MINUTES The Plainview City Council met in Regular Session on Tuesday, March 14, 1989, at 7:30 P.M., in the Council Chambers of City Hall with Mayor E.V. Ridlehuber presiding. The following Councilmembers were present: Alton Jackson, Terry Clements, Don Dickson, Bobby James, Junior Brown and Ross Owen. Councilmember Barbara Dorman was absent. Staff present: James P. Jeffers, City Manager; Bill Hogge, Director of Public Works; Mike McDonough, Director of Municipal Services; David Blackburn, City Attorney; Norman Huggins, Director of Finance; Roy Osborne, Chief of Police and City Secretary, Carla Reese. News Media Present: Naron - KVOP/KATX. Richard Orr - Plainview Daily Herald and Wes Guest Present: Swart. Mary M. Keller, Jim Ferrell, Tut Tawwater and Dale Mayor E.V. Ridlehuber delivered the invocation. Mayor E.V. Ridlehuber welcomed the guest. Highway - South Quincy. Mayor E.V. Ridlehuber presented Resolution No. R89-120. A Resolution of the City Council of the City of Plainview, Texas accepting the conditions of the State Department of Highways and Public Transportation Minute Order 88237 dated January 30, 1989. Motion was made by Councilmember Don Dickson to adopt Resolution No. R89-120. Motion was duly seconded by Councilmember Terry Clements and carried by unanimous vote. Sanitation. Jim Jeffers, City Manager presented an overview of the proposed rate increase on the sanitation rates. It was noted the reason for the proposed increase is the need for a new landfill and new guidelines and regulations being imposed by the Texas Department of Health and Environmental Protection Agency. This is an introduction of the proposed rate increase for sanitation rates and the consideration for adoption of such an increase will be brought before the City Council for action on April 11, 1989. Budget Amendment - Hotel/Motel Tax. Ordinance No. 89-2784. A Ordinance of the City Council of the City of Plainview, Texas, amending the 1988-89 Budget of the City of Plainview; appropriating additional funds from the Hotel/Motel Tax Reserve Fund. Tut Tawwater representing the Convention and Tourism Committee presented to the Council a request for $4,910.00 from Hotel/Motel Tax Funds for advertising of the Mammoth Exhibit. Mary Keller of the 1 of 4 034 Plainview Independent School District presented a summarization of different activities the area Schools are doing to promote the mammoth exhibit. Motion was made by Councilmember Don Dickson to approve Ordinance No. 89-2784 appropriating $4,910.00 of Hotel/Motel Tax Fund monies for advertising of the mammoth exhibit. Motion was duly seconded by Councilmember Terry Clements and carried by unanimous vote. Mayor E. V. Ridlehuber presented the following Consent Calendar for approval. 6) CONSENT CALENDAR a) Minutes b) Department Reports c) Budget Expenditures d) GRANT - CRIMINAL JUSTICE DIVISION. Resolution No. R89-121. A Resolution of the City Council of the City of Plainview, Texas, authorizing the Chief of Police on behalf of the City of Plainview to file a grant application for law enforcement assistance from the Criminal Justice Division of the Governor's Office of the State of Texas. e) BUILDING CODE AND FIRE CODE BOARD OF APPEALS. Ordinance No. 89-2780. An Ordinance of the City Council of the City of Plainview, Texas, amending Chapter 6 Article III (Board of Appeals) of the Plainview City Code for the purpose of updating the rules and regulations effecting the Plainview Building Code and Fire Code Board of Appeals and bringing them into conformance with current policies of the City of Plainview and providing for an effective date. f) FLOOD DAMAGE PREVENTION ORDINANCE - APPEALS BOARD. Ordinance No. 89-2779. An Ordinance amending Ordinance No. 88-2769, (Flood Damage Prevention Ordinance of the City of Plainview), by identifying the Appeals Board as the Building Code and Fire Code Board of Appeals; providing severability clause; and providing for an effective date. g) PARKS - SOFTBALL FIELDS - OPTIMIST TOURNAMENT. Resolution No. R89-119. A Resolution of the City Council of the City of Plainview, Texas, authorizing the Mayor to execute a Lease Agreement with the Noon Optimist Club of the City of Plainview for use of the Softball Complex in Running Water Draw Regional Park for the third weekend of April, 1989. h) PARKS - BASEBALL. Resolution No. R89-118. A Resolution of the City Council of the City of Plainview, Texas, authorizing the Mayor to execute a Lease Agreement and a Concession Agreement with the Optimist Summer Baseball Program. i) BUDGET - SANITATION DEPARTMENT. Ordinance No. 89-2781. An Ordinance of the City Council of the City of Plainview, Texas, 2 of 4 amending the 1988-1989 Budget of the City of Plainview. j) GOALS AND TIMETABLES. Resolution No. R89-122. A Resolution of the City Council of the City of Plainview, Texas, establishing goals and timetables for the City of Plainview k) TDOC - EMCO CONTRACT 706452. Resolution No. R89-123. A Resolution of the City Council of the City of Plainview, Texas, authorizing an application for an amendment to TDOC EMCO Contract 706452. 1) LANDFILL-CONSULTING ENGINEER. Resolution No. R89-124. A Resolution of the City Council of the City of Plainview, Texas, selecting a Consulting Engineer to assist the City in permitting a new landfill. Resignation - Councilmember Terry Clements. Mayor E.V. Ridlehuber presented Resolution No. R89-126. A Resolution of the Mayor and City Council of the City of Plainview, Texas, accepting the resignation of Councilmember Terry Clements of Precinct No. 2 from the Plainview City Council. Motion was made by Councilmember Ross Owen to adopt Resolution No. R89-126. Motion was duly seconded by Councilmember Don Dickson and carried by unanimous vote. Bids - Trucks, Backhoe and Motor Graders. Mayor E.V. Ridlehuber presented Resolution No. R89-127. A Resolution of the City Council of the City of Plainview, Texas, accepting bids for various trucks, backhoe and two motor graders. Motion was made by Councilmember Junior Brown to adopt Resolution No. R89-127. Motion was duly seconded by Councilmember Ross Owen and carried by unanimous vote. Election. Mayor E. V. Ridlehuber presented Ordinance No. 89-2783. An Ordinance calling and setting the date for a Special Election; Setting date for Run-Off Election; Designating Precinct Polling Place; Designating the election of a Councilmember from Precinct 2; approving Election Officials; setting hourly rate for Election Officials and posting notice of Special EleCtion. Motion was made by Councilmember Don Dickson to adopt Ordinance No. 89-2783. Motion was duly seconded by Councilmember Ross Owen and carried by unanimous vote. Executive Session. Motion was made by Councilmember Terry Clements to adjourn into Executive Session. Motion was duly seconded by Councilmember Junior Brown and carried by unanimous vote. Mayor E.V. Ridlehuber adjourned the meeting into Executive Session at 8:10 P.M. Budget Amendment - City Manager Department. Ordinance No. 89-2782. An Ordinance of the City Council of the City of Plainview, Texas, amending the 1988-1989 Budget of the City of Plainview. Motion was made by Councilmember Don Dickson to adopt Ordinance No. 89-2782. Motion was duly seconded by Councilmember Alton Jackson and carried by unanimous vote. 3 of 4 O0 03a City Manager - Contract. Resolution No. R89-125. A Resolution of the City Council of the City of Plainview, Texas, approving a contract for services with the City Manager and authorizing the Mayor to execute Such on behalf of the City of Plainview. Motion was made by Councilmember Don Dickson to table action on Resolution No. R89-125 for legal review. Motion was duly seconded by Councilmember Alton Jackson and carried by unanimous vote. Adjournment. Motion was made by Councilmember Don Dickson to adjourn. Motion was duly seconded by Councilmember Terry Clements and carried by unanimous vote.
