MINUTES The Plainview City Council met in Regular Session on Tuesday, November 28, 1989, in the Council Chamber of City Hall at 7:30 P.M. with Mayor E.V. Ridlehuber presiding. The following Councilmembers were present: Alton Jackson, John E. Kirchhoff, Don Dickson, Bobby James, Dwain Dodson and Ross Owen. Councilmember Barbara Dorman was absent. Councilmember Alton Jackson entered at the meeting at 7:50 P.M. Staff Present: James P. Jeffers, City Manager; Mike McDonough, Director of Municipal Services; Bill Hogge, Director of Public Works; Norman Huggins, Director of Finance; David Blackburn, City Attorney; Roy Osborne, Director of Public Safety; Barbara Sullivan, Municipal Court Judge; and Carla Reese, City Secretary. News Media Present: Richard Orr - Plainview Daily Herald. Guest Present: R.C. Stevens, John Warrick, J.G. Brewer, Carol Brewer, Roy Tullis, Jay Laird, Bill Cartwright, Dorothy Tullis, Jerry Wofford, Paul Johnson, Joe McKinnis, W.M. Tyler, David Williams, R.R. Carruth, R.P. Carruth, Andy Taylor, Jr., Andy Taylor, Sr. and Jerry Hinnenkamp. Councilmember Dwain Dodson delivered the invocation. Mayor E.V. Ridlehuber welcomed the guest. Drug Awareness. Mayor E.V. Ridlehuber introduced Resolution No. R89-207. A Resolution of the City Council of the City of Pl~inview, Texas, that the City of Plainview declares December 3 thru 9, 1989, as "Cities Fight Back Against Drugs Week", and sponsoring activities in support of the fight against drugs. Councilmember Ross Owen read the entire Drug Awareness Resolution. Barbara Sullivan, Municipal Court Judge presented an overview of the activities that the City of Plainview was sponsoring in support of Drug Awareness Week. Motion was made by Councilmember Don Dickson to adopt Resolution No. R89-207. Motion was duly seconded by Councilmember Dwain Dodson and carried by a unanimous vote. In conjunction with Drug Awareness Week Roy L. Osborne, Director of Public Safety advised of a memo from the officers and employees of the Police Department asking for the permission and support of the Council for voluntary drug testing. Motion was made by Councilmember John Kirchhoff to commend and support the officers and employees of the Police Department for voluntary drug testing. Motion was duly seconded by Councilmember Dwain Dodson and carried by a unanimous vote. 1 of 3 O0 157 Cable TV - Public Access - WBU. Mayor E.V. Ridlehuber introduced Resolution No. R89-199. A Resolution of the City Council of the City of PlainvieW, Texas, urging the Congress of the United States to revise the Cable Communications Policy Act of 1984, and expressing general concern about the need for greater local government regulatory authority. Fred Nichols of Teleservice Corporation objected to the wording in the Resolution which reflects that service is decreased, programming has substantial decrease in service reduction, programming changes do not reflect consumers needs, and asked that this wording be deleted before being sent to Congress. Nichols also noted that he felt that Teleservice Corporation had acted responsibly and that the company has given good' service to its consumers. Nichols reviewed the regulations by the FCC, the rates and programming cost. Motion was made by Councilmember Don Dickson to adopt Resolution No. R89-199, deleting paragraph number three that reads, municipalities throughout the nation, including Plainview, have been subjected to substantial rate increases, service reductions and programming changes that do not reflect consumers' needs or the original intent of the franchise agreement. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. Subdivision Regulations - Building Permit Variance - Plainview Housing Limited.. Mayor E.V. Ridlehuber introduced Resolution No. R89-206. A Resolution of the City Council of the City of Plainview, Texas, granting a variance from the Subdivision Ordinance by allowing the issuance of a building permit for the construction of an Apartment Complex on the West side of Mesa Drive, South of 13th Street, prior to the completion of the platting process. Richard Carruth of Plainview Housing Limited advised that they were asking for the issuance of a building permit on the plans as originally designed, to enable the Apartment Complex to progress before the law of January 18, 1990, requires that all apartments on the ground floor be built handicapped accessible, which will cost in excess of $400,000 from the original planS. Carruth noted that the apartment complex is now designed that 16 of the 88 apartments will be handicapped accessible. Medlin Carpenter spoke in favor of the City issuing the building permit, due to the need for additional housing. Paul Lyle spoke in opposition of the City issuing the building permit. Motion was made by Councilmember Bobby James that Resolution No. R89-206 be tabled until the meeting of December 12, 1989, awaiting additional information on this project from Carruth. Motion was duly seconded by Councilmember Alton Jackson and carried by a vote of 5 ayes and 1 nay. Sanitation - Landfill. Jim Jeffers, City Manager, presented Resolution No. R89-205. A Resolution of the City Council of the City of Plainview, Texas, requesting a delay in the implementation of proposed Environmental Protection Agency regulatior~ until 1994. Motion was made by Councilmember Bobby James to adopt Resolution No. R89-205. Motion was duly seconded by Councilmember John Kirchhoff and carried by a unanimous vote. 2 of 3 Budget Amendment - Personnel. Jim Jeffers, City Manager presented Ordinance No. 89-2810. An Ordinance of the City of Plainview amending the 1989-1990 Budget: granting most employees a four percent salary increase in January, 1990. Motion was made by Councilmember Dwain Dodson to adopt Ordinance No. 89-2810. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. Mayor E.V. Ridlehuber presented, the following Consent Calendar for approval, noting that Item f) Housing - Resolution No. R89-210 be tabled and removed from the Consent Calendar. 8) CONSENT CALENDAR a) Minutes b) Department Reports c) Budget Expenditures d) Street - Plainview Christian Academ~. Resolution No. R89-208. A Resolution of the City Council of the City of Plainview, Texas, authorizing the Mayor to execute a promissory note with the Plainview Christian Academy. e) Budget - Airport. Resolution No. R89-209. A Resolution of the City Council of the City of Plainview, Texas, approving the 1990 Budget for the Plainview/Hale County Airport. TABLED f) Housing. Resolution No. R89-210. A Resolution of the City Council of the City of Plainview, Texas, authorizing participation in a feasibility study for a MAI community assessment and report. Motion was made by Councilmember Alton Jackson to approve the Consent Calendar as stated. Motion was duly seconded by Councilmember Ross Owen and carried by a unanimous vote. Adjournment. Motion was made by Councilmember Ross Owen to adjourn. Motion was duly seconded by Councilmember Don Dickson and carried by a unanimous vote. There being no further business Mayor E.V.
