MI~S The Plainview City Council met in Work Session on Thursday, October 6, 1988, at 11:30 a.m. at the Plainview Club with Mayor E.V. Ridlehuber presiding. The following Councilmembers were present: Terry Clements, Bobby James, Junior Brown, Don Dickson and Barbara Dorman. Councilmembers Alton Jackson and Ross Owen were absent. Staff present: James P. Jeffers, City Manager, Bill Hogge, Director of Public Works; Mike McDonough, Director of Municipal Services; Norman Huggins, Director of Finance; David Blackburn, City Attorney; Roy Osborne, Chief of Police; Captain Dennis Harkins; Barbara Sullivan, Municipal Court Judge and Carla Reese, City Secretary. Guest present: George Meriwether and Don Horning. The following items were reviewed for possible action at its regular scheduled meeting on October 11, 1988. 1) INVOCATION (Don Dickson) 2) OPENING OF COUNCIL: This meeting of the Plainview City Council is being conducted in compliance with the Texas Open Meetings Law. 3) ANNEXATION - PUBLIC HEARING - An area north of State Highway No. 194 and west of Interstate Highway No. 27. 4) HOTEL/MO~EL TAX RESERVE FUND. Resolution No. R88-196. A Resolution of the City Council of the City of Plainview, Texas, acting on a request from the Llano Estacado Museum to utilize Hotel/Motel Tax Reserve Funds. 5) SUBDIVISION - BALLARD - PRELIMINARY PLAT. Resolution No. R88-197. A Resolution of the City Council of the City of Plainview, Texas approving the preliminary plat of Ballard Subdivision, Unit No. 1 revised, Hale County, Plainview, Texas. ALL MATTERS UNDER ITEM 6 CONSENT CALENDAR ARE CONSIDE~RD TO BE ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION IN THE FORM LISTED BRT.OW. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE CLARIFICATION. ON OBJECTION BY ANY PARTY TO THE INCLUSION OF ANY ITEM ON THE CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT CALENDAR. SUCH OBJECTION MAY BE RECORDED ANY TIME PRIOR TO THE TAKING OF A VOTE ON THE MOTION TO APPROVE THE CONSENT CALENDAR. Resolution No. R88-135. A Resolution of the City Council of the City of Plainview, Texas, appointing an individual to serve on the Plumbing Board of the City of Plainview. (tabled from last Meeting) e) BOARD OF ADJUSTMENT - APPOINTMENTS. Resolution No. R88-179. A Resolution of the City Council of the City of Plainview, Texas, appointing individuals to serve on the Board of Adjustment of the City of Plainview. f) RETIRE~m~r - T~RS. Ordinance No. 88-2762. Second and final reading. An Ordinance authorizing and allowing, under the act governing the Texas Municipal Retirement System, "Updated Service C~edits" in said system for service performed by qualifying members of such system who presently are in the employment! of the City of Plainview; providing for increased prior and Current service annuities for retirees and beneficiaries of deceased retirees of the City; and establishing an effective date for such actions. g) HIG~rWA¥S. Resolution No. R88-193. A Resolution of the City Council of the City of Plainview, Texas, encouraging all Texans to vote "for" Proposition 1, the GOOD ROADS AMENDMENT. h) GRANT - COMMUNIT~ DEVELOPS. Resolution No. R88-194. A Resolution of the City Council of the City of Plainview, Texas, authorizing the submission of a Texas Community Development Program Application to the Texas Department of Commerce for the Community Development Fund; and authorizing the Mayor to act as the City's Executive Officer and authorized representative in all matters pertaining to the City's participation in the Community Development Program. i) GRAN~ - ~2~AS CAPITAL FUND. Resolution No. R88-198. A Resolution of the City Council of the City of Plainview, Texas, authorizing the submission of a Texas Community Development Program Application to the Texas Department of Commerce for the Texas Capital Fund; and authorizing the Mayor to act as the City's Executive Officer and authorized representative in all matters pertaining to the City's participation in the Community Development Program. j) ~ RELATIONS COMMISSION - APPOI~. Resolution No. R88-199. A Resolution of the City Council of the City of Plainview, Texas, appointing an individual to serve on the Human Relations Commission of the City of Plainview. 2 of 4 O0 !68 k) AUDIT. Resolution No. R88-200. A Resolution of the City Council of the City of Plainview, Texas, accepting the 1986-1987 Audit. 7) EXECUTIVE SESSION. Executive Session to discuss pending litigation as authorized by Article 6252-17 Section 2(e). (Alexander v. City of Plainview) 8) ALEXANDER V. CITY OF PLAINVIEW. Resolution No. R88-195. A Resolution of the City Council of the City of Plainview, Texas, approving a 'settlement with the plaintiffs in the Alexander v. City of Plainview litigation. ANIMAL CONTROL. Captain Dennis Harkins presented the review of Animal Control Ordinance noting the proposed changes, with the major change being cats being placed under a restraint law. Captain Harkins advised the Humane Society and Texas Department of Health were in support of the restraint law for cats. He also advised he was in receipt of 13 letters regarding the animal control ordinance with 10 letters supporting the restraint law for cats and 3 letters against the restraint law for cats. The major factors stated by the Humane Society, Texas Department of Health and individuals in favor of a restraint law for cats was due to safety factors. After some discussion it was the consensus of the Council to delete all reference to cats from the Animal Control Ordinance and place back on a Work Session Agenda for discussion with the Humane Society. AIRPORT DISADVANTAGED BUSINESS ENTERPRISE PROGRAM. Resolution No. R88-192. A Resolution of the City Council of the City of Plainview, Texas, adopting a Disadvantaged Business Enterprise Program in compliance with Section 105(f) of the Airport and Airway Safety and Capacity Expansion Act of 1987. Jim Jeffers, City Manager noted this was for the grant on the Airport and a problem had occurred with the FAA. Motion was made by Councilmember Barbara Dorman to table Resolution No. R88-192. Motion was duly seconded by Councilmember Terry Clements and carried by unanimous vote. HEALTH DEPARTMENT. Work SessiOn. Review of family planning. Tabled for future EXECUTIVE SESSION. Executive Session to discuss pending litigation as authorized by Article 6252-17 Section 2(e). (Alexander v. City of Plainview) Motion was made by Councilmember Barbara Dorman to adjourn into EXecutive Session. Motion was duly seconded by Councilmember Bobby James and carried by unanimous vote. Motion was made by Councilmember Terry Clements to return from' Executive Session. Motion was duly seconded by Councilmember Barbara Dorman and carried by unanimous vote. 3 of 4 ALEXABq)ER V. CIT~ OF PLAINVIEW. Resolution No. R88-195. A Resolution of the City Council of the City of Plainview, Texas, approving a settlement with the plaintiffs in the Alexander v. City of Plainview litigation. Motion was made by Councilmember Don Dickson to adopt Resolution No. R88-195. Motion was duly seconded by Councilmember Barbara Dorman and carried by unanimous vote. ADJOURNMENT. Motion was made by Councilmember Terry Clements to adjourn. Motion was duly seconded by Councilmember Barbara Dorman and carried by unanimous vote.
