MINUTES
The Plainview City Council met in Regular Session, Tuesday, July
11, 1989, at 7:30 P.M., in the Council Chambers of City Hall with
Mayor E.V. Ridlehuber presiding. The following Councilmembers were
present: Alton Jackson, John E. Kirchhoff, Don Dickson, Bobby
James, Barbara Dorman and Ross Owen. Precinct No. 6 is vacant.
Staff Present: James P. Jeffers, City Manager; Mike McDonough,
Director of Municipal Services; David Blackburn, City Attorney;
Bill Hogge, Director of Public Works; Norman Huggins, Director of
Finance; Roy Osborne, Director of Public Safety; Janice Anderson,
Secretary to Municipal Services, Barbara Sullivan, Municipal Court
Judge and City Secretary, Carla Reese.
Planning and Zoning Commission members present: Dwain Dodson, Pam
Moore, Bill Ramsey, Linda Thompson, David DeBusk, Ron Gammage and
Yvonne Hernandez.

Guest Present: Norman Dulaney, Robert E. Carter, Tom Aday, Rick

Medlin Carpenter, Gene Hembree, Frankie Hembree, Jimmy Bublis,
Shanda Lindemin.
Councilmember Barbara Dorman delivered the invocation.
Mayor E. V. Ridlehuber welcomed the guest.
Zoning Ordinance. Mayor E.V. Ridlehuber introduced a Joint Public
Hearing of the City of Plainview City Council and Planning and
Zoning Commission to receive input on the proposed comprehensive
revision of the City of Plainview Zoning Ordinance and Map.
Councilmember Barbara Dorman made a motion to call the Public
Hearing. Motion was duly seconded by Councilmember Don Dickson and
carried by a unanimous vote. Mike McDonough, Director of Municipal
Services introduced Ron Gammage, Chairman of the Planning and
Zoning Commission, and noted that the Planning and Zoning
Commission recommended the proposed Zoning Ordinance in its final
draft to the City Council on June 29, 1989. Ron Gammage introduced
Lee Lawrence with Governmental Services, Agency, Inc. Lee Lawrence
with Governmental Services Agency, Inc. reviewed the proposed
Zoning Ordinance noting that the current Zoning Ordinance was a
cumulative ordinance and allows for different uses in cumulative
districts, as where the proposed Zoning Ordinance is not a
cumulative ordinance and allows for limited uses in cumulative

districts. Lawrence also outlined the following proposed changes
in the proposed Zoning Ordinance; two new districts have been
created for Colleges and Universities and Office Districts; Day
Care Centers have specific requirements for their locations;
PriVate Clubs and Private Club Restaurants are classified as two
different issues and have different zoning requirements; and all
reference to Landscaping requirements have been deleted; all other
changes were only minor changes from the current Zoning Ordinance.
Those speaking in favor of the proposed Zoning Ordinance were,
Medlin Carpenter and Tom Ada¥. Those speaking in opposition of the
proposed Zoning Ordinance were, Norman Dulaney, Gene Hembree, and
Delton Waggoner. Motion was made by CounCilmember Barbara Dorman
to close the public hearing. Motion was duly seconded by
Councilmember Ross and Owen and carried by a unanimous vote.
Motion was made by Councilmember Barbara Dorman to place
landscaping requirements in the proposed Zoning Ordinance. Motion
was duly seconded by Councilmember Bobby James. Motion failed with
a vote of 3 ayes and 3 nays. Motion was made by Councilmember Don
Dickson to amend the prior motion to place landscaping requirements
in the proposed Zoning Ordinance, but delete all reference to
paragraph 3 on page 124, of the proposed Zoning Ordinance, which
refers to tree requirements. Motion was duly seconded by
Councilmember Alton Jackson. Motion failed with a vote of 2 ayes
and 4 nays. Motion was made by Councilmember John E. Kirchhoff to
leave landscaping requirements out of the proposed Zoning
Ordinance. Motion died due to lack of a second. Motion was made
by Councilmember Don Dickson to place landscaping requirements in
the proposed Zoning Ordinance, with the exception of deleting size
requirements on trees as referenced in paragraph 3, page 124, of the
proposed Zoning Ordinance. Motion was duly seconded by
Councilmember Ross Owen and carried by a vote of 5 ayes and 1 nay.
Motion was made by Councilmember Don Dickson to accept the
recommendations of the Planning and Zoning Commission with the
amendments as adopted, and for staff to make the final draft for
adoption at meeting of July 25, 1989. Councilmember John Kirchhoff
amended the motion, stating he wanted Lee Lawrence of Governmental
Services Agency to provide the results of the reports on items
directly having a bearing on the proposed Zoning Ordinance a week
prior to the meeting of July 25, 1989. Lee Lawrence of
Governmental Services Agency advised Council there would be no
problem in making these reports available to the Council a week
prior to the meeting of July 25, 1989. Councilmember John E.
Kirchhoff withdrew his amendment to the motion. Motion was duly
seconded by Councilmember Ross Owen and carried by a unanimous
vote.
Youth - "Parking Lot". Mayor E.V. Ridlehuber noted Resolution No.
R89-i60, a Resolution of the City Council of the City of Plainview,
Texas, recognizing the need to establish a lawful gathering place
for the youth of our community and authorizing the Mayor to execute
an agreement for the leasing of such property to accomplish such
purpose, is tabled.

Youth - "Parking LOC'. Mayor E.V. Ridlehuber noted Ordinance No.
89-2795, an Ordinance designating a parking lot located at 2801
Olton Road, Plainview, Texas, as a public place during certain
times, setting a maximum speed limit thereon during such times;
authorizing the Director of Public Safety to regulate the operation
and parking of vehicles at such location during certain times;
providing for a penalty; and other related provisions, is tabled.
Mayor E.V. Ridlehuber presented the following Consent Calendar for
approval noting that Item d) Property Sale has been tabled.

Tabled d) Property Sale. Resolution No. R89-157. A Resolution of
the City Council of the City of Plainview, Texas, authorizing the
Mayor to execute a Tax Deed on behalf of the City of Plainview in
regard to property located at 2518 Holiday Drive, PlainView, Texas,
more properly described hereunder~ (Tabled from meeting of June 27,
1989.)
e) Sanitation - Recycling. Resolution No. R89-162. A
Resolution of the City Council of the City of Plainview, Texas,
authorizing the City Manager to contract for the removal and
purchase of scrap metals at the Municipal Landfill.
f) SYAG - Agreement. Resolution No. R89-163. A Resolution of
the City Council of the City of Plainview, Texas, authorizing the
Mayor to execute an Interlocal Governmental Cooperation Contract for
administrative services with the South Plains Association of
Governments, as such pertains to a Texas Department of Commerce
Grant.
g) Seth Ward Water Supply Agreement. Resolution No. R89-161.
A Resolution of the City Council of the City of Plainview, Texas,
authorizing the Mayor to execute a Water Supply Agreement with Seth
Ward Water Supply Corporation.
Motion was made by Councilmember Barbara Dorman to adopt the
Consent Calendar as stated. Motion was duly seconded by
Councilmember Ross Owen and carried by a unanimous vote.
Executive Session to discuss the purchase, exchange, lease or value
of real property as authorized by Article 6252-17 Section 2 (f)
V.T.C.S. (Sanitary Landfill) (Other City Properties). Mayor E.V.
Ridlehuber announced no Executive Session would be held.
Motion was made by Councilmember Ross Owen to adjourn. Motion was
duly seconded by Councilmember Don Dickson and carried by a
unanimous vote. There being no further business Mayor E. V.
Ridlehuber adjourned the meeting at 8:55 P.M.
