CITY COUNCIL MEETING

MINUTES
The Plainview City Council met on Tuesday, December 21, 1989, at
11:30 A.M., at the Plainview Country Club, with Mayor E.V.
Ridlehuber presiding. Councilmembers present were: Bobby James,
Dwain Dodson, Don Dickson, Barbara Dorman, Ross Owen; John
Kirchhoff and Alton Jackson.
Staff present: James P. Jeffers, City Manager; Mike McDonough,
Director of Municipal Services; David Blackburn, City Attorney;
Rolando Vela, Administrative Assistant; Roy L. Osborne, Director
of Public Safety; and City Secretary, Carla Reese.
The City Council reviewed the following agenda items for the
upcoming meeting on December 21, 1989.
1) INVOCATION
2) OPENING OF COUNCIL
This meeting of the Plainview City Council is being conducted in
compliance with the Texas Open Meetings Law.
3) Zone Case 558 - Specific Use Permit. Ordinance No. 89-2811
entitled "An Ordinance amending Zoning Ordinance No. 89-2798 and the
official zoning map of the City of Plainview so as to make the
following changes: request of J. C. Funderburk for a Specific Use
Permit - Club serving alcoholic beverages in a C-3 (Commercial
General Business) Zoning District, for commercial uses and located
at 1301 S. 1-27.
4) Freeport Exemption
a. Ordinance No. 89-2813. An Ordinance of the City of
Plainview, Texas, providing for the taxation of property exempt
under article VIII., Section l-j, Texas Constitution beginning with
the 1990 tax year.
b. Tax Abatement. Resolution No. 89-215. A resolution of the
City of Plainview, Texas, authorizing the Mayor to execute an
agreement with Wal-Mart, Inc. terminating the tax abatement
agreement.
5) Sanitation - Rate Adjustment. Ordinance No. 89-2814. An
Ordinance of the City of Plainview, Texas, amending Section 24-47
entitled, "Refuse Collection Fees; Water Termination", of the Code
of Ordinances of the City Plainview, Texas.
6) Alarm - False. Ordinance No. 89-2812. An Ordinance amending
Chapter 17, of the Plainview City Code, offenses, providing for
registration and regulation of alarm systems within the City of

Plainview; providing for an increase in fees;
effective date and other related matters.

7) Housing. Resolution No. 89-210. A Resolution of the City of
Plainview, Texas, authorizing participation in a housing need and
feasibility study for the City of Plainview.
ALL MATTERS UNDER ITEM 8 CONSENT CALENDAR ARE CONSIDERED TO BE
ROUTINE BY THE CITY COUNCIL AND WILL BE ENACTED ON A MOTION IN THE
FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUSSION ON THESE
ITEMS OTHER THAN THE ASKING OF QUESTIONS FOR SIMPLE CLARIFICATION.
ON OBJECTION BY ANY PARTY TO THE INCLUSION OF ANY ITEM ON THE
CONSENT CALENDAR, THAT ITEM SHALL BE REMOVED FROM THE CONSENT
CALENDAR. SUCH OBJECTION MAY BE RECORDED ANY TIME PRIOR TO THE
TAKING OF A VOTE ON THE MOTION TO APPROVE THE CONSENT CALENDAR.
ALL SUCH ITEMS SHALL BE CONSIDERED INDIVIDUALLY IN THE ORDER IN
WHICH THEY ARE OBJECTED TO, IMMEDIATELY FOLLOWING THE CONSIDERATION
OF THE CONSENT CALENDAR.
8 ) CONSENT CALENDAR
a) Minutes
b) Department Reports
c) Budget Expenditures
d) Bids - Vehicles. Resolution No. R89-214. A Resolution of
the City Council of the City of Plainview, Texas, awarding bids for
various vehicles.
e) Museum - Llano Estacado - Agreement. Resolution No.
R89-216. A Resolution of the City of Plainview, Texas, authorizing
the Mayor to execute a Hotel/Motel Occupancy Tax Revenue Sub-Grant
Agreement with the Museum of the Llano Estacado, of Wayland Baptist
University.
f) Budget Amendment - Hotel/Motel - Museum. Ordinance No.
89-2815. An Ordinance of the City of Plainview, amending the
1989-1990 Budget of the City.
g) Airport - Joint Agreement with Count~/. Resolution No.
R89-217. A Resolution of the City of Plainview, Texas, authorizing
the Mayor to execute an agreement with Hale County, creating a Joint
Airport Board and setting fourth said Board's duties and powers.
9) Adjournment.
Traffic. Jim Jeffers, City Manager advised the Council that
Public Safety has reviewed the request of the Lakeside PTA to make
one block of Independence a one-way street. Public Safety has
advised that it could be hazardous to make one block on
Independence Street a one-way street, but suggested no parking
zones to eliminate some the traffic congestion in that block. The
proposal was submitted to the Lakeside PTA and they were not

satisfied with the suggestion. Roy L. Osborne, Director of Public
Safety is to meet with Debbie Price, President of the PTA at
Lakeside and review this matter.
County - Jail Building Permit. Jim Jeffers City Manager advised
the Council of a letter from Commissioner Henry Reiff asking for
the permits for the addition to the County jail and offering to
pay the permit fees if necessary.
County Housing City Prisoners. Jim Jeffers, City Manager advised
Council that he had talked with County Judge Bill Hollars
concerning the County housing City prisoners. A letter making the
formal request for the County to house City prisoners is being
drafted.
Council. Review of plans for a display honoring the past and
existing elected officials. This item was deferred until
information from Terri Beth Dillard is received.
Public Safety Consolidation. Roy L. Osborne, Director of Public
Safety distributed to the Council a Public Safety Consolidation
Report, noting the employment of seven Public Safety Officers.
TDOC - Frisco/Austin Height Project. DaVid Blackburn, City
Attorney advised, that a letter had been sent to Santa Fe officials
and they are to send a representative from Santa Fe to review this
project in January.
Minutes. Jim Jeffers, City Manager reminded the Council of the
importance of reading the minutes from each meeting for accuracy.
Adjournment. Motion was made by Councilmember Ross Owen to
adjourn. Motion was duly seconded by Councilmember Don Dickson
and carried by a unanimous vote. There being no further business
Mayor E.V. Ridlehuber adjourned the meeting at 12:45 P.M.
