O0 CITY OF PLAINVIEW CITY COUNCIL WORK SESSION JUNE 22, 1989 PLAINVIEW COUNTRY CLUB 11:30 A.M. MINUTES The Plainview City Council met in Work Session on Thursday, June 22, 1989, at 11:30 A.M., at the Plainview Country Club, with Mayor E.V. Ridlehuber presiding. Councilmembers present were: Ross Owen, Bobby James, Don Dickson, Barbara Dorman, Alton Jackson and John E. Kirchhoff. Precinct No. 6 is vacant. Staff present: James P. Jeffers, City Manager; Mike McDonough, Director of Municipal Services; David Blackburn, City Attorney; Roy Osborne, Director of Public Safety; Barbara Sullivan, Municipal Court Judge; and City Secretary, Carla Reese. News Media Present: Richard Orr - Plainview Daily Herald. The City Council reviewed the following agenda items for the upcoming meeting on June 27, 1989. 1) INVOCATION (Mayor E.V. Ridlehuber) 2) OPENING OF COUNCIL: This meeting of the Plainview City Council is being conducted in compliance with the Texas Open Meetings Law. 3) Youth - "Parking Lot". Resolution No. R89-160. A Resolution of the City Council of the City of Plainview, Texas, recognizing the need to establish a lawful gathering place for the youth of our community and authorizing the Mayor to execute an agreement for the leasing of such property to accomplish such purpose. 4) Youth - "Parking Lot". Ordinance No. 89-2795. An Ordinance designating a parking lot located at 2801 Olton Road, Plainview, Texas, as a public place during certain times, setting a maximum speed limit thereon during such times; authorizing the Director of Public Safety to regulate the operation and parking of vehicles at such location during certain times; providing for a penalty; and other related provisions. Bond - Re-roofing. Ordinance No. An Ordinance providing that persons desiring to engage in the business of roofing contracting in the City of Plainview will provide the City with a Performance Bond. Building Code - Roofing Requirements. Ordinance No. . An Ordinance of the City of Plainview establishing minimum standards for re-roofing structures within the City of Plainview, providing for inspections of the re-roofing of structures and requiring 1 of 4 ©9 permits for each re-roofing job; establishing a requirement that all roofing contractors be licensed annually with the City of Plainview; requiring proof of liability insurance be provided by roofing contractors; and establishing a penalty for the violation of this Ordinance. ALL MATTERS UNDER ITEM 5 CONSENT CALENDAR ARE CONSIDERED TO BE ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION IN THE FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION ON THESE ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE CLARIFICATION. ON OBJECTION BY ANY PARTY TO THE INCLUSION OF ANY ITEM ON THE CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT CALENDAR. SUCH OBJECTION MY BE RECORDED ANY TIME PRIOR TO THE TAKING OF A VOTE ON THE MOTION TO APPROVE THE CONSENT CALENDAR. ALL SUCH ITEMS SHALL BE CONSIDERED INDIVIDUALLY IN THE ORDER IN WHICH THEY ARE OBJECTED TO, IMMEDIATELY FOLLOWING THE CONSIDERATION OF THE CONSENT CALENDAR. 5) CONSE CALENDA a) Minutes b) Department Reports c) Budget Expenditures d) Property Sale. Resolution No. R89-157. A Resolution of the City Council of the City of Plainview, Texas, authorizing the Mayor to execute a Tax Deed on behalf of the City of Plainview in regard to property located at 2518 Holiday Drive, Plainview, Texas, more properly described hereunder. e) Budget Amendment - City Manager. Ordinance No. 89-2794. An Ordinance of the- City Council of the City of Plainview, Texas, amending the 1988-1989 Budget of the City of Plainview. 6) Executive Session to discuss the purchase, exchange, lease or value of real property as authorized by Article 6252-17 Section 2(f) V.T.C.S. (Sanitary Landfill). 7) Sanitary Landfill. Resolution No. R89-159. A Resolution of the City Council of the City of Plainview, Texas, authorizing the Mayor to execute the necessary documents in order to acquire land to be used as a Sanitary Landfill. 8) Adjournment. Water - Seth Ward. David Blackburn, City Attorney presented a review of the concerns and comments that Seth Ward Water Supply Corporation had submitted in referemce to the proposed contract. Service Area, Seth Ward Water Corporation has requested the service area be extended to two blocks East on Lancaster or, include homes on East side of Wood Street. Council was of the consensus to not extend the service area any further than the Contract has stated. Inspection, Seth Ward Water Corporation has requested that the City 2 of 3 078 of Plainview shall only have the right to inspect water wells on the customers premises where there is reasonable grounds to suspect cross connections or contamination, and there shall be a representative of the Seth Ward Water Corporation accompanying the City of Plainview employee inspecting such well. Also Seth Ward Water Supply Corporation has requested that in the event the Corporation fails to correct a problem of cross connection or contamination within ten days, or if Corporation fails to disconnect service to the offending customer, then the City of Plainview would reserve the right to suspend its obligation under this Contract. Council was of the consensus that the City of Plainview should reserve the right to inspect any customers well at any time, with a representative of the Seth Ward Water Supply Corporation accompanying the inspector and if Corporation fails to correct a problem with cross connection or contamination within ten days then the City reserves the right to suspend the Contract. Method of rate determination, Corporation has concerns that they would be assessed total costs of system study and they feel they should only be charged a pro-rata costs of such study. Council was of the consensus that Seth Ward Water Supply Corporation should only be required to share in a pro-rata costs of the water system study. Monthly reports, Corporation has requested that the reports be changed to quarterly and instead of the report being based on the water metered be changed to the amount of water the system metered. Council was of the consensus to request reports on a Monthly basis and the reports be based on the amount of water metered. Duration, Termination, Corporation feels, the failure to make timely payments or comply with Federal, State or Municipal Law or with any of the provisions of the Contract are ambiguous, or conflict, or superfluous. Council was of the consensus that the notice provision of sixty days was adequate, and provisions should be much shorter when due to cross connection or contamination. Penalties, Corporation has requested the opportunity to know of such violation and be given sixty days before penalty is assessed. Council was of the consensus if Corporation violates any of the provisions stated that the penalty of 1,000 should be assessed. Compliance with City Laws, Corporation request that they be allowed to enforce comparable provisions of the Code, Ordinances and Resolutions of the City of Plainview as such pertains to water supplied under this Contract. Council was of the consensus that what the Corporation was requesting and the wording of the Contract was one in the same. Maintain facilities, Corporation has requested that they shall be responsible for properly measuring the quantity of water delivered at the delivery point. Council was of the consensus that the Corporation shall be responsible for properly measuring the quantity of water delivered under this Contract. It was also noted that Seth Ward Water Corporation was ready to begin tying on its customers to the system when it had water ready to supply. Contract must be signed and in place before the City can start furnishing water. Board Appointments Jim Jeffers, City Manager advised Council that appointments were still needed on the Board of Adjustments and Building Code and Fire Code Board of Appeals. 3 of 4 O0 079 6arage Sale regulations, Mike McDonough, Director of Municipal Safety noted that regulations on garage sales were added to the Zoning Ordinance back in the 1970's and consisted of the following regulations: garage sales should not exceed three consecutive days, no items purchased for resale, one unlighted advertising sign, and no items shall be displayed outside the garage. Council was of the consensus to comply with regulations in the current Ordinance and notify citizens there are regulations and guidelines for garage sales. Water and Sewer Service Outside City Limits Jim Jeffers, City Manager presented to the Council a proposed policy statement for water and sewer service outside the city limits. It was noted that the City of Plainview should have such a policy, otherwise if any complications arouse the Texas Water Commission could become involved. Council was advised to review this policy and if there were no problems it would be placed on the next agenda for approval. Public Safety Consolidation Roy Osborne, Director of Public Safety advised that due to some current changes in laws and resignations in the Police and Fire Departments there should be a corps of six public safety officers in place by this time next year. Master Plan. Council was advised of the Public Hearing on June 22, 1989 at 7:30 P.M. It was noted that the Planning and Zoning Commission might possibly make its final recommendation to the Council at this meeting. Adjourn. Motion was made by Councilmember Ross Owen to adjourn. Motion was duly seconded by Councilmember Bobby James and carried by a unanimous vote. There being no further business Mayor E. V. Ridlehuber adjourned the meeting at 12:50 P.M.
