding. The following Councilmembers were present: Alton Jackson, Terry Clements, Don Dickson, Bobby James, Junior Brown, Barbara Dorman and Tom Aday. Staff present were: James P. Jeffers, City Manager; Bill Hogge, Director of Public Works; Mike McDonough, Director of Municipal Services; David Blackburn, Assistant City Attorney; Norman Huggins, DirectOr of Finance; Roy Osborne, Chief of Police; and Carla Reese, City Secretary. Guest present: Winfred Walker, Terrisu Sims Mann, Richard Mann, Mrs. Tom Cappington, Albert Perez, Sidney Jackson, Dwight Jacobs, Jan Owen, Mr. & Mrs. Gene Owen and Dr. John Dorman. Councilman Tom Aday delivered the invocation. Mayor EoV. Ridlehuber welcomed the guest. ELECTION RETURNS - CANVASS. Mayor E.V. Ridlehuber presented Resolution No. R88-144 A Resolution of the City Council of the City of Plainview, Texas ordering the canvass of election returns and declaring the results of the City Election held on May 7, 1988. On the 10th day of May, 1988, the City Council of the City of Plainview, Texas, convened at the regular meeting place thereof with the following members present to wit: Alton Jackson, Terry Clements, Don Dickson, Bobby James, Barbara Dorman, Junior Brown and Tom Aday. and the following were absent: None Constituting a quorum, and among other proceedings had were the following: Councilmember Tom Aday introduced a Resolution and ordered and moved its adoption. The motion was seconded by Councilmember Bobby James, and the motion carrying with the adoption of the Resolution and order prevailed by the following vote, ayes: 7 noes: 0 The Resolution is as follows: There came on to be considered the returns of an election held on the 7th day of May, 1988, for the purpose of electing the hereinafter named officials, and it appearing from said returns, duly and legally made, that there were cast at said election 422 valid and legal votes: that each of the candidates in said election received the following votes: For Councilmember Precinct 5 Barbara J. Dorman 175 Write-In 7 For Councilmember Precinct 6 Junior Brown 87 Write-In 4 For Councilmember Precinct 7 Ross Owen 92 Castro Perez 56 Write-In 1 THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLA.INVIEW, TEXAS: That said election was duly called; that notice of said election was given in accordance with law, and that said eleCtion was held in accordance with law, and that: Section 1: Barbara J. Dorman was duly elected Councilmember for Precinct 5 on the City Council of the City of Plainview, and that Barbara J. Dorman is hereby declared elected to said office of Councilmember for Precinct 5 on the City Council of the City of Plainview, subject to the taking of the Oath of Office as provided by the laws of the State of Texas; and Section 2: Junior Brown was duly elected Councilmember for Precinct 6 on the City Council of the City of Plainview, and that Junior Brown is hereby declared elected to said office of Councilmember for Precinct 6 on the City Council of the City of Plainview, subject to the taking of the Oath of Office as provided by the laws of the State of Texas; and 078 Section 3: Ross Owen was duly elected Councilmember for Precinct 7 on the City Council of the City of Plainview, and that Ross Owen is hereby declared elected to said office of Councilmember for Precinct 7 on the City COuncil of the City of Plainview, subject to the taking of the Oath of Office as provided by the laws of the State of Texas. OATH OF OFFICE. Mayor E.V. Ridlehuber had the three elected Councilmembers, Barbar~ Dorman, Junior Brown and Ross Owen take their Oaths of Office swore each one into their positions as Councilmembers. ZONE CASE NO. 553. McDonough, Director of Municipal Services presented Zone Case N(. 553 noting the request of Terrisu Sims Mann for rezoning 1315 Quincy, Plainview, Texas, from an R-1 (Single-Family Residential) to C.R.D. (Commercial Retail) Zoning District. McDonough noted that along Quincy were many businesses which were zoned C.R.D. (Commercial Retail). Letters have been mailed and a notice posted of the request to rezone this property from Single-Family Residential to Commercial Retail and no complaints have been received. Councilman Don Dickson made a motion to call a public hearing. Motion was duly seconded by Councilman Terry Clements and carried by a unanimous vote. Terrisu Sims Mann, 1315 Quincy, Plainview, spoke in favor of the rezoning noting she had the same type of business in Snyder and it was a very good business. She felt her business on Quincy Street would benefit the other business located on Quincy Street. Mann advised she had talked with each of her neighbors personally and none had any problems with her locating a business in her residence. Motion was made by Councilman Junior Brown to close the public hearing. Motion was duly seconded by Councilman Terry Clements and carried by unanimous vote. Mayor E.V. Ridlehuber presented the following Consent Calendar for approval noting Item i) Plumbing Board Appointment was tabled. An Ordinance of the City of Plainview, Texas, amending the Plumbing Code of the City of Plainview, Texas (Ordinance No. 85-2587), prohibiting the use of any lead pipes, solder, or flux in the installing or repair of any plumbing in a residence or non-residential plumbing system which provides water for human consumption; directing the publication of the descriptive caption of this ordinance with penalty provisions of the Plumbing Code; and providing for an effective date of this ordinance. An Ordinance amending Zoning Ordinance No. 82-2478 an the official zoning map of the City of Plainview so as to make the following changes: request of Terrisu Sims for rezoning Lots 4 and 5, Block 2, Sunset Heights Subdivision from an R-1 (Single-Family Residential) Zoning District to a C.R.D. (Commercial Retail) Zoning District for commercial uses and located at 1315 Quincy. f) STREET LIGHT DISCONTI~3ANCE - TEMPORARY - UNIT 6 - AUSTIN AND BALTIMORE STREETS. Resolution No. R88-132. A Resolution of the City Council of the City of Plainview, Texas temporarily discOntinuing a portion of the street lighting in "Unit 6", primarily on Austin and Baltimore Streets. g) STREET LIGHT DISCONTINUANCE - TEMPORARY - UNIT 7 - SCHOOL LIGHTS. Resolution No. R88-133. A Resolution of the City Council of the City of Plainview, Texas temporarily discontinuing a portion of the street lighting in "Unit 7", primarily street lights around schools. h) STREET LIGHT DISCONTINUANCE - TEMPORARY - MISC~US. Resolution No. R88-134. A Resolution of the City Council of the City of Plainview, Texas temporarily discontinuing a portion of the street lighting in "miscellaneous" areas. TABLED i) PLUMBING BOARD - APPOINT~F. NT. Resolution No. R88-135. A Resolution of the City Council of the City of Plainview, Texas appointing an individual to serve on the Plumbing Board of the City of Plainview. j) TELEPHONE - PHONE BILLING EXAMINERS CONTRACT. Resolution No. R88-136. A Resolution of the City Council of the City of Plainview, Texas authorizing the Mayor to execute a contract with Phone Billing Examiners (PBX) auditing the City telephone billings. k) BUDGET POLICY - 5 YEAR ADOPTION PROCESS. Resolution No. R88-138. A Resolution .of the City Council of the City of Plainview, Texas eStablishing a policy for the adoption of a 5 Year Budget on an annual basis. 1) LIBRARY BOARD - APPOINTMENT. Resolution No. R88-139. A Resolution of the City Council of the City of Plainview, Texas appointing an individual to serve on the Library Board of the City of Plainview. 6) EXECUTIVE SESSION. Executive Session to discuss pending litigation as authorized by Article 6252'17 Section 2(e). (Alexander v. City of Plainview) Executive Session to discuss personnel as authorized by Article 6252-17 Section 2(g). (Assistant City Attorney). 7) LITIGATION STATEMENT. pending litigation. Issuance of a statement concerning O0 085 8) PERSONNEL - SALARY ADJUSTMENTS. Resolution No. R88-119. A Resolution of the City Council of the City of Plainview, Texas implementing salary adjustments. (This item was tabled from the previous Council Meeting) 9) CIT~ ATTORNEY - APPOI~VIIw~%~T. Resolution No. R88-140. A Resolution of the City Council of the City of Plainview, Texas appointing David Alan Blackburn as City Attorney for the City of Plainview, Texas. 10) CITY ATTORNEY - CO~WI~ACT. Resolution No. R88-141. A Resolution of the City Council of the City of Plainview, Texas authorizing the Mayor to execute a contract for services with the City Attorney. Motion was made by Councilwoman Barbara Dorman to approve the Consent Calendar as stated. Motion was duly seconded by Councilman Junior Brown and carried by unanimous vote. EXECUTIVE SESSION. Ridlehuber presented Resolution No. R88-140. A Resolution of the City Council of the City of Plainview~ Texas appointing David Alan Blackburn as City Attorney for the City of Plainview, Texas. Motion was made by Councilman Bobby James to appoint David Alan Blackburn as City Attorney. Motion was duly seconded by Councilman Terry Clements and carried by unanimous vote. Mayor E.V. Ridlehuber had David Alan Blackburn take the Oath of Office for City Attorney and swore him in. CITY ATTORNEY - CONTRACT. Mayor E.V. Ridlehuber presented Resolution No. R88-141. A Resolution of the City Council of the City of Plainview, Texas authorizing the ~Mayor to execute a contract for services with City Attorney. Motion was made by Councilman Bobby James to execute the contract for City Attorney services. Motion was duly seconded by Councilman Junior Brown and carried by unanimous vote. ADJO~.
