MINUTES The Plainview City Council met in Regular Session, Tuesday, June 14, 1988, at 7:30 P.M. in the Council Chambers at City Hall with Mayor E.V. Ridlehuber presiding. The following Councilmembers were present: Alton Jackson, Don Dickson, Bobby James, Junior Brown, Barbara Dorman, Ross Owen and Terry Clements. Staff present were: James P. Jeffers, City Manager; Bill Hogge, Director of Public Works; Mike McDonough, Director of Municipal Services; Norman Huggins, Director of Finance; David Blackburn, City Attorney; Roy Osborne, Chief of Police and Carla Reese, City Secretary. News media present: Richard Orr - Plainview Daily Herald. Guest present: J.B. Wheeler, Katherine Wheeler, Perry Francess, Jack Oswald, Medlin Carpenter, Jeff Ewrtham, Norman Mourey, Barbara Sullivan, Ricky Sizemore, Jerry Murry, Jeff Boldin, Jacob Masso, Kemp Hinch, Bill Eaves, James Thomas, Juanita McElroy, Tom Culp, Bruce Crawford, John Warrick, Austin Ragland, Ralph Bates, Jr., H. Paul Holdridge, Randy Warrick, Albert Perez, John Roberts, Betty Hurt, Steve Hurt, Lyn Kirchhoff and Bob Kirchhoff. Councilman Terry Clements delivered the invocation. Mayor E.V. Ridlehuber welcomed the guest. Mayor E.V. Ridlehuber presented the following Consent Calendar for approval, noting item d) Plumbing Board - Appointment and item g) Human Relations Commission - Appointment has been tabled, item h) Street Light Discontinuance - Unit 2 - Broadway Street is being pulled from the Consent Calendar for further discussion. A Resolution of the City Council of the City of Plainview, Texas appointing individuals to serve on the Human Relations Commission of the City of Plainview. PULLED h) STREET LIGHT DISCONTINUANCE - UNIT 2 - BROADWAY STREET. Resolution No. R88-151. A Resolution of the City Council of the City of Plainview, Texas authorizing the permanent removal of street lights in "Unit 2", on Broadway Street. i) ELECTRICAL BOARD - REMOVAL FROM OFFICE. Resolution No. R88-152. A Resolution of the City Council of the City of Plainview, Texas removing Hal Wesley from the Board of Electrical Examiners. j) LOADING AND UNLOADING ZONES. Resolution No. R88-153. A Resolution of the City Council of the City of Plainview, Texas approving loading and unloading zones. k) SOUTHWES~ PUBLIC SERVICE - ELECTRIC BILLING EXAMINERS CONTRACT. Resolution No. R88-154. A Resolution of the City Council of the City of Plainview, Texas authorizing the Mayor to execute a contract with Phone Billing Examiners (PBX) auditing the City electrical billings. 4) EXECUTIVE SESSION. Executive Session to discuss pending litigation as authorized by Article 6252-17 Section 2(e). (Alexander vs. City of Plainview.) 5) LITIGATION STATE~mm~. pending litigation. Issuance of a statement concerning EXECUTIVE SESSION. Executive litigation as authorized by (Alexander vs. City of Plainview). Session to discuss pending Article 6252-17 Section(e). Councilman Don Dickson made a motion to approve the Consent Calendar as stated. Motion was duly seconded by Councilman Terry Clements and carried by a unanimous vote. STREET LIGHT DISCONTINUANCE - UNIT 2 - BROADWAY STREET. Mayor E.V. Ridlehuber'presented Resolution No. R88-151. A Resolution of the City Council of the City of Plainview, Texas, authorizing the permanent removal of street lights in "Unit 2" on Broadway Street, noting this is not a public hearing but will let the citizens speak their pro's and con's concerning this matter. Speaking against the street lights being discontinued on Broadway Street were: Jack Oswald, 513 West 7th Street; J.B. Wheeler, 216 Northwest Alpine Drive; Bruce Crawford, 1315 Pleasant Hill Drive; 2 of 3 O0 09? Medlin Carpenter, 401 Mesa Circle; Randy Warrick, 815 E1 Paso; Steve Hurt, 1000 West llth; Austin Ragland, Westridge Square; John Warrick, 312 Juanita; Lyn Kirchh°ff'l~-'.~n 1000 West llth; Juanita McElroy, 2620 We~t 2; After BettYa lengthy Hurt, discusSion councilman Junior Brown made a motion to turn on the lights on Broadway Street. Motion was duly seconded by Councilman Alton Jackson. Motion failed with Councilmembers Junior Brown and Alton Jackson for turning the lights on and Councilmembers Terry Clements, Don Dickson, Bobby James, Barbara Dorman, and Ross Owen against turning the lights back on, 2 ayes and 5 nayes. Councilman Terry Clements made a motion to approve Resolution No. R88-151 Street Light Discontinuance - Unit 2 - Broadway Street. Motion was duly seconded by Councilman Bo~y James. Motion passed with' Councilmembers Terry Clements, Don Dickson, 'Bobby James, Barbara Dorman and Ross Owen for approving Resolution No. R88-151, -Councilmembers Alton Jackson and Junior~ Brown voted against approving Resolution No. R88-151, 5 ayes and 2 nayes. Mayor E.V. Ridlehuber vetoed Resolution No. R88-151for further study. Councilwoman Barbara Dorman made a motion to adjourn to Executive Session. Motion was duly seconded by Councilman Terry Clements and carried by a unanimous vote. Mayor E.V. Ridlehuber reconvened Session at 9:27 p.m. the meeting from Executive LITIGATION STATE~mm~. Mayor E,V. Ridlehuber announced there would be no statement pertaining to the pending litigation. ADJOURNMENT. Councilman Don Dickson made a motion the meeting be adjourned, motion was duly seconded by.Councilwoman Barbara Dorman and carried by a unanimous vote. There being no further business Mayor E.V.
