CITY COUNCIL WORK SESSION
APRIL 6, 1989
PLAINVIEW COUNTRY CLUB
11:30 A.M.
MINUTES
The Plainview City Council met in Work Session, at 11:30 A.M., at
the Plainview Country Club, with Mayor E.V. Ridlehuber presiding.
Councilmembers present were: Bobby James, Ross Owen, Don Dickson,
Barbara Dorman and Junior Brown. Councilmember Alton Jackson was
absent. Precinct No. 2 is vacant.
Staff Present: James P. Jeffers, City Manager; Mike McDonough,
Director of Municipal Services; Bill Hogge, Director of Public
Works; David Blackburn, City Attorney; Roy Osborne, Chief of Police
and City Secretary, Carla Reese.

The City Council reviewed the following agenda items for the
upcoming meeting on April 11, 1989.
1) INVOCATION (Junior Brown)
2) OPENING OF COUNCIL:
This meeting of the Plainview City Council is being conducted in
compliance with the TeXas Open Meetings Law.
3) SANITATION RATES - Ordinance No. 89-2786. An Ordinance of the
City Council of the City of Plainview, Texas, amending Section 24-47
entitled Refuse Collection Fees; Water Termination; of the Code of
Ordinances of the City of Plainview, Texas.
4) TAX ABATEMENT - REINVESTMEN=f ZONE NO. ONE - Resolution No.
R89-133. A Resolution of the City Council of the City of Plainview,
Texas, Calling a Public Hearing on the creation of Reinvestment Zone
No. One for Commercial/Industrial Tax Abatement and authorizing
notice of such hearing.
ALL MATTERS UNDER ITEM 5 CONSENT CALENDAR ARE CONSIDERED TO BE
ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION iN THE
FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION ON THESE
ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE CLARIFICATION.
ON OBJECTION BY ANY PARTY TO THE INCLUSION OF ANY ITEM ON THE
CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT
CALENDAR. SUCH OBJECTION MY BE RECORDED ANY TIME PRIOR TO THE TAKING
OF A VOTE ON THE MOTION TO APPROVE THE CONSENT CALENDAR. ALL SUCH
ITEMS SHALL ~BE CONSIDERED INDIVIDUALLY IN THE ORDER IN WHICH THEY
ARE OBJECTED TO, IMMEDIATELY FOLLOWING THE CONSIDERATION OF THE

d) STREETS AND SIDEWALKS. Ordinance No. 89-2785. An Ordinance
amending Chapter 21, Streets and Sidewalks of the Plainview City
Code; defining terms; providing for prohibited activities and uses
on public rights-of-way; providing for use and care of public
right-of-way; providing for licenses to incumber public
right-of-way; and providing for a penalty and severability clause.
e) BID - TRACTOR AND MOWER. Resolution No. R89-132. A
Resolution of the City Council of the City of Plainview, Texas,
awarding a bid for a tractor and mower for use in the Water
Production Department.
f) PLAT - PRELIMINARY - LAKESIDE. Resolution No. R89-134. A
Resolution of the City Council of the City of Plainview, Texas,
approving the preliminary plat of Lakeside Subdivision of Block 7,
Unit No. 1, Plainview, Hale County, Texas.
6) EXECUTIVE SESSION to discuss personnel as

7) PUBLIC SAFETY DIRECTOR. Resolution No. R89-136. A Resolution of
the City Council of the City of Plainview, Texas, confirming the
appointment of a Public Safety Director.
8) BUDGET AMENDMIgYf - POLICE DEPART~R~. Ordinance No. 89-2787.
An Ordinance of the City Council of the City of Plainview, Texas,
amending the 1988-1989 Budget of the City of Plainview.
9 ) ADJO~.
City Manager - Contract. Resolution No. R89-125, was tabled until
requested information is received from Tom Hamilton.
City Council - general discussion of law and policy on City
conducting business with City elected officials. Jim Jeffers, City
Manager advised Council of a questions that had been asked by a
potential candidate for city council, "can the City continue to
trade with his business if elected". David Blackburn, City Attorney
researched such and advised that the City of Plainview Charter
strictly prohibits the City from doing business with elected
officials, even if the business of the elected official is the sole
source within the City, however, State law does not prohibit the
City from doing business with an elected official, with the
following exception, if the elected official has a substantial
interest in the business, which is 10% or more of the voting stock
or shares, or ownership of $2,500.00 or more of the fair market
value, the elected official must file an affidavit stating the
extent of this interest and refrain from participation in the

matter. David Blackburn did note that the City Charter is more
restrictive than State Law and dictates that the City may not do
business with an elected official. After some discussion the
Council expressed an interest in identifying Charter amendments to
lessen the restrictions on the City conducting business with elected
officials.
Zoning - general discussion of need for zoning change on 5th Street
to the West of Quincy Street. Mike McDonough, Director of Municipal
Services made Council aware of the options in rezoning a business on
5th Street where a junk dealer had been located. The City Council
can initiate a more restrictive zone change, which would restrict
businesses of this nature from locating in the zone, or wait until
the Comprehensive Plan is complete. It was the consensus of the
Council to wait until the Comprehensive Plan is complete and adopt
all Changes in one Ordinance.
Electrical Inspectors. Jim Jeffers, City Manager made the Council
aware of a situation that had arisen at the Board of Electrical
Examiners Meeting on March 21, 1989. Waldo Wesley had met with the
Electrical Board to discuss the possibility of changing the
Electrical code to require that the city inspectors, who inspect the
work of master and journeyman electricians, be licensed electrical
inspectors. It was noted that the city inspectors who inspect the
work of electricians, also must be building inspectors, licensed
plumbing inspectors, zoning inspectors and code enforcement
officers. Some of the possibilities that Wesley mentioned was for
the City to hire a part-time electrician, or a retired electrician
to perform electrical inspections.
Adjournment. Motion was made by Councilmember Don Dickson to
adjourn. Motion was duly seconded by Councilmember Ross Owen and
carried by unanimous vote. There being no further business Mayor
E.V. Ridlehuber adjourned the meeting at 1:00 P.M.
