CITY COUNCIL MEETING
SEPTEMBER 12, 1989

MINUTES
The Plainview City Council met in Regular Session, Tuesday,
September 12, 1989, at 7:30 P.M., in the Council Chambers of City
Hall with Mayor E.V. Ridlehuber presiding. The following
Councilmembers were present: Alton Jackson, John E. Kirchhoff, Don
Dickson, Bobby James, Barbara Dorman, and Ross Owen. Precinct No.
6 is vacant.
Staff Present: James P. Jeffers, City Manager; Mike McDonough,
Director of Municipal Services; Norman Huggins, Director of
Finance; Bill Hogge, Director of Public Works; Rolando Vela,
Administrative Assistant; Roy Osborne, Director of Public Safety;
and City Secretary, Carla Reese.

Guest Present: Rev. Walter Jackson, Trevino Uddley, Rosa Favila
Zuniga, Rev. Glen D. Young, Mrs. Melanie Young, Thomas Riggins,
Mrs. Lexie B. Riggins, Marcela Dominguez, Elder A.L. Hervey, Noemi
Enriquez, Noemi Sirisa, Ramon Enriquez, Allen Clary, Mrs. Allen
Clary, R.A. Vernon, Jimmie Mason, Mrs. Jimmie Mason, Mary Lou
Truesdale, Barbara Sullivan, Robert Kirchhoff, Mrs. Robert
Kirchhoff, Jesus Hernandez, Mrs. Jesus Hernandez, Randy Warrick and
Joe Sherman.
Councilmember Don Dickson delivered the invocation.
Mayor E. V. Ridlehuber welcomed the guest.
Councilmember Barbara Dorman made a motion to suspend the rules and
table Items No. 3 and 4 as posted on the Agenda until the old
business in Item No. 5 is taken care of. Motion was duly seconded
by Councilmember Ross Owen and carried by a unanimous vote.
Zone Case 557 - Specific Use Permit - Jesus Hernandez. Mayor E.V.
Ridlehuber introduced Ordinance No. 89-2797. An Ordinance amending
Zoning Ordinance No. 82-2478 and the official Zoning Map of the
City of Plainview so as to make the following changes: Request of
Jesus Hernandez, for a Specific Use Permit - club serving alcoholic
beverages in a C.B. (Central Business District) zoning district
being Lots 27, 28, 29, and 30, Block 26, Original Town Addition and
located at 617 Ash. Those present speaking in opposition of the
Specific Use Permit were, R.A. Vernon, Randy Warrick, Jimmie Mason
and Lyn Kirchhoff. Motion was made by Councilmember Bobby James to
approve Zone Case 557 - Specific Use Permit with the following
exceptions: Club would be open four day a week, Thursday thru
SUnday; a six foot fence would be built at the back of the property
and customers would only be allowed in and out the front door;

well lighted front, rear and alley of club; immediate and adjacent
area would be policed daily for trash; two uniform security guards
would be on duty; and it would be subject to periodic reviews by
the City. Motion was duly seconded by Councilmember Ross Owen and
carried by a unanimous vote.
Election - Canvass - Precinct 6 - Run-Off Election. Mayor E.V.
Ridlehuber introduced Resolution No. R89-180. A Resolution of the
City Council of the City of Plainview, Texas, ordering the canvass
of election returns and declaring the results of the Run-Off
Election held on September 9, 1989. Motion was made by
Councilmember Barbara Dorman to adopt Resolution No. R89-180.
Motion was duly seconded by Councilmember Ross Owen and carried by
a unanimous vote.
City Council - Oath of Office - Precinct 6. Mayor E.V. Ridlehuber
presented the Oath of Office to Dwain Dodson, and swore him into
the position of Councilmember - Precinct No. 6.
TDOC - Community Development Fund. Resolution No. R89-179. A
Resolution of the City Council of the City of Plainview, Texas,
authorizing the submission of a Texas Community Development
Program Application to the Texas Department of Commerce for the
Community Development Fund and authorizing the Mayor to act as the
City's executive officer and authorized representative in all
matters pertaining to the City's participation in the Community
Development Program. Rolando Vela, Administrative Assistant
advised that four public hearings have been conducted on the Texas
Community Development Fund and strong public approval has been
received for this grant. Motion was made by Councilmember Barbara
Dorman to adopt Resolution No. R89-179. Motion was duly seconded
by Councilmember Bobby James and carried by a unanimous vote.
Budget 1989-1990. Jim Jeffers, City Manager introduced the City of
Plainview Budget for 1989-1990. Motion was made by Councilmember
Don Dickson to call a Public Hearing. Motion was duly seconded by
Councilmember Ross Owen and carried by a unanimous vote. There
were no persons speaking in favor or opposition to the Budget for
1989-1990. Motion was made by Councilmember Barbara Dorman to
close the Public Hearing. Motion was duly seconded by
Councilmember Alton Jackson and carried by a unanimous vote.
Insurance Bids - Conflict of Interest Declaration. Councilmember
Ross Owen read the Conflict of Interest Declaration, noting that he
would abstain from voting on the awarding of the bid for the City
of Plainview Insurance.
Mayor E.V. Ridlehuber presented the following Consent Calendar for
approval.

d) Budget - 1989-1990. Introduction of Ordinance No. 89-2800.
An Ordinance adopting and approving the Budget for the fiscal year
beginning October 1, 1989, and terminating September 30, 1990, and
making appropriations for each department, project and account.
e) Tax Levy. Introduction of Ordinance No. 89-2801. An
Ordinance levying Municipal Ad Valorem Taxes for the City of
Plainview, Texas, for the year 1989, and directing the assessment
and collection thereof.
f) Health Department - TDH Document C0000552. Resolution No.
R89-181. A Resolution of the City Council of the City of
Plainview, Texas, authorizing the Mayor to execute TDH Document
C0000552 as such pertains to Community and Rural Health; Maternal
and Child Health and Immunization.
Motion was made by Councilmember Ross Owen to adopt the Consent
Calendar as stated. Motion was duly seconded by Councilmember
Barbara Dorman and carried by a unanimous vote.
Executive Session. Motion was made by Councilmember Don Dickson to
adjourn into Executive Session. Motion was duly seconded by
Councilmember Bobby James and carried by a unanimous vote.
Mayor E.V. Ridlehuber adjourned the meeting from Executive Session
at 10:05 P.M. with no action being taken.
Adjournment. Motion was made by Councilmember Ross Owen to
adjourn. Motion was duly seconded by Councilmember Barbara Dorman
and carried by a unanimous vote. There being no further business
Mayor E.V. Ridlehuber adjourned the meeting at 10:08 P.M.
