MINUTES The Plainview City Council met in Work Session on Thursday, March 9, 1989, at 11:30 A.M. at the Plainview Country Club with Mayor E.V. Ridlehuber presiding. Councilmember present were: Junior Brown, Ross Owen, Don Dickson, and Bobby James. Councilmembers Terry Clements, Barbara Dorman and Alton Jackson were absent. Staff present: James P. Jeffers, City Manager; Mike McDonough, Director of Municipal Services; Bill Hogge, Director of Public Works; David Blackburn, City Attorney, Norman Huggins, Director of Finance; Roy Osborne, Chief of Police; Eddie Henegar, Service Center; and City Secretary, Carla Reese. News Media Present: Richard Orr - Plainview Daily Herald Guest Present: Tut Tawater and Jim Ferrell. The followin~ items were reviewed for the upcoming City Council meeting on March 14, 1989. 1) I~VOCATION (Mayor E.V. Ridlehuber) 2) OPENING OF COUNCIL: This meeting of the Plainview City Council is being conducted compliance with the Texas Open Meetings Law. in 3) HIGHWAY - $OUT~ QUINCY. Resolution No. R89-120. A Resolution of the City Council of the City of Plainview, Texas, accepting the conditions of the State Department of Highways and Public Transportation Minute Order 88237 dated January 30, 1989. 4) SANITATION - Review of proposed rate increase. 5) BUDGET AMENDMENT - HO~EL/MOTEL TAX. Tut Tawater and Jim Ferrell presented a proposal for the request of funds from the reserve account of the Hotel/Motel Tax for the promotion and advertising of the new mammoth exhibit at the Llano Estacado Museum. Ordinance No. 89-2784. An Ordinance Qf the City Council of the City of Plainview, Texas, amending the 1988-89 Budget of the City of Plainview; appropriating additional funds from the Hotel/Motel Tax Reserve Fund. ALL MATTERS UNDER ITEM 6 CONSENT CALENDAR ARE CONSIDERED TO BE ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION IN THE FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE CLARIFICATION. ON OBJECTION BY ANY PARTY TO THE INCLUSION OF ANY ITEM ON THE CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT CALENDAR. SUCH OBJECTION MAY BE RECORDED ANY TIME 1 of 4 030 PRIOR TO THE TAKING OF A VOTE ON THE MOTION TO APPROVE THE CONSENT CALENDAR. Resolution No. R89-121. A Resolution of the City Council of the City of Plainview, Texas, authorizing the Chief of Police on behalf of the City of Plainview to file a grant application for law enforcement assistance from the Criminal Justice Division of the Governor's Office of the State of Texas. e) BUILDING CODE AND FIRE CODE BOARD OF APPEALS. Ordinance No. 89-2780. An Ordinance of the City Council of the City of Plainview, Texas, amending Chapter 6 Article III (Board of Appeals) of the Plainview City Code for the purpose of updating the rules and regulations effecting the Plainview Building Code and Fire Code Board of Appeals and bringing them into conformance with current policies of the City of Plainview and providing for an effective date. f) FLOOD DAMAGE PREVENTION ORDINANCE - APPEALS BOARD. Ordinance No. 89-2779. An Ordinance amending Ordinance No. 88-2769, (Flood Damage Prevention Ordinance of the City of Plainview), by identifying the Appeals Board as the Building Code and Fire Code Board of Appeals; providing severability clause; and providing for an effective date. g) PARKS - SOFTBALL FIELDS - OPTIMIST TOURNAMENT. Resolution No. R89-119. A Resolution of the City Council of the City of Plainview, Texas, authorizing the Mayor to execute a Lease Agreement with the Noon Optimist Club of the City of Plainview for use of the Softball Complex in Running Water Draw Regional Park for the third weekend of April, 1989. h) PARKS - BASEBALL. Resolution No. R89-118. A Resolution of the City Council of the City of Plainview, Texas, authorizing the Mayor to execute a Lease Agreement and a Concession Agreement with the Optimist Summer Baseball Program. i) BUDGET - SANITATION DEPARTMENT. Ordinance No. 89-2781. An Ordinance of the City Council of the City of Plainview, Texas, amending the 1988-1989 Budget of the City of Plainview. j) GOALS AND TIMETABLES. Resolution No. R89-122. A Resolution of the City Council of the City of Plainview, Texas, establishing goals and timetables for the City of Plainview 2 of 4 031 k) .T~OC - EMCO CONTRACT 706452. Resolution No. R89-123. A Resolution of the City Council of the City of Plainview, Texas, authorizing an application for an amendment to TDOC EMCO Contract 706452. 1) LANDFILL-CONSULTING ENGINEER. Resolution No. R89-124. A Resolution of the City Council of the City of Plainview, Texas, selecting a Consulting Engineer to assist the City in permitting a new landfill. 7) RESIGNATION - COIINCILMEMBER TERRY CLE~%I~S. Resolution No. R89-126. A Resolution of the Mayor and City Council of the City of Plainview, Texas, accepting the resignation of Councilmember Terry Clements of Precinct No. 2 from the Plainview City Council. 8) BIDS - ~RUCK, BACKHOE AND MOTOR GRADERS. Resolution No. R89-127. A Resolution of the City Council of the City of Plainview, Texas awarding bids for various trucks, backhoe and two motor graders. 9) RT~CTION. Ordinance No. 89-2783. An Ordinance calling and setting the date for a Special Election; Setting date for Run-Off Election; Designating Precinct and Polling Place; Designating the election of a Councilmember from Precinct 2; approving Election Officials, setting hourly rate for Election Officials and posting notice of Special Election. 10) EXECUTIVE SESSION to discuss personnel as authorized by Article 6252-17 2(g) V.T.C.S. (City Manager Performance Evaluation) 11) BUDGET ~ - CITY MANAGER DEPARTmenT. Ordinance No. 89-2782. An Ordinance of the City Council of the City of Plainview, Texas, amending the 1988-1989 Budget of the City of Plainview. 12) CITY MANAGER - CONTRACT. Resolution No. R89-125. A Resolution of the City Council of the City of Plainview, Texas, approving a contract for services with the City Manager and authorizing the Mayor to execute such on behalf of the City of Plainview. 13) Adjournment. Southwestern Bell Telephone. Jim Jeffers, City Manager advised Council there had been no further discussions on the refranchising. City is awaiting a meeting with Southwestern Bell Telephone officials. Council was-presented with a hand out from the Telephone Franchise Committee in reference to Texas First, noting that Texas First is a proposal from Southwestern Bell to settle a rate dispute for allegedly' overcharging Southwestern Bell Telephone customers an estimated 90 million dollars. Texas First is a effort by Southwestern Bell Telephone to avoid a rate decrease and settle a contested case pending before the Public Utility Commission. Staff recommends to continue to participate in Public Utility Commission Docket No. 8585 and express the City's concerns for a thorough 3 of 4 assessment on the'merits of the Texas First proposal. TDOC - EMCO CONTRACT NO. 706542. Resolution No. R89-123. A Resolution of the City Council of the City of Plainview, Texas requesting an amendment to EMCO Contract No. 706542 from the Texas Department of Commerce. Motion was made by Councilmember Bobby James to adopt Resolution No. R89-123. Motion was duly seconded by Councilmember Don Dickson and carried by unanimous vote, with four Councilmembers present and three Councilmembers absent. Adjournment. Motion was made by Councilmember Ross Owen the meeting be adjourned. Motion was duly seconded by Councilmember Junior Brown and carried by a unanimous vote. There being no further business Mayor E.V.
